About this file

This document is an Acquisition Alert related to Executive Order 14173 "Ending Illegal Discrimination and Restoring Merit-Based Opportunity" issued in February 2025. The executive order revokes previous diversity, equity, and inclusion (DEI) initiatives, including EO 11246 on Equal Employment Opportunity, which previously mandated non-discrimination and affirmative action requirements for government contractors.

The alert requires all contractors to certify that they are in full compliance with federal anti-discrimination laws and do not operate any DEI programs that could violate these laws. Contractors must sign a certification stating their compliance, with the understanding that this certification is material to the government's payment decisions and subject to the False Claims Act. The document provides a certification form for contractors to complete, acknowledging their commitment to not engaging in programs that could be construed as illegal discrimination.
