Memorandum for Record – Justification for Brand-Name Procurement
This is a Memorandum for Record (MFR) justifying a brand-name restriction for a federal procurement. DLA Distribution, located in New Cumberland, Pennsylvania, is procuring Safariland brand tactical external vest carriers for the DLA Police Department at DLA Susquehanna under Solicitation #SP330026Q5012. The procurement will be conducted using FAR Part 12 procedures for commercial products as a firm-fixed-price contract action, with the opportunity posted publicly on SAM.gov to maximize competition among authorized Safariland dealers.
The justification for restricting the procurement to Safariland brand carriers is based on system compatibility and safety requirements. The DLA Police Department's existing body armor inventory consists entirely of custom-fitted Safariland ballistic panels that are designed as a unified system with their corresponding carriers. The contracting officer established that mixing ballistic panels from one manufacturer with carriers from another manufacturer can void the manufacturer's warranty and compromise NIJ safety certification under standard 0101.06, potentially allowing soft armor inserts to shift or bunch and leave vital organs exposed. Additionally, Safariland carriers are proprietary and uniquely cut to match the internal dimensions and perimeter shape of Safariland panels, and sizing must be performed by manufacturer-trained representatives to ensure proper fit without restricting officer mobility. The contracting officer determined this action represents the best value to the Government, with pricing to be determined fair and reasonable at the time of award.

5. Solicitation Procedures The opportunity will be available publicly on SAM.gov .
6. Justification Rationale The brand Safariland is the only brand that is acceptable for the procurement of the carrier vests. The DLA Police Department’s primary body armor existing inventory consists entirely of custom-fitted Safariland ballistic panels. Ballistic panels and their corresponding carriers are designed as a unified system.
The DLA Police Department’s primary body armor inventory consists entirely of custom-fitted Safariland ballistic panels. Ballistic panels and their corresponding carriers are designed as a unified system.
1. NIJ Certification and Warranty Integrity: Under National Institute of Justice (NIJ) standard 0101.06, mixing ballistic panels from one manufacturer with an external carrier from a different manufacturer can void the manufacturer’s warranty and compromise the system's NIJ safety certification. A loose or improperly aligned carrier allows soft armor inserts to shift, fold, or bunch, leaving vital organs exposed to ballistic threats.
2. Dimensional Fit: The external carrier must perfectly match the internal dimensions and perimeter shape of the existing Safariland ballistic panels currently issued to the DLA police officers. Safariland carriers are proprietary and uniquely cut to secure their own panels.
3. Certified Technicians: Sizing must be performed by manufacturer-trained representatives to ensure the vest is fitted to accommodate both the soft armor panels and the hard plates without restricting the officer’s range of motion. To guarantee safety and mobility, each carrier must be custom sized to the individual officer and their corresponding ballistic panels.
7. Other Supporting Facts The brand name Safariland is the only applicable brand accepted by the Government due to the Governments existing inventory of ballistic plates that can only be utilized with carriers manufactured by Safariland. This brand name is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
8. Fair and Reasonable The price will be determined fair and reasonable at the time of award.
9. Determination The Contracting Officer acknowledges that the above justification is “accurate and complete to the best of the contracting officer’s knowledge and belief.” Additionally, I have determined that this action represents the best value to the Government.
