About this file

This is a Code of Conduct Acknowledgement Form issued by the State of Michigan Department of Natural Resources for evaluation members participating in the procurement process for RFP 21-1202 LED Polaris ATV/ORV. The form establishes the mandatory requirements and ethical standards that all evaluation team members must follow throughout the evaluation, negotiation, and award process. Evaluators are required to comply with Michigan Civil Service rules, the State Ethics Act, and the Michigan Procurement Policy Manual. Additionally, evaluators must disclose any actual or potential conflicts of interest involving bidders or situations that could compromise their impartial participation, including conflicts affecting their immediate family members as defined by Civil Service rules.

The form outlines eleven specific obligations for evaluation members, including performing duties impartially without bias, reviewing and understanding all solicitation documents and proposals, attending scheduled evaluation meetings prepared to actively participate, maintaining confidentiality of evaluation details until award notification is made, and attending post-award activities such as debrief meetings and vendor kick-off sessions. Failure to disclose conflicts of interest may result in removal from the evaluation team, disciplinary action by the state, or for non-state evaluators, prevention from working for Michigan in any capacity and potential debarment of both the evaluator and their employer from receiving future state contracts. The form was signed by evaluator Lisa Crozier-Green on March 22, 2021.

Code of Conduct Acknowledgement Form You are receiving this form because you are an evaluation member participating in the evaluation, negotiation, and award process for RFP 21*1202 LED Polaris ATV / ORV.

An evaluation member must do the following:

1. Comply with Civil Service rule 2-8 (Ethical Standards of Conduct) and Public Act 196 of 1973 (State Ethics Act)

2. Comply with Chapter 1, Section 1.4 of the Michigan Procurement Policy Manual.

3. Disclose, to the Solicitation Manager, any actual or potential conflict of interest you have with a bidder, or any situation that may call into question your ability to participate impartially and without bias. Conflict of interest includes any personal, financial, business or other interest that impairs, may impair or give the appearance of impairing independent judgment or action in the performance of duties as an evaluation member. This disclosure requirement extends to any member of the evaluation member’s immediate family as defined in Civil Service rule 2-8. Disclosure of the specific relationship or conflict is not required if the evaluator voluntarily withdraws from participating.

4. Report any actual or perceived conflict of interest of others to the Solicitation Manager or Procurement Executive.

5. Failure to disclose any conflict of interest may result in the following: (a) removal from the evaluation team, (b) contact made with State employees department director, (c) contact made with Governor’s legal counsel or State Ethics Board; (d) disciplinary action, (e) non-state employee evaluators may be (1) prevented from working for the State of Michigan in any capacity, (2) the individual and the contractor the individual works for may be barred from receiving future contracts, and any existing contract with the evaluator or the evaluator’s employer, or contractor may be canceled.

6. Perform evaluation duties impartially and without bias.

7. Review and understand the solicitation documents and addendums.

8. Review and understand the proposals received.

9. Attend scheduled meetings and be prepared to actively participate in the evaluation process based on bidder submissions.

10. Ensure the details of the evaluation remain confidential until a notification of award has been made. This does not preclude the evaluator from discussing the overall status of the project with the evaluator’s management.

11. Attend any post award activities such as debrief and protest meetings, and vendor kick-off meetings.

My signature below (or an acknowledgement to the Solicitation Manager via email) indicates I have read and understand the above requirements and will abide by them.
