About this file
This is a Mandatory Section 3 Solicitation Package from the Georgia Department of Community Affairs (DCA) designed for contracts involving $200,000 or more in Community Development Block Grant (CDBG) funds. The package establishes compliance requirements for all firms, sub-recipients, contractors, and sub-contractors working on HUD-funded activities. Section 3 of the Housing and Community Development Act of 1968 requires that employment and training opportunities arising from Section 3 projects be provided to low and very low-income workers within the metropolitan area (or nonmetropolitan county) where the project is located, with priority given to Section 3 workers residing in the service area or neighborhood and YouthBuild program participants.
The solicitation package requires contractors to submit three mandatory forms prior to contract execution: the Section 3 Self-Certification and Action Plan, the Previous Section 3 Compliance Certification, and the Assurance of Compliance Certification. Contractors may claim Section 3 preference under three options: 51 percent or more ownership by low or very low-income persons; over 75 percent of labor hours performed by Section 3 workers in the prior six months; or 51 percent or more ownership by public housing or Section 8-assisted housing residents. For employment and contracting, contractors must document recruiting efforts, maintain priority lists of qualified low-income applicants, and provide records of Section 3 worker hiring and hours. Contractors not requesting preference must commit to outreach through at least three methods, including community newspapers, workforce boards, housing authorities, and other approved channels. All records related to employment and compliance must be maintained for at least three years after contract close, and any grievances from eligible residents or businesses must be filed with HUD within 180 calendar days.
