About this file

This is a form template used by the Indian Health Service (IHS), a division of the Department of Health & Human Services, to verify that offerors meet the eligibility requirements under the Buy Indian Act for Indian Economic Enterprise (IEE) status.

The form requires self-certification that an enterprise qualifies as an "Indian Economic Enterprise" with "Indian Ownership" under 25 U.S.C. 47 and EHSAR 326.601. Offerors must meet this definition at three critical junctures: when submitting an offer, at contract award, and throughout the entire contract performance period. Failure to maintain eligibility requires immediate written notification to the Contracting Officer. The form applies to solicitations including Sources Sought Notices, Requests for Information (RFI), and formal Solicitations. Offerors must check a box indicating whether they do or do not meet the IEE definition and provide signatures and documentation including the name of the Federally Recognized Tribal Entity, the 51% owner of the IEE firm, business name, and Unique Entity Identifier (UEI) number. The form warns that false or misleading information submitted in connection with a Buy Indian Act set-aside award violates 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain registration with the System of Award Management (SAM), and awards may be subject to protest if the offeror's eligibility is questioned.
