About this file
This document is a clarification response issued by Clackamas County Department of Transportation and Development regarding BID 2026-53 for the Marquam Paving Project, a rural roadway resurfacing initiative spanning 3.6 miles across South Drake Road, South Farm Road, and related county roads. The clarification response addresses five key questions submitted by interested bidders regarding the scope and specifications of various bid items. The project scope includes placing approximately 8,860 tons of asphalt concrete paving, cold planing approximately 4,000 square yards of existing pavement, and performing surface removal and subgrade repairs of varying depths. Bid items under clarification include B.I. #112 (Removal of Surfacings), B.I. #119 (Aggregate Base Restoration), B.I. #128 (8 Inch Asphalt Concrete Paving Repair), and B.I. #114 (12 Inch Subgrade Stabilization). The original substantial completion date of September 3, 2026 was revised to Friday, October 2, 2026 in response to contractor concerns regarding schedule feasibility. Bids were due July 7, 2026 at 2:00 PM Pacific Time, with public bid opening scheduled for July 7, 2026 at 2:05 PM via Zoom. Work cannot commence before June 15, 2026, with lane closures permitted Monday through Friday, 7:00 a.m. to 6:00 p.m., subject to more restrictive hours on State Highway OR213.
The County's Engineers Estimate is $1.66 million. Bidders must submit 10 percent bid security and, if selected, execute 100 percent Performance and Payment Bonds within 20 calendar days, with 5 percent retainage applied to progress payments. Liquidated damages apply for lane closures and traffic delays exceeding specified limits, driveway completion delays beyond 30 calendar days, and failure to meet contract time at 15 percent of the bid amount divided by total contract days. Prime contractors must hold current prequalification with either the Oregon Department of Transportation or Clackamas County in Asphalt Concrete Paving, Temporary Traffic Control, Miscellaneous Highway Appurtenances, and Earthwork classifications, with prequalification serving as a hard eligibility filter. Good Faith Effort outreach to at least three Historically Underrepresented Business subcontractors is required for each division of work. Work must comply with the 2024 Oregon Standard Specifications for Construction and Oregon Department of Transportation standards, with state prevailing wage rates applicable. The County encourages bids from Minority, Women, and Emerging Small Businesses.

INVITATION TO BID #2026-53
Marquam Paving Project
PROJECT (“BID”)
RESPONSE TO CLARIFYING QUESTIONS #2
July 6, 2026
Note that these are questions submitted by interested firms to the above referenced solicitation.
The below answers are for clarification purposes only and in no way alter or amend the BID as published.
1. Does B.I. #112 “Removal of Surfacings” encompass the pavement and rock removal work for B.I. #119 “Aggregate Base Restoration”? Or is the removal work for B.I. #119 incidental? The payment section (00610.90) mentions that disposal is incidental but does not state that removal is.
B.I.#112 does not encompass the pavement and rock removal work for B.I.#119.
B.I. #112 is marked in specific locations on the plans (Pages C-08, C-13, C-14, C-18, C-19) with areas that need reconditioning, as well as extra aggregate base for grade adjustments.
These marked areas are poorly graded and in bad condition thus needing removal and grading. Being that this is primarily an overlay project the removal of surfacing areas are limited to portions of this project that need all the above stated treatments.
B.I. #119 is specific to areas where the road width has deteriorated to the point that the proposed full width overlay would essentially result in paving on top of dirt or other areas without the proper aggregate base underneath it. Please see detail 4 sheet C-03. Removal and disposal of any debris or pavement is incidental to this bid item.
2. Where and how does B.I. #128 “8 Inch Asphalt Concrete Paving Repair” incorporate into the project? There is no work shown on the plans calling for this that I can locate.
a. As a subpart of this question… Detail 1 on Sheet C-03 of the plans says the following: “… If additional grind depth required use 12-inch Subgrade Stabilization.” Is this supposed to read: “... Use 8-inch Asphalt Concrete Paving Repair”? Just trying to make sense of B.I. #128.
B.I.#128 is a provision we have that may come into effect in areas where the plans have identified pavement deficiencies. See sheet C-03 detail 1, this explains where the 8 inch asphalt concrete pavement repair and the 12 inch subgrade stabilization may play a role. The ACP spot grind detail shows 2” additional milling depth, which will likely extend to the aggregate base layer in most areas due to the thin asphalt thickness. If the material is soft at this depth, detail 2 on C-03 shows the additional 8” removal and aggregate section required for the asphalt concrete repair.

3. How were the quantities of B.I. #114 “12 Inch Subgrade Stabilization” and B.I. #128 “8 Inch Asphalt Concrete Paving Repair” generated? Is there any insight as to where and how large these areas are?
Quantities for these bid items are estimates based off potential conditions found in the field.
Final quantities will be based on actual encounters where necessary to complete a resurfacing repair. The condition of the existing pavement at the time of observation was deteriorated to the extent that made it infeasible to determine precise locations for all these items.
4. The match line from the top drawing on Sheet C-08 to the top drawing on Sheet C-14 of the plans do not match up, duplicating the area of the intersection of Drake Road & Farm Road.
The match line on C-08 is strictly a visual indicator for point of reference as to where that sheet ends. C-14 does show the same intersection as sheet C-08 however it does not impact areas or quantities.
5. If the County is going to use a firm completion date, then a firm Contract / NTP date needs to be given. There is unquantifiable risk on this project, with the Contractor at the mercy of the County to issue Contract and NTP. We propose either giving the contract 60 or 90 days from NTP, if a variable NTP date is needed, OR, give the contract a firm NTP date with sufficient time to complete the project before the already stated substantial completion and then follow through on it.
After internal discussion we have arrived at a new substantial completion date of Friday October 2, 2026.
