About this file
This is a Brand Name Justification document for a maintenance and repair contract for the Bobcat forklift fleet at the Naval Surface Warfare Center Philadelphia Division (NSWCPD).
The contract establishes a comprehensive maintenance and repair program requiring periodic safety inspections, certified load tests, and preventative maintenance cycles at intervals not exceeding one year or per OEM operating-hour intervals, whichever occurs first. Monthly power-washing and detailing services are also mandated to prevent industrial grease and debris buildup. The acquisition is restricted to Bobcat Authorized Dealers and vendors to maintain the manufacturer's warranty on the Bobcat fleet. The justification cites three primary reasons for the brand name restriction: (1) manufacturer warranty requirements that mandate all warranty work be performed by authorized Bobcat dealers with proper service record documentation and genuine Bobcat parts; (2) Bobcat equipment's use of specialized, proprietary diagnostic software, firmware, and tooling that only authorized dealers have legal access to; and (3) the requirement for factory-certified technicians trained on specific models to ensure correct torque specifications, system calibrations, and safety standards. A market survey of potential authorized Bobcat dealers in the Philadelphia Metro area was conducted from April 8 to June 4, 2026. The document requires signatures from the Cognizant Requisition Originator, 1st Level Supervisor, and Contracting Officer, with the certifying officer acknowledging that processing this justification precludes the use of full and open competition.

2. SUPPORTING DOCUMENTATION FOR SOLE SOURCE/BRAND NAME
BASED ON CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF
THE ACQUISITION
In order to maintain the manufacturer warranty for the Forklifts, any service provided must be a BOBCAT authorized dealer. Utilizing a non-authorized service provider voids active OEM warranties and risks the installation of third-party, non-conforming parts. To ensure safe, compliant operation on military installations, only certified technicians installing genuine Bobcat parts are authorized
Per the manufacturer’s warranty (attached), “For this warranty to be effective, BOBCAT requires all warranty work to be performed by an authorized BOBCAT dealer.
Recommended maintenance be performed, service records be completed and available for inspection by BOBCAT, and defective parts be available for return to BOBCAT. Also, the hour meter shall not have been tampered with or disconnected. Parts replaced under this warranty are warranted only for the balance of the Forklift warranty period. All fluids, filters and lubricants must meet BOBCAT specifications.”
Bobcat equipment utilizes specialized, proprietary diagnostic software, firmware, and tooling to analyze engine and hydraulic performance. Non-authorized dealers do not have legal access to these licensed diagnostic platforms. Bobcat-authorized dealers employ technicians who have undergone factory-certified training specific to these models, ensuring correct torque specifications, system calibrations, and safety standards are met.
