About this file

This is a Single Source Justification (SAP) document for a sole-source purchase order by the Transportation Security Administration (TSA). The Transportation Security Administration Training Center (TSATC) in Egg Harbor Township, NJ requires urgent repair and replacement of inoperable Vac-U-Max 1040 collection systems for firing range target and projectile recovery systems in three buildings (291F, 291G, and 291H). Choice Environmental Services, LLC is the sole authorized and qualified provider, certified by the original equipment manufacturer (Vac-U-Max) to perform these specialized repairs.

The procurement is valued at $42,000 with a 90-day performance period, utilizing FAR Part 13 Simplified Acquisition Procedures. The justification emphasizes that Choice Environmental Services is the only vendor with proprietary tools, OEM parts access, and factory training necessary to complete the repairs while maintaining system integrity, performance, and safety standards. The document details the critical nature of the repairs, including replacement of gauges, sensors, valves, filters, belts, and lubricants, as well as mechanical cleaning of horizontal ductwork and removal of firearm byproducts. The contracting officer determined this sole-source approach represents the best value to prevent potential system failures, extended repair times, and higher costs associated with using alternative vendors.

Appendix B SAP Single Source Justification

FAR 13.501

SECTION I: Introduction

The Aviation and Transportation Security Act was signed into law on November 19, 2001. TSA employs more than 45,000 security screeners and provides guidance and training to flight crews for dealing with threats on-board aircraft. Since February 17, 2002 TSA has been responsible for all civil aviation security functions. Because these tasks are directly related to the security of the national air transportation system, TSA has a critical need to be located on or very near airport property. TSA’s Real Estate Management Division and Office of Acquisition propose to enter into a contract on the basis of other than full and open competition.

The Aviation Transportation Security Act (ATSA – P.L. 107-71 Sect. 600.1; 49 U.S. Code § 114) provides TSA with the authority to enter into contracts, including leases.

The Transportation Security Administration (TSA), Transportation Security Administration Training Center (TSATC) and Direct Leasing Branch propose to solicit and issue a purchase order based on soliciting only one source. (FAR 13.106-1 (b)(2))

The Direct Leasing Branch J&A tracking number is JA-RELD-25-0008.

This acquisition is conducted under FAR Part 13, Simplified Acquisition Procedures.

SECTION IV: Identification of the Single Source Justification

FAR 6.302-1(c)(1)

Only one source is capable of responding due to the unique or specialized nature of the work.

Brand Name Only.

An urgent and compelling need exists and soliciting more than one vendor would result in unacceptable delays.

A licensing agreement is required as a part of this purchase order, which is available from only one source.

SECTION V: Description of Rationale

The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) implemented by the FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.

In accordance with Federal Acquisition Regulation (FAR) Subpart 6.302-1, the procurement for repair and maintenance services of the Vac-U-Max 1040 collection system, including the associated components and systems at Building 291F, 291G, and 291H, is being conducted on a sole-source basis with Choice Environmental Services, LLC. This determination is made because Choice Environmental Services, LLC is the sole authorized and qualified provider capable of performing the required services in compliance with manufacturer specifications and maintaining system integrity, performance, and warranty compliance. The rationale for the sole-source determination is outlined below:

Exclusive Authorization by Original Equipment Manufacturer (OEM):

Choice Environmental Services, LLC is the only entity authorized by the OEM, Vac-U-Max, to provide repair and maintenance services for the Vac-U-Max 1040 collection system. The OEM has certified Choice Environmental Services, LLC as the exclusive service provider with the necessary technical expertise, access to proprietary tools, OEM parts, and factory training required to perform repairs and ensure compliance with the manufacturer’s specifications. This certification ensures that the integrity and warranty of the equipment are upheld.

Proprietary Tools and Access to OEM Parts:

The repairs and maintenance tasks outlined for the Vac-U-Max 1040 collection system require the use of proprietary tools and OEM-specific parts. Choice Environmental Services, LLC is the only vendor with authorized access to these proprietary resources, ensuring that the repairs meet the manufacturer's exact specifications. Other vendors do not have the legal authority or capability to obtain the necessary components or tools required for such repairs.

Specialized Technical Expertise and Factory Training:

The repair tasks include the replacement of critical components such as gauges, sensors, valves, filters, belts, lubricants, and the cleaning and maintenance of horizontal ductwork. These procedures require specialized technical knowledge and factory training that is only available through Choice Environmental Services, LLC. The company's expertise ensures that all systems are repaired and tested in accordance with OEM standards, thereby guaranteeing system performance and safety.

System Integrity, Performance, and Safety Compliance:

The Vac-U-Max 1040 collection system is a critical piece of infrastructure designed for use in firing range target systems and projectile recovery. Any repair work performed must adhere to strict operational safety standards and system integrity requirements to ensure performance efficiency. Choice Environmental Services, LLC is uniquely positioned to provide these services because it is the only provider capable of maintaining the high standards set by the OEM. Other vendors are unable to meet these stringent safety and performance standards, which could compromise the integrity of the system.

Urgency and Critical Repairs:

The Firing Range Target Systems and Projectile Recovery Systems at Buildings 291F, 291G, and 291H are currently non-operational and require urgent repairs. The breakdown of critical components, including gauges, sensors, and ductwork, is hindering system functionality and safety. Given the nature of the required repairs, it is imperative that they be completed quickly and accurately to restore full operational capacity. Choice Environmental Services, LLC is the only qualified provider capable of completing these repairs without delay.

Post-Repair Support and Follow-on Maintenance:

In addition to completing the repairs, Choice Environmental Services, LLC is the only provider authorized to offer post-repair support and ongoing maintenance services for the Vac-U-Max 1040 collection system. This ensures continuity in service and allows for future maintenance to be handled by the same qualified team, preserving system reliability and performance over time.

Given these factors, Choice Environmental Services, LLC is the sole source provider capable of fulfilling the requirements of this procurement. The continued functionality and safety of the Vac-U-Max 1040 collection system depend on working with the authorized service provider to ensure proper repairs and compliance with the OEM’s standards.

SECTION VI: Contracting Officer’s Determination that the Order Represents the Best Value

The use of an alternate vendor and their custom engineered repair to Vac-U-Max’s equipment would be significantly costlier to the Government and could have a detrimental effect resulting in failure of range systems, poor performance of the system equipment using non-compatible/non-standard components, and a longer repair time of the custom parts in the future. These combined could result in range downtime, longer repair times, serious injuries to staff, extended delays to the FAMS training schedule, and higher repair costs. In addition, no OEM warranties are currently in effect. For these reasons, the Government requires a turn-key repair of the firing range target systems and projectile recovery systems through Choice Environmental Services. 41 U.S.C. 253(c)(1) FAR 6.302-1(A)(ii)(A) or (B) states that circumstances permitting other than full and open competition include situations that would cause “substantial duplication of cost to the Government that is not expected to be recovered through competition or unacceptable delays in fulfilling the agency’s requirements.”

SECTION VII: Market Research Description

The market research conducted for this requirement involved two primary approaches: outreach to the manufacturer and online sourcing efforts. The manufacturer was contacted directly, and based on their response, only one authorized source for the required product was identified. This source is the sole distributor of the product, which meets the specific technical and operational requirements set forth by the agency. Further efforts to identify alternative suppliers via comprehensive online searches yielded no additional sources capable of providing the required product or service.

In summary, the market research confirms that the identified source is the only known supplier that can meet the agency’s needs. Despite diligent attempts to identify other potential sources, no viable alternatives were found through both direct manufacturer communication and independent online searches.

This exhaustive market research process demonstrates that no competitive sources are available for the specific product or service required.

SECTION VIII: Document Preparation Prepared by Technical Monitor name in Section IX SECTION IX : Technical or Requirements Personnel Certification

I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
