About this file
This file is Appendix E of the Federal Transit Administration Office of Research, Demonstration, & Innovation Broad Agency Announcement (BAA) 2026, containing the contractual requirements that will be incorporated into Phase I contracts upon award.
The appendix provides an illustrative list of Federal Acquisition Regulation (FAR) provisions and clauses required in Phase I contracts, organized into two categories: Provisions (P) and Clauses (C). Provisions are representations and certifications made during the proposal stage, while clauses become binding contractual obligations upon award. The provisions include certifications regarding payments to influence federal transactions, women-owned business status, system for award management registration, inverted domestic corporation prohibition, and submission requirements in English and U.S. currency. The clauses cover a comprehensive range of contractual obligations including anti-kickback procedures, whistleblower rights, small business utilization, labor compliance (including convict labor prohibition, equal opportunity, veterans employment, and trafficking in persons), employment eligibility verification, intellectual property rights, payment terms, dispute resolution, subcontracting requirements, and research misconduct. Additional clauses specific to the Department of Transportation are included, addressing contractor representatives, organizational conflicts of interest, performance requirements, payment procedures, and records management. The document notes that this list is not exhaustive and that complete clause language will be provided prior to contract award.
