About this file
Brand Name Justification Summary
This is a Brand Name Justification document issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), located at 110 Vernon Avenue, Panama City, FL 32407-7001. The contracting activity seeks to acquire Sierra Instruments Series 100 Smart-Trak2 Mass Flow Controllers through a firm fixed price purchase order to the lowest priced offeror. The acquisition consists of six line items totaling ten units of mass flow controllers configured for specific hyperbaric chamber system applications, plus ten Certificates of Conformance with standard calibration certificates, for delivery to the Navy Experimental Diving Unit at 321 Bullfinch Road, Panama City, FL 32407. The mass flow controllers include four units with LOW flow bodies (part number C100L-DD-2-OV1-SV1-PV2-V1-S4) ranging from 0-8 to 0-50 slpm capacities, and two units with MEDIUM flow bodies (part number C100M-DD-3-OV1-SV1-PV2-V1-S4) rated from 0-100 to 0-145.4 slpm, all configured for nitrogen, helium, and/or carbon dioxide with 316SS construction, Viton elastomers, 24 VDC power, and 0-5 VDC/4-20mA linear output signals.
The justification for restricting consideration to Sierra Instruments brand equipment is based on the requirement for hardware configured specifically for integration with existing hyperbaric chamber systems used for diver life support equipment evaluation and certification. The contracting officer determined this acquisition represents best value and the lowest overall cost alternative. No market research was conducted among schedule holders because Sierra Instruments is identified as the only brand capable of meeting the government's needs without introducing unacceptable delays or new parameters that could adversely affect diving system testing. The acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold, and the requirement will be synopsized on sam.gov.

The Government's minimum needs have been verified by the certifying technical and requirements personnel. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.
Authority: FAR 6.103-1(d), Application for brand-name descriptions.
The Sierra Instruments hardware being procured is comprised of commercial hardware, with specifications configured specifically for use with current hardware and software systems. The hardware specified provides the means to integrate with already in place systems for hyperbaric chamber systems. The hardware will be used to provide simulated gas addition and removal for evaluation of diver’s life support equipment in support of certification. Additionally, these instruments must provide calibration standards and Certificates of Conformance. Only those articles which have been successfully calibrated are qualified. In summary, using alternate equipment would prove costly in time and dollars to the government and to the mission. Use of another system may change or introduce new parameters that may be harmful to all diving systems tested and maintained . Therefore, it is imperative that this particular brand of equipment is purchased.
As such, the Government does not expect significant savings through alternate brands and does expect significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Governments’ best interest to acquire the Sierra Instruments brand.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.203.
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Sierra Instruments is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Sierra Instruments is the only brand that can meet the Government’s needs.
