About this file

This is a Fines and Penalties Chart document approved by the Board of Aldermen (BOA) for the City of New Haven, Connecticut, establishing compliance violation penalties for construction contracts under the FY 2024-2025 budget ordinance. The document outlines enforcement mechanisms and penalty amounts applicable to contractors and subcontractors working on city construction projects, governed under ordinance 17-201(15) and administered by the Commission on Equal Opportunities.

The penalties outlined in the chart address specific compliance violations including failure to conduct pre-award conferences ($3,000 or 2% of contract amount), late certified or living wage weekly payroll reports ($1,000 per week or 1% of contract amount per week), missing or incorrectly filled daily employee reports ($750 per violation), and violations related to minority, female, and resident participation goals ($2,000 or 1% of contract amount per week of violation). Penalties are assessed against responsible contractors and subcontractors across all tiers, with escalating fines for repeat violations. For example, failure to meet participation goals can result in charges applied separately to both the subcontractor and all hiring contractors up to and including the general contractor for each week of non-compliance throughout the project duration. These penalties apply to the On-Call Storm Drain Maintenance contract bid and all other city construction projects.
