About this file
This is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers for federally funded construction projects. The form requires contractors bidding on the Lake Management Services contract (ITB 25-090) to certify compliance with BABA provisions mandated by the Infrastructure Investment and Jobs Act. The procurement involves comprehensive lake and pond maintenance services across 16 city locations, including aquatic weed control, buffer management, algae control, shoreline maintenance, visual inspections, and quarterly maintenance of aeration systems and fountains. Key dates include a pre-submittal meeting on September 16, 2025, a question submission deadline of October 1, 2025, and a proposal submission deadline of October 10, 2025, with City Council approval anticipated for November 3, 2025. The contract term extends for five years with month-to-month renewal options available.
The BABA certification requires all contractors and subcontractors to source iron, steel, manufactured products, and construction materials exclusively from domestic United States producers. Respondents must identify domestic sources of BABA-covered products, provide verification documentation demonstrating compliance, and submit waiver documentation when necessary per federal guidelines. The City of Fort Myers has established a Disadvantaged Business Enterprise (DBE) program with a 10.54% overall goal using a race-neutral approach. Contractors must possess valid pesticide applicator licenses, maintain appropriate insurance certificates, and comply with E-Verify, public records laws, background screening requirements, and all applicable federal regulations. False certification statements may result in bid rejection or contract termination.
