About this file

This is a Brand Name Justification memorandum from the Naval Surface Warfare Center Panama City Division (NSWC PCD) for the acquisition of Nuvair electronic boards with sensors. The document justifies the sole-source procurement of these components for CO Monitor Assemblies used in portable breathing air compressors.

The procurement includes a base quantity of 40 Electronics Board with Cable and Sensor (50PPM) units (P/N TEMC1), plus 10 optional quantities of 10 units each, for a potential total of 140 units. The justification explains that only Nuvair brand parts can meet the government's needs because they were specifically designed to meet CFR requirements, fit within the required envelope, and have been tested in the existing design. The document notes that using alternate equipment could introduce harmful parameters to the compressors, and using sensors from other brands would require extensive testing and incur additional costs and time. The Contracting Officer has determined this represents the best value and lowest overall cost alternative to meet the government's needs.

This action will award a purchase order, on a brand name specific basis, to acquire Nuvair electronic boards with sensors. These items are being acquired for the manufacture and overhaul of CO Monitor Assemblies.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This following items are being acquired:

ITEM P/N QTY

Electronics Board with Cable and Sensor (50PPM) BASE TEMC1 40 Electronics Board with Cable and Sensor (50PPM) OPTION 1 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 2 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 3 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 4 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 5 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 6 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 7 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 8 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 9 TEMC1 10 Electronics Board with Cable and Sensor (50PPM) OPTION 10 TEMC1 10

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

Only Nuvair brand parts can meet Government needs for the following reasons. The Carbon Monoxide (CO) Monitor was developed and designed to meet CFR requirements for portable breathing air compressors. The sensor from Nuvair was found after extensive market research for a sensor that would alarm at the required reading and fit within the envelope needed for our design. Use of alternate equipment may introduce new or change existing parameters that may be harmful to the compressors. Therefore, Nuvair is the only brand that will meet the requirements for this effort. Nuvair electronics boards with sensor have been tested and fit within our design. A sensor from another brand would require extensive testing and incur added expense and time.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1.

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

As stated in paragraph 4 above, Nuvair is the only brand that can meet the Government’s requirements

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Nuvair is the only brand that can meet the Government’s requirements.
