This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form used for self-certification of eligibility in response to federal contract opportunities.

The form applies to solicitation 75H70926BAO-056-RFQ for a Bobcat Compact Articulated Loader L28 or Equal, dated July 7, 2026. Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian Ownership under 25 U.S.C. 47 (the Buy Indian Act) and HHSAR 326.601. Enterprises must maintain eligibility status at three critical points: when submitting an offer, at contract award, and throughout the full contract performance period, with immediate written notification to the Contracting Officer required if eligibility is lost. Individual Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful Offeror's eligibility is questioned. Successful Offerors must also be registered with the System of Award Management (SAM). The form requires the offeror to indicate whether it does or does not meet the Indian Economic Enterprise definition and must be completed with the name of the Federally Recognized Tribal Entity, the 51% owner of the firm, business name, UEI SAM number, certifying signature, and printed name. False or misleading information constitutes a violation under 18 U.S.C. 1001, with additional penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287 for false claims during contract performance.
