Memorandum for Record – Brand Name Justification Summary

This is a Brand Name Justification memorandum for a federal contract procurement conducted by the 1st Armored Division through MICC at Fort Bliss. The requirement is for Advanced Manufacturing Training services valued at $450,000.00, with a fixed-price purchase order contract vehicle. The procurement is funded through FY26 Operations & Maintenance, Army (OMA) appropriations, with a performance period from 27 April 2026 through 26 April 2027. The contractor must provide six (6) training classes delivering instruction on current and future manufacturing methods, including three (3) onpost training sessions and three (3) offpost training sessions as specified in the Performance Work Statement. Upon completion, students will be capable of designing, manufacturing, and qualifying Final-Use Original Equipment Manufacturer (OEM) components listed in Attachment 3, with the goal of reducing lead times and strengthening defense readiness.

The contracting officer cites FAR 16.507-7(b) as the authority for limiting competition to items peculiar to one manufacturer. Market research conducted through two Sources Sought notices (6-20 October 2025 and 6-20 March 2026) identified five qualified vendors capable of performing the requirement—four small businesses and one large business in each notice. Based on these findings, a 100% Total Small Business set aside is recommended to establish adequate price competition and ensure fair and reasonable pricing. The justification will be posted in accordance with FAR 52.211-6(a) for brand name restrictions exceeding $40,000. The Contracting Officer, MSG Jenny Cisneros, has certified that the expected price is fair and reasonable and has approved the limitation of competition.

8. Market Research: Market research confirms that the procurement of advanced manufacturing training continues to constitute a specialized requirement with inherent pricing variability. The initial Sources Sought notice, posted from 06 October 2025 through 20 October 2025, resulted in the identification of five (5) qualified vendors capable of performing the requirement in accordance with the Performance Work Statement (PWS). Of these vendors, four (4) were Small Businesses and one (1) was a Large Business.

Following a refinement of the PWS, a subsequent Sources Sought notice was issued from 06 March 2026 through 20 March 2026. During this period, multiple vendor questions were received, and responses were published on 17 March 2026. This notice identified five (5) potential vendors, consisting of four (4) Small Businesses and one (1) Large Business.

Based on these findings, it is recommended that 100% Total Small Business set aside be pursued, as this approach will provide the Government with the most advantageous means to establish adequate price competition and ensure that pricing is fair and reasonable within the marketplace for future procurements.

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

11. Contracting Officer Certification/Approval: I hereby determine that the expected price to the Government for the acquisition of the specified brand-name product(s) is fair and reasonable, supported by the market research and justification contained in this document.

I certify that this Brand Name Justification is true, accurate, and complete to the best of my knowledge and belief. I approve the limitation of competition to the identified brand name, subject to funding availability and provided that the supplies or services described are authorized for procurement in accordance with applicable regulations.
