About this file
This document is Bid Bond Preparation Instructions issued by the State of West Virginia's Department of Administration Purchasing Section. The instructions provide a standardized template and guidance for bidders submitting proposals in response to West Virginia government solicitations. The bid bond serves as a financial guarantee that a bidder will enter into a contract if their proposal is accepted and will furnish any additional bonds or insurance required. The document outlines the required components of the bid bond, including identification of the principal (bidder), surety (bonding company), obligee (State of West Virginia), and the specific scope of work being bid upon. No specific project details, quantities, response dates, or contract terms are outlined in these instructions, as they function as a procedural guide applicable across multiple solicitations.
Bid bonds must be executed with a penal sum equal to a minimum of 5% of the total bid amount, though bidders may propose a higher amount. The surety must be licensed to transact surety insurance in West Virginia and must affix its corporate seal to the bond document. A dated power of attorney with the surety's seal must accompany the bid bond submission. The surety's liability is capped at the penal amount stated in the bond, and the surety waives notice of any extensions granted by the State for bid acceptance. The bond document must be signed by the principal's president, vice president, or duly authorized agent and by an attorney-in-fact representing the surety, with both signatures and seals required to constitute a valid submission.
