FAR 52.212-2 -- Evaluation -- Commercial Items (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and non-price factors considered. In addition to price, the following factors, which are listed in descending order of importance, will be used to evaluate proposals. All non-price evaluation factors, when combined, are significantly more important than the price evaluation factor.
1.0 NON-PRICE EVALUATION.

Questions and Answers for RFQ CFP-13-R-00004, Data Audit, Analysis and Strategic Plan for the Office of Minority and Women Inclusion (OMWI)
Paragraph SF 1449
Block 10 Q This acquisition is Unrestricted. However, since several 8(a) and HUBZone firms are fully capable of performing these services and the award threshold is less than the sole source dollar a limitation of $4million, would CFPB award to a capable 8(a) or HUBZone and preserve the human capital resources of
CFPB?
A This opportunity was previously set aside on GSA for small businesses under GSA Schedules 874, 70 and 738X. However, none of the proposals submitted for this requirement were found to be acceptable to perform the work required by OMWI.
Block 12 Q Please explain or define “Discount Terms” A Discount terms refer to discounts offered by the Contractor for payment by the government before 30 days after receipt of a proper invoice (ie. 2/10, net 30; if the vendor is paid within 10 days, the Contractor will give the Government a 2% discount).
Block 17a Q Where do I acquire the "Contractor/Offeror Code" and the "Facility Code" A The contractor is only required to complete blocks 30A, 30B and 30C on the
SF-1449.
Paragraph SECTION I
Section I 2.0
Q The Government provides two sample Labor Categories – Management Analyst 2 and Management Functional Specialist 1. Would the Government consider providing relevant years of experience or expertise desired (beyond the 5 year minimum of diversity consulting experience) in order to apply the most appropriate LCATs?
A The CFPB is only requiring that the Key Personnel have a minimum of 5 years of diversity consulting experience. Government seeks to contract with a consulting firm which has diversity consulting experience in the last five years with at least three engagements. Diversity consulting experience includes providing diversity consulting services including, but not limited to, developing strategic plans, conducting focus groups, developing diversity training plans, and devising methods of analysis of the diversity in the workforce.
Section I 2.0
Q 1. Can the government provide detailed descriptions and educational requirements for the anticipated labor categories?
2. If not, would the government consider revising the language that states
“Offerors should propose equivalent labor categories” to “Offerors should propose appropriate equivalent labor categories” ?
A 1. Typically diversity consultants come from a variety of educational backgrounds and develop experience in diversity consulting through work experience.
2. The Government is amenable to revising the language to “Offerors should propose appropriate equivalent labor categories.” See attached Revised RFP.
Section I 2.0
Q Would the government consider a firm fixed fee where the offeror would propose a dollar value only for the work to be performed on the contract? This would allow the elimination of the Firm Fixed Price Table requirement and payments for services rendered would be based on a deliverable scheduled instead of labor hour.
A Yes. The Government is requesting a Firm Fixed Price Proposal. As Indicated in Section One, Subsection 2.0, the labor categories and estimated hours indicated (TOTAL HOURS – 613) are the number of hours the CFPB anticipates will be required to complete the work. Your firm may propose hours (less or more) and Other Direct Costs (ODCs) if applicable that it believes will be required to accomplish all tasks for this requirement.
Section I 2.0
Q The Firm Fixed Price table lists labor categories only. Will Travel & Living Expenses and Other Direct Costs be separate line items and billed as incurred, or are these two categories to be rolled into one firm fixed price proposal?
A Travel and living expenses should be priced into their firm fixed price labor rates. ODCs in this instance means copying and other incidentals that the Contractor believes will be required to accomplish this task. The CFPB does not anticipate much, if any, ODCs.
Section I 2.0
Q Is CFPB amenable to a time and materials award rather than a firm fixed price, nothing the hours appear materially less than similar scopes of work for other projects of similar nature and complexity?
A No, the government will award a Firm Fixed Price Contract for this requirement.
Section I 2.0
Q Should travel expenses be included in the Other Direct Costs (ODCs) as a part of the Firm Fixed Price bid, or will approved travel expenses be billed separately and paid on a pass-through or at cost basis? If separately, will travel need to be pre-approved by the Contracting Officer?
A Travel and living expenses should be priced into their firm fixed price labor rates.
Section I Q Paragraph 2.0: Schedule of Supplies, Services and Prices: the section does not
2.0 identify whether there is an incumbent providing these services. Is there an incumbent vendor providing the services currently? If so, can the CFPB identify the incumbent vendor?
A This is a new requirement for the CFPB and there is no incumbent providing the services.
Section I 2.0, 2.1
Q What factors, formula or baseline were used to arrive at the projected hours for the Scope of Work?
A The factors considered were a review of the work performance required, the level of experience needed, and the anticipated time for completing the tasks.
Paragraph SECTION II Section II 3.0
Q Do you have personnel located outside of Washington, DC? If so, will we be expected to travel, or will phone and/or email contact be acceptable?
A Yes, we have personnel located throughout the country but expect the focus for the diversity and inclusion proposal to be at headquarters. There will not be travel outside of DC and, to the extent it is necessary, phone calls and emails are acceptable.
Section II 3.0
Q Can you provide the breakout of the government estimate of hours across the three task areas?
A The Government expects that the hours will largely depend on the firm’s experience and proposed approach the performed the tasks. In general, the Government expects to have the firm spend a large portion of its time on factor 2, which includes the development of an approach to analyzing data and applications systems, and the performance of an internal data diversity audit.
Section II 3.0
Q Is the contractor leading this expected to be responsible for staffing to the complete LOE necessary to accomplish Tasks 1-3? Or is the expectation that the contractor would work as a part of an integrated delivery team with CFPB resources to deliver Task 1-3?
A Yes, the Contractor is expected to provide all necessary hours to complete the tasks. The Contractor will work with the Office of Minority and Women Inclusion (“OMWI”) team with CFPB resources to deliver Task 1-3. The OMWI will enlist support services from Human Capital as well as support the needs of the contractor.
Section II 3.0
Q What is the extent, format and media of all relevant existing CFPB workforce data system and data from program offices, Bureau of Public Debt and other data resources?
A We use two primary systems for workforce data: (1) data from the National Finance Center (payroll data); and (2) HR Connect (HRIS system). Additional data pertaining to performance ratings and workforce planning are contained within other systems. All data can be exported to EXCEL.
Section II 3.0
Q Task 3 is asking for support with reviewing, revising and finalizing the OMWI strategic plan. Does CFPB see any conflict of interest arising from this support that would conflict the vendor out of being considered for any implementation of the strategic plan?
A No. It is important that the firm have an opportunity to assist with the development of the strategic plan in order to optimize its effectiveness.
Section II 3.1
Q In the effort to perform data analysis, will the CFPB provide resources to extract data, or provide access to internal data systems, or what level of support do you anticipate giving to the contractor?
A The CFPB uses two primary systems for workforce data: (1) data from the National Finance Center (payroll data); and (2) HR Connect (HRIS system).
Additional data pertaining to performance ratings and workforce planning are contained within other systems. All data can be exported to EXCEL. The CFPB will provide support to extract the data from the two systems.
Section II 3.1
Q In Task I, the Government requests a “data analysis framework that is renewable every pay period.” Please clarify the intent of this request.
1. Is the Government seeking an automated tool or a manual refresh of data to be analyzed every pay period?
2. What does this entail; specifically expound on “renewable”?
3. What is the pay period; every two weeks, twice a month, or monthly?
A 1. The Government seeks either an automated tool or a manual refresh of data system that can be analyzed every pay period.
2. The Government seeks a framework to analyze workforce data as it changes with the changes in the workforce (i.e. hiring and promotion of personnel as well as personnel departures).
3. The pay period of every two weeks.
Section II 3.1
Q Please clarify the number of Program Offices whereby data will be collected, the technology used for CFPB’s workforce data system, and the scope and extent of other data resources from which we will need to extract information.
For example, will MD-715 workforce tables be within scope for analysis? Has CFPB performed a MD-715 Barrier Analysis?
A The data will be collected from Human Capital which contracts its data collection to the Bureau of Public Debt. In addition, the EEO office may have data related to the MD-715. The scope of work includes similar data that is provided in the MD-715 but is not limited to that date. CFPB has performed MD-715 Barrier Analysis for the first time for the Fiscal Year 2011.
Section II Q 1. Please clarify who owns the data – Human Capital, Chief Human Capital
3.1 Officer (CHCO) or the Office of Minority and Women Inclusion (OMWI)?
2. Does CFPB have historical data that will be used?
A 1. Both the Human Capital and the Office of Minority and Women Inclusion own and have access to the data.
2. The CFPB “opened its doors” two years ago and has data since its inception.
Section II 3.1
Q 1. What is the workforce data system or software that is being used?
2. How is the data being generated now?
3. Is the data system purely numerical or does it include comments or extrapolations from the workforce?
A 1. The CFPB uses two primary systems for workforce data: (1) data from the
National Finance Center (payroll data); and (2) HR Connect (HRIS system). Additional data pertaining to performance ratings and workforce planning are contained within other systems. All data can be exported to
EXCEL.
2. The data is generated on a bi-weekly basis which is exported to excel.
3. The data is purely numerical.
Section II 3.1
Q Can you please clarify the deliverable desired as a result of Task 1?
A The deliverable is the use of software (either created by the firm or recommended that CFPB purchase) that tracks various types of workforce data.
Section II 3.1
Q Is the anticipation that the vendor will build a solution (e.g., software application) for ongoing data analysis that CFPB will be able to run itself?
A Yes, the vendor may either build or recommend a current software system for CFPB to purchase.
Section II 3.1
Q How many “Divisions” are within CFPB?
A There are 6 Divisions at the CFPB: (1) Operations, (2) Consumer Education and Engagement, (3) Research, Markets & Regulations, (4) Supervision, Enforcement and Fair Lending, (5) General Counsel, and (6) External Affairs.
Section II 3.1, 3.2
Q Do the data analysis and data audit include only the workforce population (i.e.
current and prospective employees) or does it also include a need to capture, analyze, and audit supplier and contractor data and processes?
A The data analysis is only limited to the workforce population.
Section II 3.2
Q Please clarify whether or not the Government anticipates the contractor to conduct primary data collection (e.g. conduct a new survey and/or conduct new focus groups) or if this task will be restricted to analyzing secondary (i.e., existing) data only.
A The Government anticipates the contractor to conduct primary data collection but also anticipates that the Contractor may want or be required to review analyzing secondary data to complete the tasks.
Section II 3.2
Q If the Government anticipates the contractor conducting primary data collection, will the CFPB permit staff of various levels within the Bureau to participate in focus groups and interviews? Are there any restrictions?
Additionally, will the CFPB coordinate the availability of these individuals based on the agreed-upon project plan?
A Yes, the CFPB will permit and encourage staff at various levels within the Bureau to participate in focus groups and interviews. We expect this to be a voluntary process so the focus groups will be made up of staff who wish to participate. No,the CFPB will not coordinate the availability of these individuals based upon an agreed-upon project plan.
Section II 3.2
Q Task 1 calls out reporting for each Division within CFPB. Should the vendor assume that “Division” is the desired level of analysis for the diversity audit task? If not, how deep of a dive is anticipated (e.g., occupational series within Division)?
A As assessment of the diversity of the Division level should include reviewing and assessing data at various viewpoints (including pay level and title) where appropriate. It is not limited to the Division level.
Section II 3.2
Q Will a web-based survey be acceptable to CFPB?
A Yes. The CFPB currently utilizes web-based surveys.
Section II 3.2
Q How many senior leaders and other stakeholders do you anticipate will be involved in the assessment/audit process?
A The CFPB expects several senior leaders and other stakeholders to be involved the process but participation will be voluntary.
Section II 3.2
Q Does the Bureau have available current employee survey data related to diversity and inclusion?
A The Bureau has an annual employee survey which includes two questions related to diversity. It expects to edit its annual survey this spring to include 20 additional OPM devised diversity questions.
Section II 3.2
Q How many employees? What percentage of the employees will participate in the focus groups, interviews, and surveys? How will they be selected?
A The CFPB currently has 1,074 employees. The CFPB expects the contractor to survey a sufficient amount of employees to formulate an assessment of workforce diversity and inclusion and to inform the contractor for its revision of the strategic plan.
Section II 3.1-3.3
Q What is the target "start date" for the project, and when, specifically, are the deliverable dates for each respective piece of the project (Tasks I, II, and III respectively)?
A The CFPB expects the project to cover a six month timespan and expects the
Contractor to start work as soon as possible. The deliverable dates of each tasks will be determined after contract award.
Section II 4.0
Q The statement of requirement, Item 4.0, requires 5 years of diversity consulting experience for the consultant. What is actually meant by this statement? Do you require someone who has worked with diversity or somebody who has worked with diversity data at CFPB?
A The consultant must have diversity consulting experience in the last five years which involves at least three engagements but not specifically at the CFPB.
Since the CFPB is a new bureau and the requirement has no incumbent, no Contractor will have worked with diversity data at the CFPB. Diversity experience is defined as experience with developing strategic plans, conducting focus groups, developing diversity training plans, and devising methods of analysis of the diversity in the workforce.
Paragraph SECTION III Section III 9.0, 10.0
Q Given (a) the base ordering period of six months, (b) the requirement that at least 50 percent of the time or possibly longer be spent at CFPB headquarters, and (c) the estimated 613 total hours for two resources, does CFPB have an expectation for the number of weeks the contractors will be required to be on-site?
A No. The CFPB does not have an expectation for the number of weeks that the contractors will be required to be on-site. Deference will be given to the contractor to determine its needs to maximize is performance of the proposal.
Section III 10.0
Q What computer equipment and IT support services, if any, will be provided to the contractor by the CFPB for the 50% of work or greater which shall be performed at CFPB?
A The CFPB will ensure that the contract has access to its electronic files and will provide appropriate computer support (i.e Laptop) as needed.
Section III 10.0
Q Can the data be analyzed at locations other than the CFPB OMWI office?
A Yes, the data can be analyzed from other locations with the expectation that the data will be shared with the CFPB as the project is developed. However, the CFPB anticipates that the Contractor will most likely need to be onsite at least 50% of the time.
Section III 10.0
Q 1. Can you provide a job description of the person who will have to be on site at least 50% of the time or longer?
2. Does this person have to be key personnel?
A Yes, the person who will be required to be onsite will be the Key Personnel who possesses 5 years of diversity experience.
Section III 10.0
Q Does the Government plan on providing designated workspace for contractors to include computers and telephones? What is the expectation regarding the work being performed 50 percent of the time at CFPB’s headquarters? Does the agency anticipate the contractor being on site a percentage of time on a weekly basis over the six month time period? Or is this requirement at the discretion of the contractor as long as 50 percent or more of the total time is performed onsite.
A Yes, the CFPB plans to provide designated workspace for contractors to include computers and telephones. The expectation for working 50 percent at the CFPB headquarters provides an opportunity to work closely with the staff of the CFPB during contract performance.
Section III 13.0
Q As mentioned in the SECTION 13.0, a "CONTRACTOR PROJECT MANAGER” is required. Do we need to submit only the project manager's resume or do we need to submit other key personnel resumes?
A A resume for the Key Personnel is required. If the Key Personnel and the Contract Project Manager are not the same person, a resume of the Project Manager will be helpful and will not count against the Offeror’s page limit.
Section III 13.0
Q Will this work require the contractor to teach CFPB personnel how to conduct the analysis?
A No. The expectation is that the CFPB personal will utilize the work product of the firm as a guide for future work in diversity and inclusion.
Section III 13.0
Q • Is this a follow on or new requirement? If this is a follow on, please let us know the current incumbent, contract number and value?
• Is incumbent still eligible to bid as a prime?
• Is there a preferred candidate?
A This is a new requirement for the CFPB and there is no incumbent nor is there a preferred candidate.
Section III 18.0
Q What Contractor products does the Government intend to designate for 508 compliance?
A The CFPB supports compliance with Section 508 and will ensure that its Contractor products comply with Section 508. However, the present RFP solely contemplates diversity and inclusion as required under Section 342 of the Dodd Frank which was not written to include Section 508.
Paragraph SECTION IV Section IV 22.3
Q Does the 6 page limit for Diversity Consulting Experience include resumes for our key consultants?
A No. The resumes do not count toward the Offeror’s 6 page limit for diversity consulting experience. See Table 22.7.
Section IV 22.3
Q Can you please clarify what is meant by “data and applications systems”?
A A data application system refers to the development of an electronic mechanism for ready assessment of diversity and inclusion. For example, the utilization of Excel to provide a means to assess the diversity of the CFPB.
Section IV 22.4
Q You indicate that our response can be in Adobe PDF format, and as SF1449 and SF30 need to be scanned to be included, the PDF format is our preferred method of submission. Paragraph 22.4 asks for an Excel file. We would prefer to place this table into the PDF file to form one complete submission.
This also avoids the inconsistencies found in various versions of Excel. Is one complete PDF file acceptable as our submission?
A Yes. One complete PDF file is acceptable. See Change Pages to RFP.
Section IV 22.6
Q May we include an introductory cover letter? May we include resumes in an appendix?
A Please see table 22.7. An introductory cover letter is permissible and does not count toward the Offeror’s page limit. Resume’s do not count toward an Offeror’s page limit. See Revised Table 22.7 in the attached Change Pages.
Section IV 22.7
Q Do you prefer to have the diversity consulting experience narrative, technical approach narrative, and technical approach narrative in separate volumes or one-combined document?
A The CFPB does not have a preference and will defer to the contractor for its preferred approach.
Section IV 22.7
Q As the development of diversity and inclusion consulting and subsequent strategic planning is an initiative that is in the foreground of leading Human Resources departments, we have an inquiry regarding the possibility of an extension for the Request for Proposal response. While we have the appropriate diversity and data analysis resources available at our firm, we believe an extension would enable us to create the most competitive response to this engagement by leveraging individuals across our multiple practices and service lines to create the most experienced team. We acknowledge the proposal submission instructions, including the fact that late proposals will not be accepted or evaluated; however, as noted above, we present this inquiry respective to an extension for the Request for Proposal response.
A Due to our time constraints, we are unable to provide an extension for time.
Paragraph ATTACHMENTS
Paragraph MISC
Misc Q Why was this opportunity not set aside for either 8A or WBE status?
A This opportunity was previously set aside on GSA for small businesses under
GSA Schedules 874, 70 and 738X. However, none of the proposals submitted for this requirement were found to be acceptable to perform the work required by OMWI.
Misc Q This paragraph mentions the Online Representations and Certifications Application (ORCA) website that has been replaced and information migrated to the System for Award Management (SAM). 1) Are provisions regarding the completion of paragraphs (b) of this provision still a requirement (see page 22 Annual Representations and Certification number (b)(1)? 2) Will the government consider updating the solicitation to replace outdated ORCA related information to provide clarity regarding representation and certifications?
A FAR Clause 52.212-3 -- OFFEROR REPRESENTATIONS AND CERTIFICATIONS -- COMMERCIAL ITEMS (DEC 2012) is unfortunately out of date and has not been revised since the merging of ORCA with SAM.
The offeror may complete it’s online Reps and Certs through SAM which will be checked by the CFPB or may complete FAR Clause 52.212-3 and submit it with its proposal.
Misc Q What is your budget for this project?
A The CFPB cannot disclose it’s budget for this requirement.
