About this file

This is a Brand Name or Equal Justification document for a simplified acquisition procedure at the Department of Veterans Affairs. The contracting activity is the VA Network Contracting Office 10, supporting VISN 10 at Battle Creek VA Medical Center in Michigan. The acquisition seeks to procure one endoscopy reprocessing sink (PureSteel Healthcare brand, part number PS-97530-HA-03-301810B) to replace noncompliant equipment at the Wyoming Clinic's Sterile Processing Service. The sink must meet VHA Directive 1116(2) and AAMI standards per Joint Commission requirements and has been classified as Priority 1 (Mission Critical) for the gastrointestinal clinic's reprocessing area. The equipment specifications include overall dimensions of 97.5" L x 30" W with adjustable height, three 30" x 18" x 10" basins with telescoping drains, ergonomic features including 45-degree wrist rests and 10" gooseneck swivel spout sprayers, dual sink light hoods (4' and 2' lengths), programmable timer with alarm, halogen task light with 27" gooseneck arm and 2X magnifier, wall-mounted pegboard backing, and various accompaniments including LED basin lights, scope buddy shelf mount system, and stainless steel wire baskets.

The market research identified 15 vendors through SBA searches using NAICS 339113, with 4 identified as SD/VOSB vendors, and additional searches revealed Steris sink options that were deemed unsuitable for endoscopic processes. A sources sought notice resulted in responses from small business vendors, including OEM representatives, confirming capability to meet requirements. The contracting officer certified that PureSteel provides required compatibility with existing equipment and customization capabilities that other vendors cannot match. The acquisition will be competed as an open market SDVOSB set-aside, making the VA Rule of Two attainable. The estimated acquisition amount exceeds the micro-purchase threshold but does not exceed the simplified acquisition threshold of $350,000. The acquisition plan action ID is 36C250-26-AP-2449, with solicitation number 36C25026Q0725, and no C&A requirements or Security Accreditation Package are required.

VHAPG Part 813.106 Simplified Acquisition Procedures Attachment 1: Brand Name or Equal Justification for SAP up to SAT

DEPARTMENT OF VETERANS AFFAIRS

Brand Name or Equal Justification for Awards IAW FAR Overhaul 12.102(a)

For Over Micro-Purchase Threshold but Not Exceeding the SAT ($350K)

Acquisition Plan Action ID: 36C250-26-AP-2449

1. Contracting Activity:

Department of Veterans Affairs, Network Contracting Office 10, in support of VISN 10, Battle Creek VA Medical Center, 5500 Armstrong Rd, Battle Creek, MI 49037

2237: 515-26-2-069-0090

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Brand Name or Equal: This request is to replace the Endoscopy Reprocessing Sink at the Wyoming Clinic, a CBOC to the Battle Creek VAMC, for the Sterile Processing Service (SPS). The current equipment was original to the building and is noncompliant with VHA Directive 1116(2), and the Association for the Advancement of Medical Instrumentation (AAMI) standards set forth by the Joint Commission, AMMI ST91. This has been deemed a Priority 1 replacement (Mission Critical) for the Gastrointestinal (GI) clinic’s reprocessing area within SPS during the recent site visit and audit from the VISN 10 Chief Sterile Processing Officer (CSPO). The C&A requirements do not apply, and a Security Accreditation Package is not required.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

PureSteel provides required compatibility with existing equipment, ensuring interoperability and avoiding system integration issues. VAPAHCS medical staff researched similar sinks and tables. No other vendor was located with the ability to customize a double sink and table, nor could they meet the specific space requirements. Pure Process LLC stated it will meet the requirement within the space constrictions.

4. Description of market research conducted and results or statement why it was not conducted:

Searched SBA SBS using NAICS 339113 and located 15 vendors, of which 4 are SD/VOSB vendors. Searched again, using keywords “Endoscopy Sink”, and there were 12 vendors. Searched GSA for Endoscopy Sink, and there were no vendors listed. Searched again using key term “Reprocessing Sink”, and several Steris Sink options were listed. The Steris Sinks are not designed for the Endoscopic process. Searched the SCMC and VANAC, and it revealed several Steris Sink procurements. I posted a Sources Sought, and several Small Business vendors, including the OEM, replied and advised they could meet this requirement. I then contacted the vendor, and was advised they have several SDVOSB vendors for this product. The VA Rule of Two is attainable, this action will be competed Open Market, as an SDVOSB set-aside.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR RFO 12.102. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
