STATEMENT OF WORK

1. BACKGROUND/PROJECT CONDITIONS
1.1. Background: Background: The SRF Building is located at 16349 Shasta Dam Boulevard, Shasta Lake, CA 96019. It is a 1,550-square-foot concrete building that’s almost entirely empty but has a working bathroom. Asbestos abatement was completed internally approximately five years ago, but some areas were missed due to equipment and walls that were in the way. Appendix A - Worksite Photos shows the general areas of work, except for the bathroom.
1.1.1. Internal Work:
Main Office:
• The floor material left behind from the removal of a preexisting wall has been tested positive for asbestos. Although the material on the existing wall has not been tested, assume it also contains asbestos and/or lead paint. Remove approximately 18 square feet of this floor and wall material.
• Encapsulate any holes in the underlying surface after removal.
Waiting Area:
• Remove approximately 4 square feet of the paint-like material covering a wall mounted network switch.
• Assume this material contains lead and/or asbestos.
Bathroom:
• Remove all baseboards and underlying mastic (approx. 60 linear feet).
• Remove the window and all sealing/installation materials.
• Remove ¼″ of the window frame all the way around the perimeter to ensure complete asbestos removal.
• Install the new window and apply caulking.
• Assume any dust and debris found in the rafters and other areas of the building’s interior has tested positive for asbestos. Clean all interior space so it is free of dust and debris.
1.1.2. External Work:
• Apply elastomeric caulking (compatible with elastomeric sealant for downspouts) to the exterior of all eight previously installed windows to prevent water intrusion.
• Prep approximately 1,530 square feet of exterior wall that tested positive for asbestos by scraping all loose or flaking material, including chipped surfaces.
• Do not remove pipes, conduits, or fixtures from the exterior wall except for downspouts.
• Remove and preserve downspouts on the north and south walls.
• Scrape areas behind downspouts to remove loose material.
• The Government will reinstall the downspouts.
1.2. Access: Project site is currently unoccupied by Government personnel.
1.3. Testing: Assume all exterior building materials subject to this work contain asbestos, as they have not been tested for contaminants.
2. SCOPE OF WORK
2.1. Contractor shall
2.1.1. Prevent contamination from dust and debris generated by asbestos-removal activities by providing containment:
• immediately around the work area
• for all fire alarm devices
• for all equipment that cannot be removed from the work area, such as the network switch o The network switch can be placed on a cart so that all connections remain in place and the switch is powered. Cover the network switch to protect it from dust and debris.
o The network switch will be reinstalled by the Government at a later date.
2.1.2. Employ asbestos material removal techniques that avoid unduly damaging the underlying building material.
2.1.3. Remove all asbestos containing materials within a full containment under negative air pressure of at least negative 0.020 inches of water. All removed materials and debris generated during removal shall be properly packaged and labeled.
2.1.4. Properly dispose of all removed materials in the Government-provided Hazardous
Waste Containers.
• The Government shall be responsible for disposal of the waste placed in the
Hazardous Waste Containers.
2.1.5. After material removal, clean all surfaces inside the building to remove all particulate matter.
2.1.6. Provide an air-monitoring specialist (AMS) certified by EPA and California
Department of Safety and Health (DOSH) to conduct a final visual inspection and clearance air monitoring at the conclusion of abatement activities. The Contractor shall contact the AMS a minimum of 24 hours prior to applying encapsulant for a visual inspection. Clearance air monitoring will be completed within 48 hours after the visual inspection and application of encapsulant. In the event that the AMS arrives on-site at the request of the Contractor and the area is identified to require additional cleaning or that the encapsulant requires additional drying time, the cost of the additional time required for the AMS will be the contractor’s responsibility.
A minimum of 1 sample per room and 2 blanks will be collected from each work area and will be analyzed by phase-contrast microscopy (PCM). A copy of the Air
Clearance shall be provided to the COR.
• The project is considered complete if all samples collected are less than 0.01 f/cc using the NIOSH 7400 method.
3. ADMINISTRATIVE INFORMATION
This section covers the basics of day-to-day operations and normal hours of work.
3.1. Place of Performance. The work to be performed under this contract shall be performed at the SRF Building (16349 Shasta Dam Boulevard, Shasta Lake, CA 96019).
3.2. Period of Performance. The performance period shall be 30 calendar days after Notice to
Proceed. Period of Performance includes submittals, mobilization, abatement, disposal, and de-mobilization.
3.3. Hours of Operations. The Contractor is responsible for conducting business, between the hours of 7:00 am-5:00 pm Pacific Standard Time, Monday thru Friday. The Contractor shall, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this Statement of Work when the Government facility is not closed during the daily schedule above. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
3.4. Definitions. The follow acronyms, terms, and wording will be used throughout this
Statement of Work (SOW).

3.5. Post Award Meeting. A brief post award meeting will be held prior to commencement of work via Teams. The Contractor shall meet with the designated Bureau of Reclamation
Field Engineer and or Onsite Government Representative. The post award meeting shall provide the Contractor an opportunity to discuss and outline both the safety and work plans, ask any questions relative to the project, and to review the proposed time schedule.
3.6. Security. The Contractor shall be responsible for safeguarding all Government equipment, information, and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured.
3.6.1. All vehicles entering the worksite may be subject to search by government security forces.
3.6.2. The Contractor shall maintain a current and updated list of authorized persons, including subcontractors, and provide a copy to the COR.
3.6.3. A list of ALL employees and copies of their driver’s license shall be provided to the COR before they are permitted on site.
4. CONTRACTOR REQUIREMENTS
The contractor and contractor personnel shall possess licenses, certificates, and training appropriate for removal of asbestos material.
4.1 Asbestos Abatement Activities. All asbestos abatement activities shall be carried out by a contractor with a current California C-22 Asbestos Abatement licensing classification.
Asbestos removal or repair work shall be performed by trained workers, knowledgeable in the hazards of asbestos, and properly trained in the use of personal protective equipment and engineering controls prior to the start of this project. The Contractor shall assume full responsibility and liability for any identified Asbestos Containing materials
(ACMs) that may be impacted during renovation activities that shall be removed or impacted and complying with all applicable federal, state, and local regulations pertaining to work practices, and protection of workers, visitors to the site, and persons occupying areas adjacent to abatement activities. The Contractor is responsible for providing medical examinations and maintaining medical records of personnel as required by the applicable Occupational Safety and Health Administration (OSHA) regulations. The Contractor shall hold the Bureau of Reclamation harmless for failure to comply with any applicable work, safety, health, or other regulations on the part of the
Contractor, the Contractor’s employees, or subcontractors. Where conflict between the regulations and this SOW exist, the most stringent requirements shall be followed.
Contractor shall be responsible to ensure all asbestos workers are compliant with state regulatory laws and federal laws regarding respiratory protection and asbestos abatement work.
4.2 Air Monitoring: Conduct daily monitoring that is representative of each employee working in the regulated area, unless all employees use supplied-air respirators operated in positive-pressure mode or a negative exposure assessment is performed.
4.3 Agencies: Impact to asbestos-containing materials is administered by state and federal regulatory agencies: (1) the California Department of Ecology, under the EPA’s National
Emission Standards for Hazardous Air Pollutants (NESHAP); (2) the California Division of Occupational Safety and Health (DOSH) for construction work and California
Department of Industrial Relations for exposure and worker relations and (3) the
Occupational Safety and Health Agency (OSHA); Contractor shall abide to these state and federal regulatory agencies.
4.4 Removal: The removal of asbestos-containing tile and mastics are regulated by DOSH as
Class II activities. Class II activities require that removal and disposal be conducted in accordance with 8 CCR §1529 and 8 CCR §5208. Workers must have a minimum of eight hours training regarding the hazards and proper removal methods specific to the material being abated, as specified in 8 CCR §1529 and 8 CCR §5208; or must be
California State Certified Asbestos Workers.
4.5 Certificates: A California State Certified Asbestos Supervisor must be present during abatement activities. Maintain a copy of this SOW on-site at all times during construction activities.
4.6 Other Materials: If additional suspect ACMs are encountered during renovation, demolition and/or construction activities, the material shall be treated as asbestos-containing until PLM analysis is conducted to characterize the material.
4.7 Hazardous Waste Training. Contractor personnel on the work site must possess current training certificates for HAZWOPER Supervisor training (40 hour) under 29 CFR
1910.120 (e) (4), and Worker training (24-hour; under 29 CFR 1910.120(e)(3)), as appropriate. All training documentation shall be provided to Contracting Officer
Representative (COR).
4.8 Deliverables. Deliverables to Reclamation will consist of electronic copies of the items specified below. Email address(es) will be provided upon Notice to Proceed.

5. COMPLETION REQUIREMENTS
The Contractor’s schedule and plan of work may differ from the order of items described below except where specified.
5.1. Site Cleanup. Remove all construction waste/debris for recycle/disposal at appropriate facilities.
5.2. Final Acceptance Inspection of All Items
5.2.1. Review completion of work with OGR.
5.2.2. Make any corrective actions determined as required during Final Acceptance
Inspection.
5.2.3. Final Inspection may uncover items not discovered during previous inspections.
Contractor shall correct all pertinent items upon discovery.
6. GENERAL REQUIREMENTS
6.1. Cleanup and Disposal of Waste Material. The Contractor shall be responsible for all proper waste materials cleanup and disposal of rubbish generated by their work.
Hazardous Waste Containers will be provided by NCAO and will be checked weekly and removed weekly or as needed. All Hazardous Waste (ACM materials) will be collected in
NCAO-provided Hazardous Waste containers and sealed. NCAO will be responsible for the disposal of the Hazardous Waste generated. This does not include general construction waste for which the contractor is responsible.
6.2. Waste Characterization, Handling and Disposal Plan. Provide this plan in accordance with paragraph 6.5.3.
6.3. Safety and Health.
6.3.1. Do not allow Contractor employees (including subcontractors), Government personnel, or the Public to be exposed to, or work under, conditions which are unsanitary, physically hazardous, or a potential exposure danger to their health or safety during performance of the contract.
6.3.2. Since this project will involve removal of asbestos material, ensure Contractor employees (including their subcontractors) and government personnel on site in the vicinity are protected from exposure to these compounds during the removal and disposal process.
6.3.3. The minimum work crew at any time on the construction site shall consist of no less than two people and shall be in accordance with other contractual obligations.
6.3.4. When violations of safety and health requirements contained in these specifications or referenced standards are called to the Contractor’s attention by the CO, COR, or the OGR, immediately correct the condition to which attention has been directed.
6.3.5. When the Contractor fails or refuses to promptly correct a compliance directive, the CO or the COR may issue an order to stop all or any part of the work.
• When satisfactory corrective action is taken, an order to resume work will be issued.
• The Contractor shall not be entitled to extension of time, nor to claim for damage or to additional compensation by reason of either the directive or the stop order.
• Failure of the CO, COR, or the OGR to order discontinuance of any or all of the Contractor’s operations shall not relieve the Contractor of the responsibility for the safety of personnel and property.
6.3.6. Maintain an accurate record of and report to the COR in the manner prescribed by the CO for all near misses, accidents or incidents, occupational diseases, traumatic injury, cases of death to Contractor employees (including subcontractors), Government personnel, or the Public, and any property damage occurring during the performance of work under this contract.
6.3.7. In the event there is a conflict between requirements contained in the Reclamation
Safety and Health Standards (RSHS), specification paragraphs, Contractor’s approved Safety Program, referenced safety and health codes, and standards, or the
U.S. Department of Labor Construction Safety and Health Standards, promulgated under Section 107 of the Contract Work Hours and Safety Standards Act (40
U.S.C. 327 et seq.), as amended, the more protective requirement having jurisdiction shall prevail.
6.4. First Aid and Communication:
6.4.1. Provide first-aid kits in accordance with Reclamation RSHS Section 5.
6.4.2. Make first aid and communication services available for providing emergency aid to employees and subcontractor employees.
6.5. Contractor's Onsite Safety Personnel:
6.5.1. Maintain records to comply with all applicable portions of CA Dept of Health, OSHA and EPA requirements, and other requirements of this specification.
6.5.2. Ensure Contractor (and/or subcontractor) personnel are currently licensed and registered with the State of California and have necessary training and personnel to perform Class II asbestos abatement work under the laws and regulations of
Title 8, Section 1529 of the California Code of Regulations (CCR) as a certified asbestos worker and as a Competent Person defined under 29 CFR 1926.1101.
• Contractor must demonstrate that they have (or will have) a sufficient number of skilled trades and licensed abatement workers who have successfully completed EPA model curriculum training in asbestos material abatement, so as to be able to complete all aspects of work covered.
• Contractor shall specify an on-site supervisor/competent person who is fully qualified in all aspects of asbestos abatement practices and procedures and meets all EPA/OSHA supervisor/competent person requirements.
6.5.3. Contractor shall ensure they have a respiratory protection program and current fit testing for all personnel and are providing medical examinations as per 29
CFR1926.1101, in addition the Contractor’s physician shall perform an evaluation of each workers ability to work in heat stress environments.
6.5.4. Contractor to perform air monitoring and sampling in accordance with California
Code of Regulations for ensuring compliance and providing copies of these reports upon request to the COR.
• Air sampling monitoring activities must be conducted by the Contractor or his duly authorized representative during asbestos abatement work or any other work involving asbestos-containing materials. The air monitoring frequency for Contractor operations shall at least be established in accordance with the requirements set forth in 29 CFR 1910.1001 and 29 CFR 1926.1101(f). The results of such sampling shall be posted and provided to the COR upon request within 24 hours after Contractor receipt of results. Contractor must ensure analytical result receipt no later than 5 calendar days after sample collection.
• The Contractor's air sample testing lab shall be an independent third party and certified for testing. Air sample analyses will be by methods described in the
CCR, and the results document must include interpretation of results.
• Air samples shall be taken every shift for the duration of the work shift at the
Contractor's expense. Additional samples must also be taken every time there is a change in the removal operation, either in terms of the location, the type of work, method of abatement, method of engineering control, change in the personnel completing abatement or other change in abatement process that might affect the exposure to asbestos of the workers. Sampling will be used to determine eight-hour exposure in accordance with the CCR. Copies of any air sampling will be provided to the COR.
• There is a need for an on-site safety representative, with at least 3-years of experience, 40-hour OSHA Construction Certification, first-aid, CPR, and
Blood Borne certifications. This person’s certifications need to be submitted with all certifications for approval.
6.6. Temporary Utilities: Applies to utilities available for use by the Contractor.
6.6.1. Electricity.
• Contractor shall coordinate with OGR for use of facility electrical power. If facility power is unavailable, Contractor shall provide required electrical power for construction.
• Remove temporary equipment and facilities upon completion of work.
6.6.2. Water.
• Government shall provide water required for abatement purposes. Contractor shall provide a backflow preventer at point of connection. Location to be coordinated with the OGR.
• Provide means of conveying water to points of use.
• Remove temporary equipment and facilities upon completion of work.
6.7. Vehicular Access and Parking.
6.7.1. Parking is available next to the jobsite building for Contractor use.
6.8. Protection of Existing Installations.
6.8.1. Provide protection for personnel and existing facilities from harm due to the
Contractor's operations. Protection shall be subject to approval of the Government.
6.8.2. Arrange protective installations to permit operation of existing equipment and facilities by the Government while work is in progress.
6.8.3. Do not discharge anything but clear water into onsite drainage system.
6.8.4. Repair, at Contractor's expense, damage to existing installations due to
Contractor's operations or Contractor's failure to provide proper protection. At the
Government's option, damage may be repaired by the Government, and the
Contractor will be charged for the repair costs.
6.9. Protection of Existing Utilities.
6.9.1. Dust Abatement.
• Contractor shall be responsible for damages resulting from dust originating from Contractor operations in accordance with clause at FAR 52.236-7
"Permits and Responsibilities."
6.9.2. Noise Control.
• Comply with all applicable Federal laws and regulations, and with applicable requirements of RSHS regarding the prevention, control, and abatement of harmful noise levels.
6.10. Hazardous Materials and Wastes. Remove and dispose of all hazardous materials and waste products encountered during construction.
6.10.1. Provide a Waste Characterization and Handling Disposal Plan. Include desired location of the Government-furnished hazardous waste container(s).
6.10.2. The Contractor will dispose of waste in Government-furnished hazardous waste containers and the Government will be responsible for the removal of the containers and appropriate disposal of the hazardous waste.
6.11 Emergency Services. In the event of an emergency, cellular service is limited.

7. SUBMITTALS
7.1. Schedule. The Contractor shall submit Required Submittal Notices (RSN) necessary to start work within 14 calendar days of the Notice to Proceed.
7.2. Review. The Government will review the Required Submittal Notices within 14 calendar days of official receipt.
7.2.1. Submittals will be returned as Approved, Conditionally Approved, or Not
Approved.
7.2.2. The Contractor shall resubmit Required Submittal Notices within 14 calendar days of receipt for Required Submittal Notices that are Conditionally Approved or Not
Approved.
7.2.3. The Government will review resubmitted Required Submittal Notices within 14 days of official receipt.
7.3. Address submittal.
7.3.1. Email to: Contracting Officer and COR. Email addresses will be provided with
Notice to Proceed.
7.4. Preparation:
7.4.1. Prepare in English.
7.4.2. Label with contract number, title, and RSN.
7.4.3. Measurement units: US Customary Units.
7.4.4. Sign and seal submittals requiring certification by a California registered professional.
7.4.5. Submittals must be reviewed by Contractor. Submittals without evidence of
Contractor's approval will be returned for resubmission.
7.4.6. Include the following information in transmittal letters:
• Contract number and title.
• RSN for each attached submittal.
• Responsible code.
• Identify submittal as initial or resubmittal.
7.4.7. More than one RSN may be submitted under a transmittal letter, provided the responsible code is the same.
7.4.8. Submittals not listed in this Statement of Work
• Submit in accordance with this section.
7.5. Submittal List and Requirements:
7.5.1. RSN-1, Safety Plan: Written Safety Program in accordance with Section 3 of the
RSHS.
• List of Employees:
Country of citizenship.
Duration and frequency on site.
Company affiliation and title/classification
• Cover all aspects of on-site and applicable off-site operations and activities associated with this contract.
• Program shall follow the format of the outline in Appendix 1.03C of RSHS
2025 (1.03 Contractor Requirements). Submittal will not be accepted for review by the COR/OGR unless it addresses, in order, lettered and numbered per
Appendix C, a narrative for each applicable item in the outline.
• For items in the outline that do not apply to this contract write “Not
Applicable to Contract” next to the number/letter.
• Provide a list of Job Hazard Analyses (JHA) – outlines of work safety regarding protective equipment to be used/ required for removal of hazardous material.
7.5.2. RSN-2, Licenses and Certifications. Provide a list of licenses and certifications held by all employees and subcontractors.
7.5.3. RSN-3, Schedule. Provide a schedule showing all aspects of the work, from mobilization through demobilization.
7.5.4. RSN-4, Abatement Plan. Provide a plan according to regulatory requirements that removes the contaminated material safely and efficiently.

7.5.5. RSN-5, Waste Characterization and Handling Disposal Plan. Provide a waste characterization, handling, and disposal plan for asbestos-containing hazardous material, plus any additional materials that must be disposed.
7.5.6. RSN-6, Final Report. Report shall include copies of all change requests, sample results, and notes pertaining directly to abatement actions.
8. INSPECTIONS
8.1. Approvals. The COR will make a minimum of four (4) mandatory inspections during the abatement work. Each inspection must be requested by the Contractor to be performed by the COR. The COR must approve the inspected work before work may begin for the next phase of work. Failure on the part of the Contractor to obtain the CORs approval before proceeding to the next phase is regarded as a violation of the contract. The four inspections are as follows:
8.1.1. Work area preparation completed - Contractor shall have all Pre-Abatement preparations of the work area completed and approved by the COR before proceeding to the next step.
8.1.2. Completion of asbestos abatement – Contractor shall have all abatement work completed, inspected, certified clean by test results, and approved before moving to the next step.
8.1.3. Completion of final cleaning inspection - Contractor shall have the final cleanup of all visible debris, waste, dust, and residue approved before moving to the next step.
The Contractor shall perform final cleaning techniques in accordance with CCR requirements before requesting final clearance sampling. Final clearance sampling will not occur until all surfaces are completely dry.
8.1.4. Final Clearance Sampling. COR/Reclamation Safety Office will perform final clearance wipe testing after final clean-up activities are completed. The Contractor shall notify the COR at least 24 hours in advance of the need for clearance wipe sampling.
8.1.5. A final punch list inspection is also required after all work is completed.
9. EXECUTION
9.1. Damages. All damages to the structure or property occurring as a result of any and all contract work and/or sub-Contractor work activities or actions shall be repaired or replaced at the Contractor’s sole expense, to the satisfaction of the COR/OGR Representative with no additional cost to the COR/OGR Representative. The Contractor will not be allowed any additional time allowances or extensions for any such circumstance or event.
9.2. General Removal. Procedures in accordance with 29 CFR 1926.1101
9.2.1. Flooring or its backing shall not be sanded.

9.2.2. Vacuums equipped with HEPA filter, disposable dust bag, and metal floor tool
(no brush) shall be used to clean floors.
9.2.3. Resilient sheeting shall be removed by cutting with wetting of the snip point and wetting during delamination. Rip-up of resilient sheet floor material is prohibited.
9.2.4. All scraping of residual adhesive and/or backing shall be performed using wet methods.
9.2.5. Dry sweeping is prohibited.
9.2.6. Mechanical chipping is prohibited.
9.2.7. Resilient flooring material including associated mastic and backing shall be assumed to be asbestos-containing unless an industrial hygienist determines that it is asbestos-free using recognized analytical techniques.
9.2.8. The material shall be thoroughly wetted with amended water prior to and during its removal.
9.2.9. The material shall be removed in an intact state unless the employer demonstrates that intact removal is not possible.
9.2.10. Cutting, abrading or breaking the material shall be prohibited unless the employer can demonstrate that method is less likely to result in asbestos fiber release are not feasible.
9.2.11. Asbestos-containing material removed shall be immediately bagged or wrapped, or kept wetted until transferred to a closed receptacle, no later than the end of the work shift.
9.2.12. Remove all construction waste and dispose of properly.

G.1 This contract shall be administered by the California Great Basin Regional Office, 2800

G.2 DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS SEP 2011
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
The COR will be named at time of award.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction
(written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the
Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the
COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting
Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

REPRESENTATIVE’S AUTHORITIES
AND LIMITATIONS – BUREAU OF
RECLAMATION
(a) Performance of the work under this contract shall be subject to the technical direction of the
Reclamation Contracting Officer's Representative (COR). The term “technical direction” is defined to include, without limitation:
(1) Inspecting and accepting or rejecting work performed under the contract.
(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR.
(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting
Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting
Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the
Contracting Officer is authorized to determine if a change is within the scope of the contract;
therefore, the COR does not have the authority to, and may not, issue any technical direction that
(1) Constitutes a direction of additional work outside the Contract requirements;
(2) Constitutes a change as defined in the contract clause entitled “Changes;”
(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;
(4) Changes any of the expressed terms, conditions or specifications of the contract; or
(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.
(d) All technical direction shall be issued in writing by the COR.
(e) The Contractor must proceed promptly with the performance of technical direction duly issued by the COR in the manner prescribed by this clause and within its authority under the provisions of this clause. If, in the opinion of the Contractor, any instruction or direction by the
COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the
Contractor must not proceed and must notify the Contracting Officer in writing within five (5) working days after receipt of any such instruction or direction and must request the Contracting
Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -
(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical
G-3 direction is within the scope of the contract effort and does not constitute a change under the
Changes clause of the contract; or
(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to the technical direction will be subject to the provisions of the clause entitled “Disputes.”
