About this file
This is a Brand Name Justification document from the Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division (NSWC PCD) for the procurement of SDV MK8 Mast Control Valves. The document justifies the sole-source acquisition of 5 Hoke brand Mast Control Valves (Part Number 7911F4Y3), which must be altered according to Drawing 7005580 REV F and tested per NSWC PCD SDV Test Procedure K-301 Rev D.
The justification establishes that Hoke is the Original Equipment Manufacturer (OEM) and the only approved manufacturer whose valves are compatible with the existing SDV system. The procurement will be conducted using simplified acquisition procedures, with a value below $250,000 but above micro-purchase threshold. Delivery is required within 16 weeks of order receipt. The purchase amount is less than $25,000 and will not be synopsized on sam.gov. The Contracting Officer has determined this represents the best value considering price, recurring costs, special features, and administrative costs.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of
$250,000.00. All items will be delivered no later than 16 weeks upon receipt of order.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-
1(c).
Only this Brand and no other supplies or services will satisfy agency requirements, FAR 6.302-
1(c). NSWC PCD currently has a need for SDV Mk 8 Mast Control Valves, as referenced in
Section 2 of this document. Hoke (brand) is the Original Equipment Manufacturer (OEM) and the only manufacturer of the part specified for alteration to create the items listed in Section 2.
The Hoke Brand valves are compatible with the existing SDV system, and there are currently no other approved manufacturers for them. Alternate items are not compatible with the existing system; therefore, it is advantageous to the Government to acquire the items listed in Section 2, (as altered by NAVSEA Drawing 7005580 REV F) with no substitutes.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The purchase amount is less than $25,000 and will not be synopsized on the Contract
Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Hoke to provide the products.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Hoke is the only brand that can meet this requirement.
