About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition (OTFOC) submitted by the Department of Veterans Affairs, NCO 10, Dayton VA Medical Center.

The acquisition seeks approval to procure a Tridium HVAC control panel on a brand name only basis for the Renovate Catholic Chapel Building 119 project (Project #552-22-201). The panel will serve as the HVAC Control Unit referenced in Division 23, Section 23 09 23. The justification cites 41 USC §3304(a)(1) as the statutory authority, asserting that Tridium is the only responsible source capable of meeting the agency's needs because Tridium panels use proprietary communication protocols designed exclusively for compatibility with other Tridium products. The existing HVAC Direct Digital Control (DDC) system at the Dayton VAMC campus currently utilizes Tridium panels throughout, and interchanging manufacturers would create operational risks and potential system failures. No market research was conducted; pricing will be determined fair and reasonable based on comparison with commercially published price lists and catalogs for similar products. The document notes that no other sources expressed written interest in the acquisition. The agency determined that no corrective actions can be taken to remove barriers to competition due to warranty requirements and the need to maintain system compatibility. Gregory Hopper, Historical Engineer in the Facilities Management Service, certified the requirement as a bona fide need, and Jenessa Regan, Network Contracting Officer, certified the accuracy and completeness of the justification on February 9, 2026.
