About this file
This document is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers Procurement Services for a federally funded project. The form requires contractors to certify compliance with the Build America, Buy America provisions of the Infrastructure Investment and Jobs Act, which mandates the use of iron, steel, manufactured products, and construction materials produced in the United States for construction, alteration, maintenance, or repair projects.
The certification requires contractors to identify domestic sources of BABA-covered products, provide verification documentation for compliance, and submit waiver documentation when necessary. Contractors must attest to understanding and adhering to these requirements for all project portions, including subcontracted work. The form emphasizes that false statements may result in rejection or termination of any award or contract, and provides a link to the White House website for additional information about BABA requirements and authorization.

As a respondent on the project listed above, I certify that I have read, understand, and will comply with the “Build America, Buy America” provisions as required by federal law. Furthermore, I understand that BABA provisions apply to any and all portions of this project, including subcontracted portions, and I certify to the best of my knowledge and belief that I will identify domestic sources of BABA-covered products, provide verification documentation for BABA compliance, and when needed provide waiver documentation per current federal guidelines.
I understand that a false statement on this certification may be grounds for rejection or termination of any award and/or contract.
