About this file
This is an E-Rate Rider document for the Cleveland Metropolitan School District (CMSD) in Ohio that establishes mandatory compliance requirements for all service providers responding to the Wide Area Network (WAN) Communication Services RFP. The rider incorporates Federal Communications Commission (FCC) and Universal Service Administrative Company (USAC) E-Rate Program rules into CMSD's procurement process. All service providers must maintain valid USAC eligibility status, comply with competitive bidding integrity requirements, and adhere to strict invoicing standards. Service providers are required to use the Service Provider Invoicing (SPI) method as the preferred billing approach, submit FCC Form 474 to USAC for all eligible charges, and ensure that CMSD is billed only for the non-discounted portion of eligible services. All invoices must clearly itemize eligible E-Rate services, ineligible services, taxes, fees, and distinguish between one-time and recurring charges. Service delivery must align with USAC guidelines and approved Funding Commitment Decision Letters (FCDLs).
Service providers are obligated to apply E-Rate discounts upfront and maintain itemized billing that matches USAC-approved funding requests. CMSD assumes no responsibility for service provider failures to submit timely SPI invoices to USAC and explicitly will not pay any discounted portions under any circumstances. All E-Rate-related records must be retained for a minimum of ten years following the last date of service delivery. Service providers must cooperate fully with USAC audits, FCC inquiries, and CMSD internal and external audits, providing documentation upon request. Contract awards are contingent upon E-Rate funding approval, and CMSD reserves the right to reduce or cancel services based on USAC funding decisions, budgetary constraints, or program rule changes. Non-compliance with the rider's requirements may result in contract termination.
