About this file
This is a Business Enterprise Program (BEP) Waiver Request and Review Form issued by the State of Illinois Commission on Equity and Inclusion (CEI). The form is designed for bidders and offerors on state contracts to request waivers from BEP participation goals when they cannot meet the established utilization targets. The document outlines a comprehensive ten-requirement process that vendors must follow to demonstrate good faith efforts in soliciting certified minority, women, and disability-owned business enterprises (MWDBEs) for contract participation. Bidders are required to document their outreach activities, including communication dates and methods with certified vendors, negotiation attempts, cost comparisons, and historical use of certified vendors in current and prior fiscal years. The form serves as the primary mechanism for evaluating whether a vendor has conducted sufficient due diligence before requesting relief from BEP goals.
The form requires multiple levels of review and approval, including sections for prime vendor submission, purchasing entity evaluation and recommendation, CEI Compliance review, and final determination by the CEI Deputy Director. All documentation supporting the waiver request, such as proof of vendor solicitation, communication records, negotiation attempts, and cost differential analyses, must be submitted with the form. The completed form with all required signatures must be forwarded to the assigned Compliance Officer and Jacob Perez, CEI Deputy Director, at Jacob.Perez@Illinois.gov, with copies to CEI.BEP.Compliance@Illinois.gov. CEI's final determination will consider the vendor's good faith efforts, the total number of prior waivers granted to the prime vendor, and the vendor's historical utilization of minority, women, and disability-owned businesses across current and prior fiscal years.
