About this file
This is a Brand Name Justification document for a simplified acquisition procedure (SAP) for medical equipment procurement by the Department of Veterans Affairs.
The Department of Veterans Affairs, Network Contracting Office 10, is procuring an Endoscopy Reprocessing Sink for the Wyoming Clinic, a Community-Based Outpatient Clinic (CBOC) under Battle Creek VA Medical Center in Battle Creek, Michigan. The current equipment is noncompliant with VHA Directive 1116(2) and AAMI standards set forth by the Joint Commission and has been designated as a Priority 1 (Mission Critical) replacement for the Gastrointestinal clinic's reprocessing area. The estimated amount is under the Simplified Acquisition Threshold (SAT) of $350,000. Market research included searching the SBA Small Business database using NAICS code 339113 (which identified 15 vendors including 4 Small Disadvantaged Veteran-Owned Small Business [SDVOSB] vendors), searching GSA and keyword databases for endoscopy and reprocessing sinks, reviewing the VA Schedule Management Center and VANAC procurement history, and posting a Sources Sought notice. The research determined that no other vendor besides Pure Process LLC could customize a double sink and table to meet the specific space requirements for the Wyoming Clinic location. The Contracting Officer has certified the justification as accurate and approved the purchase under FAR RFO 12.102. The acquisition will be competed as an open market SDVOSB set-aside, satisfying the VA Rule of Two.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source
Attachment 1: Brand Name Justification for SAP up to SAT
DEPARTMENT OF VETERANS AFFAIRS
Brand Name Justification for Awards IAW FAR Overhaul 12.102(a)
For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($350K)
Acquisition Plan Action ID: 36C250-26-AP-2449
1. Contracting Activity:
Department of Veterans Affairs, Network Contracting Office 10, in support of VISN 10, Battle Creek VA Medical Center, 5500 Armstrong Rd, Battle Creek, MI 49037
2237: 515-26-2-069-0090
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Brand Name Only: This request is to replace the Endoscopy Reprocessing Sink at the
Wyoming Clinic, a CBOC to the Battle Creek VAMC, for the Sterile Processing Service
(SPS). The current equipment was original to the building and is noncompliant with VHA
Directive 1116(2), and the Association for the Advancement of Medical Instrumentation
(AAMI) standards set forth by the Joint Commission, AMMI ST91. This has been deemed a Priority 1 replacement (Mission Critical) for the Gastrointestinal (GI) clinic’s reprocessing area within SPS during the recent site visit and audit from the VISN 10
Chief Sterile Processing Officer (CSPO). The C&A requirements do not apply, and a
Security Accreditation Package is not required.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
VAPAHCS medical staff researched similar sinks and tables. No other vendor had the ability to customize a double sink and table, nor could they meet the specific space requirements. Pure Process LLC stated it will meet the requirement within the space constrictions.
4. Description of market research conducted and results or statement why it was not conducted:
Searched SBA SBS using NAICS 339113 and located 15 vendors, of which 4 are SD/VOSB vendors. Searched again, using keywords “Endoscopy Sink”, and there were 12 vendors.
Searched GSA for Endoscopy Sink, and there were no vendors listed. Searched again using key term “Reprocessing Sink”, and several Steris Sink options were listed. The Steris Sinks are not designed for the Endoscopic process. Searched the SCMC and VANAC, and it revealed several Steris Sink procurements. I posted a Sources Sought, and several Small Business vendors, including the OEM, replied and advised they could meet this requirement. I then contacted the vendor, and was advised they have several SDVOSB vendors for this product.
The VA Rule of Two is attainable, this action will be competed Open Market, as an SDVOSB set-aside.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR RFO
12.102. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
