About this file

This is a Basis for Award Evaluation document outlining the criteria and methodology for evaluating proposals submitted in response to the Tobyhanna Lightning Protection System solicitation (PAN032531) issued by the Department of the Army.

The Government will award the contract to the responsible offeror whose proposal represents the best value using three evaluation factors: Technical, Price, and Past Performance. Offerors must submit fixed prices for line items CLINs 0001 and 0002 to cover inspection, maintenance, and repair services for lightning protection systems as detailed in the Performance Work Statement. The Government intends to award without discussions and encourages offerors to submit their best price in initial proposals, though the Contracting Officer retains discretion to conduct discussions if deemed beneficial. The Technical factor requires documentation of either Underwriters Laboratories Lightning Protection Master Certification or Lightning Protection Institute Certification, along with demonstrated experience in lightning protection system inspection, maintenance, and repair in compliance with NFPA 70, NFPA 780, and other applicable standards governing lightning protection system installation. Past Performance evaluation requires submission of two relevant contract samples completed within the past five years; proposals lacking recent or relevant past performance will receive neither favorable nor unfavorable ratings. Award is effective upon written notice of award mailed or furnished to the successful offeror within the timeframe specified in the offer, creating a binding contract without further action required by either party.

BASIS FOR AWARD

EVALUATION OF PROPOSALS

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be the best value to the Government.

Three (3) evaluation factors: Technical, Price, and Past Performance will be used.

Price – Offerors shall complete the line item(s) CLINs 0001 and 0002 with a fixed price to complete the services and hourly repair work as described in the PWS. Offerors are encouraged to submit their best price in the initial proposal as the Government intends to award without discussions; however, the Contracting Officer reserves the right to hold discussions if it is determined to be in the best interest of the Government.

Technical – Shall show the Contractor has an Underwriters Laboratories Lightning Protection Master Certification or Certification from the Lightning Protection Institute. This must also show the contractors’ experience in the inspection, maintenance and repair of lightning protection systems in accordance with the National Fire Protection Association, NFPA70, NFPA 780, and all other requirements that govern the installation of lightning protection systems.

Past Performance – Past Performance to include 2 relevant contract samples within the past 5 years.

No recent/relevant past performance will be rated either favorably or unfavorably. Nothing in this solicitation prohibits the Government from obtaining and considering past performance from any source available.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
