In order to comply with Colorado law, the proposed product or deliverable must meet these WCAG guidelines. To assess the current status of compliance, the City may request a functional accessibility evaluation such as providing an accessibility compliance report utilizing the current ITIC Voluntary Product Accessibility Template (VPAT 2.5 WCAG) or manual testing reports. If the product or deliverable does not or cannot meet these compliance standards or you cannot provide these evaluations, the City may engage in dialogue to understand the status of the product and how to bring the product into compliance. This may include your organization either performing or procuring manual testing of the product, providing reports for the current accessibility compliance status and providing a roadmap for when issues can be remediated.

3.1. EVALUATION PROCESS

A comprehensive, thorough, complete, and impartial evaluation of each proposal received will be conducted. The award shall be made to the responsible Offeror whose proposal is determined to be the most advantageous to the City, taking into consideration the price and evaluation factors set forth in this Request for Proposal.

3.2. EVALUATION COMMITTEE

An Evaluation Committee will be established utilizing measures to ensure the integrity of the evaluation process. These measures include the following:

• Selecting committee members who do not have a conflict of interest regarding this solicitation.

• Facilitating the independent review of proposals.

• Requiring the evaluation of the proposals to be based strictly on the content of the proposals.

• Ensuring the fair and impartial treatment of all Offerors.

The objective of the Evaluation Committee is to conduct reviews of the proposals that have been submitted, to hold frank and detailed discussions among themselves, and to recommend an Offeror for award.

3.3. PROPOSAL EVALUATION CRITERIA

• The City will evaluate proposals to determine if each Offeror meets all mandatory qualification requirements; provided, however, that the City has the authority to waive non-material mandatory requirements in certain circumstances. The mandatory qualification requirements are scored on a Met/ Not Met basis and only those proposals found to meet all mandatory requirements, other than non-material mandatory requirements waived by the City, can be considered for a Contract resulting from this solicitation.

• Proposals will be evaluated by the Evaluation Committee using the evaluation criteria listed below. The evaluators will consider whether the Scope of Work requirements in the solicitation have been addressed, and they will review the capabilities of the Offeror, as well as the quality of the approach proposed, the price, and any other aspect determined relevant to the evaluation criteria.

• The evaluation criteria to be used in evaluating the proposals are as follows (and are listed in no particular order):

Experience & Qualifications - Vendors will be evaluated on their demonstrated experience performing comparable fencing installation and removal projects, with particular emphasis on experience involving ornamental steel fencing systems, aquatic or water park facilities, and high-use commercial environments. The City will assess the number and relevance of completed projects involving core-drilled concrete post installations, gate hardware installation including panic hardware and self-closing mechanisms, and concrete patching and surface finishing in areas subject to foot traffic. Vendors must demonstrate familiarity with the Ameristar Montage Plus Classic model or comparable ornamental steel fencing systems. Experience working within active public facilities with operational constraints will be weighted favorably. Vendors must provide verifiable project references that reflect the scale and complexity of the work required under this solicitation.

25 points

Safety & Code Compliance - Vendors will be evaluated on their ability to meet all regulatory, licensing, and permitting requirements applicable to the scope of work. The City will assess whether the vendor holds all required contractor licenses and certifications applicable to fencing installation, concrete work, and gate hardware in Lafayette, CO.

Compliance with applicable local building codes, aquatic facility safety standards, and accessibility requirements for public entry, exit, and circulation gates will be evaluated. Vendors who identify specific applicable standards and demonstrate a clear process for ensuring compliance will be rated more favorably.

25 points

Price - Vendors will be evaluated on the total cost submitted for all required work, including but not limited to temporary fencing installation and maintenance, removal of existing fence panels, gates, and posts, concrete core drilling and post installation, concrete patching and surface repair, furnishing and installing the front entry gate, double-swing gate, and exit gate, and all associated labor, materials, equipment, and services. Pricing will be assessed for completeness, reasonableness, and consistency with the defined scope of work. The City will evaluate whether the submitted pricing reflects a thorough understanding of the project requirements, including all phases of work from mobilization through final restoration. Any omissions, exclusions, or assumptions that reduce the total price will be identified and considered as part of the overall pricing evaluation. Unit pricing for individual components, where requested, will also be reviewed to assess consistency and transparency.

25 points

Material Compatibility and Product Quality - Vendors will be evaluated on the suitability and compatibility of all proposed fencing panels, posts, gates, and hardware with the existing Ameristar Montage Plus Classic model ornamental steel fencing system. The City will assess whether proposed materials match or are demonstrably compatible with the existing system in terms of height, finish, style, and structural characteristics. Gate hardware will be evaluated for commercial-grade quality, corrosion resistance, and suitability for a high-use outdoor aquatic environment. Specific evaluation will be applied to the proposed panic hardware for the front entry gate, padlock-ready locking hardware and lockable drop pins for the double-swing gate, and self-closing hinges and anti-tamper hardware for the exit gate. Vendors must provide sufficient product documentation to allow the City to assess material quality and compatibility prior to any work commencing.

15 points

3.4. DEMONSTRATIONS AND DISCUSSIONS

The Evaluation Committee may, if it deems necessary, request clarifications, conduct discussions or oral presentations, or request best and final offers. Discussions may be held with responsible offerors whose proposals are determined to be reasonably susceptible to be selected for award to:

a. Promote understanding of the City’s requirements and the Offerors’ proposals; and

b. Facilitate a Contract that will be most advantageous to the City taking into consideration price and the other evaluation factors set forth in the request for proposals.

The Evaluation Committee may adjust its scoring based on the results of such activities.

However, proposals may be reviewed and determinations made without such activities.

Offerors should be aware that the opportunity for further explanation might not exist;

therefore, Offerors should ensure that their submission is complete, and are encouraged to submit their best possible proposal, including pricing.

3.5. SINGLE PROPOSAL

If only one bid or proposal is received in response to a solicitation, an award may be made to the single bidder or Offeror if the procurement official finds that the price submitted is fair and reasonable and that other prospective bidders or Offerors had reasonable opportunity to respond.

3.6. AWARD

A Notice of Intent to Award will be published on Bidnet.

The award determination is ultimately a business decision that will reflect an integrated assessment of the relative merits of the proposals received, using the factors set forth in

Project Timeline - Vendors will be evaluated on the feasibility and completeness of their proposed project schedule. The City will assess whether the schedule identifies all major milestones, including temporary fencing installation, phased removal, core drilling and post installation, concrete patching and curing, gate installation, and project closeout. The schedule will be evaluated for reasonableness given the scope of work and for the vendor's demonstrated ability to complete the project within a timeframe that minimizes impact on water park operations. Vendors who clearly indicate their availability to begin work promptly and align their schedule with facility operational requirements will be rated more favorably. The schedule should reflect an understanding that work coordination with the City -is required throughout the project and that restricted work hours may apply.
