1. In Section 3.10.10 and 4.2 of Attachment 4 to the RFP, a (draft) certification plan is required to be submitted. An offeror may have more than one certification plan (for multiple STCs) that would require a large majority of the 100 pages allowed in the technical volume. May these plans be excluded from the page count?
Answer: No, the certification plan has to provide an approach for FAA certification. An entire FAA certification plan package isn’t the requirement.
2. In Section 6.1.2 of Attachment 4 to the RFP, the government states that it will use FAR 15 price analyses techniques. However, as the government has issued this procurement as a commercial item acquisition under FAR Part 12 (and specifically incorporating FAR 52.212-1), and has provided no justification for a deviation, we respectfully submit that the government should only use customary commercial practices for pricing as is required under the Federal Streamlining Act of 1994 and FAR 12.301(a)(2) and 12.302(c). Accordingly, we request the government revise the pricing proposal requirements to conform to standard FAR Part 12 commercial pricing and remove the following FAR Part 15 based requirements, which are unnecessary and inconsistent with FAR Part 12 commercial item procurements. Specifically, we request the following changes to the RFP:
a. In Section 6.2 in Attachment 4 remove any requirement that estimating requirements based on current contracts per Defense Contract Audit Agency (DCAA) policy and guidance;
· In Section 6.6 in Attachment 4, remove the price breakdown requirements for the firm fixed price CLINs in that section ;
· In Section 6.7 in Attachment 4 regarding CLIN x010 (Over & Above), remove any requirement that offerors provide justification of their fully burdened labor rate, G&A rate (associated with Travel), and material handling rate to include all fringe benefits, indirect costs and fee used to develop the wrap rate; and
· In 6.8 in Attachment 4 regarding subcontractor and vendor pricing, remove the Section including any requirement to set forth a subcontractor’s indirect costs, G&A, and profits.
Answer: This is not a deviation. FAR 12.209 requires price reasonableness be determined by Subpart 15.4. Attachment 4 C-21 AUP FAR 52.212-1 Addendum dated 4 May 16 details the pricing structure that must be followed.
3. Amendment 0001, Attachment 4 - Instructions to Offerors, section 4.l (d) states: "Provide a copy of any vendor or subcontractor agreements in place to provide the required services or supplies. (Ref: SOO dated 11 Apr 16 and SRD dated 07 Apr 16)" There are multiple vendor agreements and subcontractor agreements, each with multiple pages. Are these page counted?
Answer: No, this not considered part of the 100 pages.
4. CLIN x008 Technical Data Development in Attachment 1, pricing for Option years is requested and a quantity of one is specified to calculate the TEP. What are the Technical Data Development requirements for the Option years?
Answer: The technical data development is the data that is required to be delivered under CLIN X009 for all option years. CLIN X008 allows the contractor to price the preparation of that data for each option year.
5. There seem to be discrepancies with regard to the quantities listed for CLIN 0003 (Base Year Prototype Installation) and CLIN 0016 (Base Year- Aircraft Modification/Production Kit Installation). It is our understanding that only the Prototype aircraft will modified in accordance with the approved STC Design Solution, projected to be completed during the Base Year, and that Aircraft Modification/Production Kit Installation would not start until the beginning of Option Year I, after full completion of the Prototype aircraft. CLIN 0003 & CLIN 0016 both indicate a quantity of "1." Does the government plan to induct the first production aircraft within the base year?
Answer: The Prototype aircraft is the first aircraft inducted and will be completed during base year.
6. There seem to be discrepancies with regard to the quantities listed in CLINS 0016, 1016, 2016, 3016 and CLIN 0003. A quantity of "1" is listed in the Base Year for CLINs 0003 and 0016 and quantities of "8" for Option Year 1, "8" for Option Year 2, and "2" for Option Year 3 for CLIN X016 for a total of 20 aircraft. Should the quantity in CLIN X016 for the Base Year be "0" instead of "1"?
Answer: The Prototype aircraft is the first aircraft inducted and will be completed during base year.
7. The RFP and the government's May 2, 2016 response to question 9, require a predicative radar system based on the existing airframe without any modification to the airframe. However, there are no predictive systems presently available without modifying the airframe. We accordingly request that the government delete or revise the requirement to allow for alternative solutions.
Answer: The offeror’s response should provide a solution that meets the RFP requirements or provide an explanation of why a requirement isn’t achievable.
8. SOO 5.6.9.4.2 "Prepare for, execute and follow-up on all facets of meetings, reviews, and working groups, as tasked."
a. During the FFP POP, what taskings from the government will the contractor be subject to?
b. During the FFP POP, what approvals from the customer must the contractor obtain to complete the proposed schedule (other than acceptance)?
Answer: The offeror will support meetings with the Government to meet the RFP requirements, to include FAA and military certification meetings needed to meet the SOO/SRD requirements. The government considers this a standard program management function.
