Answers to questions below.

1. A) “Contractor” would provide Supplements to the existing Flight Manual as an STC deliverable. Item 17 states "stand-alone, not supplements".

Please define.

B) What is the reason for Flight Manuals (Supplements) to be in SGML? They are approved under the STC and cannot be changed, except by the STC holder which we assume would be Supplier of the STC.

Please clarify.

Ans/ Clarification to Flight Manual requirement: Flight Manual source data will be provided in editable Word Document format with graphics imbedded in word document. Additionally, all graphics affected will be provided as a separate file provided in .png file format. Flight Manual source data will be provided as a Supplemental Flight Manual.

2. What is the intent regarding Government Use Rights to engineering and technical data? Is it the intent of the STC to be transferred to the operator? If not, please define this request.

Ans: The C-21 program uses a Contractor Logistics Support (CLS) contract using a commercial maintenance support contractor to accomplish maintenance, modification and repair of the aircraft so the Government requires authorization to release applicable technical data to the CLS contractor for sustainment of the aircraft (see reference below).

1. During the government purpose rights period, the Government may not use, or authorize other persons to use, technical data marked with government purpose rights legends for commercial purposes. The Government shall not release or disclose data in which it has government purpose rights to any person, or authorize others to do so, unless—

(i) Prior to release or disclosure, the intended recipient is subject to the use and non-disclosure agreement

(ii) The intended recipient is a Government contractor receiving access to the data for performance of a Government contract. Limitations on the Use or Disclosure of Government-Furnished Information Marked with Restrictive Legends.

2. When technical data marked with government purpose rights legends will be released or disclosed to a Government contractor performing a contract that does not have a non-disclosure agreement, the contract may be modified, prior to release or disclosure, to include verbiage for that contractor for use if a to completed non-disclosure agreement is supplied.

3. Contracting activities shall establish procedures to assure that technical data marked with government purpose rights legends are released or disclosed, including a release or disclosure through a Government solicitation, only to persons subject to the use and non-disclosure restrictions. Public announcements in the Commerce Business Daily or other publications must provide notice of the use and non-disclosure requirements. Class use and non-disclosure agreements (e.g., agreements covering all solicitations received by the XYZ company within a reasonable period) are authorized and may be obtained at any time prior to release or disclosure of the government purpose rights data. Documents transmitting government purpose rights data to persons under class agreements shall identify the technical data subject to government purpose rights and the class agreement under which such data are provided.

3. “Contractor” would like to respectfully request high resolution cockpit instrument panel and avionic bay pictures for our review. Existing avionics equipment lists would be very helpful as well if they may be available.
