If the award is to be on any other basis, transportation charges must be prepaid by the contractor and added to the invoice as a separate item.
5. The words “or equal” are understood to appear after each commodity giving manufacturer’s name or catalog reference, or on any patented commodity. If bidding on commodities other than those specified, bidder must in every instance give the trade designation of the commodity he proposes to furnish. Otherwise bid will be construed as submitted on the identical commodity described in the specification.
6. Right is reserved to raise or reduce quantities when placing an order.

10. If you are not submitting a bid it is important that you answer this proposal by specified time. Failure to respond to three successive proposals may result in your name being removed from the mailing list.
11. Purchases made by the State of New York are not subject to state or local sales taxes, federal excise taxes or transportation taxes.
To satisfy requirements of the New York State Sales Tax, either the purchase order issued by an agency or institution of New York State for supplies or equipment, or the voucher forwarded to authorize payment for such supplies and equipment will be sufficient evidence that the sale by a contractor or vendor was made to the State of New York, an exempt organization under section 1116 (a)(1) of the Tax Law. New York State Federal Excise Tax Exemption Certificate number is A 158789.
12. So far as concerns the obligations of the State University hereunder, this agreement shall be deemed executory only to the extent of monies available to the State University or the State of New York beyond the monies available for the purposes hereof.
13. Neither party hereto shall assign, transfer or convey this agreement or any part thereof or any interest therein without the consent in writing of the other.
14. The agreement shall be void and of no force and effect unless the contractor shall provide coverage for the benefit of, and keep covered during the life of this agreement, such employees as are required to be covered by the provisions of the Workmen’s Compensation Law.
