Except where specifically indicated to the contrary, the formats and drawing standards used shall be those normally used by the Contractor and by its subcontractors.
1.1 Export Control Limitations
Some of the content for documents provided by the National Aeronautics and Space Administration (NASA) (Goddard Space Flight Center [GSFC]) and United States (U.S.)
industry will be subject to the United States International Traffic In Arms Regulations (ITAR), 22 CFR 120-130, by the United States Department of State and/or the Export Administration Regulations (EAR), 15 CFR 730-744, by the Unites States Department of Commerce. NASA may exchange technical information with the foreign partners and related entities (e.g.
contractors and subcontractors) utilizing licensing exemptions to the ITAR and/or EAR, supported by the authority and content of the standing Letter of Agreement (LOA) and/or the Memorandum of Understanding (MOU) between NASA/NOAA and that foreign partner, as appropriate. U.S. industry may exchange ITAR sensitive technical data under the authority and conditions of Technical Assistance Agreements (TAA), approved by the U.S. Department of State as appropriate.
NASA and U.S. industry will mark and thus notify foreign partners and related entities of the exchange of ITAR and/or EAR sensitive data with variations of the following language:
1.1.1 ITAR Technical Data:
The unclassified technical information included is controlled under the U.S. International Traffic in Arms Regulation (ITAR), 22 CFR 120-130, by the U.S. Department of State. Transfer of this information to a foreign person or entity requires an export license issued by the U.S.
Department of State or an ITAR exemption to the license requirement prior to the export of transfer.
These items are licensed by the United States for ultimate destination [foreign partners and related entities]. Diversion, retransfer, disclosure, or use contrary to applications specified in NASA/NOAA agreement without prior U.S. authorization are prohibited.
1.1.2 EAR Technical Data:
The unclassified technical information included is controlled under the U.S. Export Administration Regulations (EAR), 15 CFR 730-744, ECCN [XXXXX] by the U.S. Department of Commerce. Transfer of this information to a foreign person or entity requires an export
