RFO FAR 52.212-2 Evaluation—Commercial Products and Commercial Services.
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
(1) Non-Price Evaluation Factor -Technical Capability: The offeror shall provide all information required for the Government POC to evaluate the quotes for compliance with the requirements detailed in the PWS. The Government will subjectively evaluate the offeror's comprehensive understanding of the requirement and the feasibility of their proposed approach to successfully fulfill the contract requirements. The submittals will be evaluated to determine whether the proposed approach demonstrates a clear understanding of the requirement defined in the PWS.
Offerors’ technical proposals will receive an overall rating based on the following:
Technically Acceptable: Offeror meets all requirements or technical specifications or has submitted all documentation requested in any technical evaluation criteria and all documentation meets the standard set forth in the solicitation.
Technically Unacceptable: Offeror fails to meet all requirements or technical specifications or has failed to comply in submitting requested documentation in any technical evaluation criteria or the submitted documentation fails to meet the standard set forth in the solicitation.
Price Evaluation Factor: Offerors shall complete Attachment 2: Pricing Sheet with best and final pricing. The proposed price will be evaluated for fairness and reasonableness in relation to the solicitation requirements. Prices must be entirely compatible with the technical capability portion of the proposal.
Proposals will be evaluated initially independently of the price to determine the Offerors’ ability to meet the Government’s requirement set forth in the solicitation. The Government may make a final rating determination based on the proposal as submitted without requesting any further information. The Government will award a contract to the responsible vendor whose quotation represents the Best Value to the Government, Price and Technical Capability considered. The non-price factor, Technical Capability, is significantly more important than Price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
