Brand Name Justification Notice Summary

This is a Brand Name Justification Notice for Solicitation 191BWC26R0018 issued by the United States Section of the International Boundary and Water Commission. The notice justifies the requirement for Hach brand wastewater instrumentation and turnkey installation services for the Nogales International Wastewater Treatment Plant. The Hach brand restriction applies specifically to sensors, controllers, accessories, mounting components, and related Hach warranty service, but does not restrict the prime contractor award to Hach Company nor designate the overall acquisition as sole source. The justification is made publicly available under FAR 11.105(a)(1) and FAR 13.501 authority, as the commercial acquisition is conducted under FAR Subpart 13.5 and exceeds the simplified acquisition threshold.

The basis for the brand name requirement stems from the Nogales facility's existing standardization on Hach SC series controllers, Hach communication protocols, and Hach calibration methods for online water quality monitoring. Informal market research determined that no compatible alternative products integrate directly with the existing Hach system without requiring rewiring, controller reprogramming, SCADA modification, or risking loss of validated data streams. The acquisition is unrestricted as to business size, and small businesses and other responsible firms may compete as authorized Hach resellers or integrators when they can furnish genuine Hach products with required warranty support and manage the complete turnkey installation requirement. Installation services are not restricted to Hach Company.

USIBWC 191BWC26R0018 | Brand Name Justification Notice

UNITED STATES SECTION

INTERNATIONAL BOUNDARY AND WATER COMMISSION

NOTICE OF BRAND NAME JUSTIFICATION

Hach Wastewater Instrumentation and Turnkey Installation

1. Purpose This notice makes publicly available the Government's justification for the brand name Hach product requirement in Solicitation 191BWC26R0018. The brand name restriction applies to the Hach sensors, controllers, accessories, mounting components, and related Hach warranty service required by the solicitation. It does not limit award to Hach Company as the prime contractor and does not make the overall acquisition a sole source procurement.

2. Authority FAR 11.105(a)(1) permits a particular brand name when it is essential to the Government's requirements and market research indicates that other companies' similar products do not meet, or cannot be modified to meet, the agency's needs. Because this commercial acquisition is conducted under FAR Subpart 13.5 and exceeds the simplified acquisition threshold, the brand name justification is documented under FAR 13.501. FAR 13.501(a)(1)(iv) and FAR 5.102(a)(6) require the brand name justification to be made publicly available with the solicitation.

3. Basis for the Brand Name Requirement The Nogales International Wastewater Treatment Plant uses Hach online water quality monitoring equipment and related software and is standardized on Hach SC series controllers, Hach communication protocols, and Hach calibration methods. The supporting technical determination states that Hach sensors integrate directly with the existing Hach controllers and system. Use of non Hach equipment would require rewiring, controller reprogramming, SCADA modification, or could result in loss of validated data streams. Hach products and associated Hach warranty support are therefore required for the product portion of this acquisition.

4. Market Research Informal market research found no compatible alternative products that integrate directly with the existing Hach digital system without the additional system changes described above. No separate sources sought notice was issued for this acquisition.

5. Competition The acquisition is unrestricted as to business size. Small businesses and other responsible firms may compete as authorized Hach resellers or integrators when they can furnish the genuine Hach products and required Hach warranty support and can perform or manage the complete turnkey requirement. The brand name justification covers the Hach product and related Hach warranty portion of the acquisition; installation is not restricted to Hach Company.

6. Public Posting This notice is posted with Solicitation 191BWC26R0018 as the public brand name justification for the Hach product requirement.
