About this file
This is a Bailment Agreement template for the transfer of Army property to a contractor for the development of a drop-in kit and/or surrogate weapon compatible with the Next Generation Squad Weapon (NGSW) systems. The Government will loan equipment valued at replacement cost to the Bailee (contractor) at no cost, including two M7 rifles (one live-fire, one demilitarized), two M7 Carbine Variants (one live-fire, one demilitarized), two M250 Automatic Rifles (one live-fire, one demilitarized), one XM157 Fire Control unit, a technical data package, and ballistic data. The agreement is structured as a bailment for mutual benefit with a 12-month initial term, extendable by mutual written agreement, after which the Bailee must return all property at its own shipping expense. Title remains with the Government at all times.
The Bailee must comply with rigorous security and handling requirements including maintaining a SECRET-level Facility Clearance from DCSA, restricting access to cleared personnel with valid need-to-know, storing live-fire weapons in GSA-approved Class 5 containers per DoD Manual 5100.76, and maintaining Federal Firearms Licensee status. The Bailee assumes all risk of loss, theft, or damage and is responsible for full replacement value. Security incidents involving live-fire weapons or functional fire control units must be reported within two hours to the CPE-STRI Security POC and DCSA Field Office, with immediate notification to ATF and FBI, and formal written reports within 24 hours. The agreement prohibits public demonstration, reverse engineering unrelated to the project, transfer to third parties without approval, and use in for-profit ventures outside the project scope. The Bailee must return all technical data generated under the agreement, granting the Government unlimited rights to such data, and must comply with all export controls, ITAR restrictions, and sanctions laws. The agreement includes comprehensive disclaimers of warranties and releases of liability for the Government.
