Brand Name Justification Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity.

Brand Name: Hydroflo Pumps, 16HH single stage pump, rated for 5000gpm and 60’ TDH, with 150 HP 2300V 3 phase motor and 16” discharge column
3. Description of Supplies/Services and Estimated Cost.
The scope of this supply is the purchase of 2 sump pump assemblies that are interchangeable, in whole or in part, with the currently installed sump pumps. Interchangeability of the pumps is essential to ease of maintenance of the entire sump pumps system and eliminates the need to maintain larger stock of wear parts while also removing the risk of incorrect part installation during maintenance. These two pumps will be installed by government personnel.

4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(ii), specific characteristics of the: Hydroflo Pumps, 16HH single stage pump, rated for 5000gpm and 60’ TDH, with 150 HP 2300V 3 phase motor and 16” discharge column This brand and model pump is required to maintain interchangeability and interoperability with existing pumps installed. This will also serve to minimize spare parts, storage and associated costs.
5. Determination of Fair and Reasonable Price.
This requirement will be solicited on SAM.GOV with a small business set aside with a brand name requirement. Previous market research has shown that there are numerous companies
