Build America, Buy America Certification Form
This is a Build America, Buy America (BABA) certification form required by the City of Fort Myers, Florida for the Sanitary Sewer Evaluation Survey Program On-Call Contractors - Cure-In-Place Pipe (CIPP) Lining procurement. The form mandates that all contractors and subcontractors use iron, steel, manufactured products, and construction materials produced in the United States in compliance with the Infrastructure Investment and Jobs Act passed on November 15, 2021. The solicitation (RSQ 25-094) was released on August 11, 2025, with questions due by August 28, 2025, and final submissions required by September 11, 2025. The selected contractors will provide comprehensive pipe rehabilitation services for the city's wastewater collection system, including work supervision, sanitary sewer cleaning, CCTV inspection, and CIPP installation. The contract will have a five-year term with proposed City Council approval on October 20, 2025, and will be awarded to multiple contractors.
All respondents must certify that they have read, understand, and will comply with BABA provisions for all project portions, including subcontracted work. Contractors must identify domestic sources of BABA-covered products, provide verification documentation for BABA compliance, and submit waiver documentation when necessary per federal guidelines. False statements on this certification may result in rejection or termination of any award and/or contract. The procurement is federally funded and includes specific set-asides for Disadvantaged Business Enterprise (DBE) participation with a statewide goal of 10.54%, as well as potential Minority Business Enterprise and Women's Business Enterprise goals of five percent each. The project is part of a comprehensive initiative to reduce infiltration and inflow, minimize sewer overflow risks, and improve the reliability of the gravity sewer system serving Fort Myers' approximately 260 miles of gravity sewers, 6,906 manholes, and over 200 lift stations.
