About this file
This is a Byrd Anti-Lobbying Amendment Certification document applicable to the City of Fort Myers' Electrical Vehicle Charging Station (EVCS) project procurement. The certification requirement applies to all contractors bidding for federal awards of $100,000 or more and mandates that contractors certify they have not used federal appropriated funds to influence government officials in connection with obtaining federal contracts, grants, or cooperative agreements. The City of Fort Myers released the EVCS Request for Proposal on July 2, 2025, with a pre-submittal meeting scheduled for July 11, 2025, and proposals due by August 5, 2025. The procurement seeks a qualified contractor to provide a turnkey solution for designing, installing, operating, maintaining, and marketing electrical vehicle charging stations on publicly owned properties, with preference for multi-vehicle capable units. The contract includes an initial seven-year term with three one-year renewal options, and the City anticipates contract approval by City Council on September 2, 2025.
The evaluation will be points-based, allocating 50% to firm experience and qualifications, 40% to project approach, and 10% to pricing, with contractors required to demonstrate a minimum of five years of turnkey EVCS installation experience in the U.S. market. The procurement emphasizes participation from Disadvantaged Business Enterprises (DBE) and Minority Business Enterprises (MBE), with the Florida Department of Transportation maintaining a race-neutral DBE program with a 10.54% DBE goal. Contractors must comply with federal and state requirements including E-Verify employment eligibility verification, Build America Buy America (BABA) provisions mandating domestic iron, steel, and manufactured products, and certifications regarding debarment, human trafficking prevention, and foreign entity restrictions. Failure to file the required anti-lobbying certification subjects contractors to civil penalties ranging from $10,000 to $100,000 for each failure, with the certification constituting a material representation of fact upon which contract award depends.
