About this file

Summary

This is an AIA Document B101-2017 Standard Form of Agreement Between Owner and Architect (Draft) for the Casimir Pulaski Elementary School project located at 1 King Place, Meriden, Connecticut 06451. The agreement is between the Meriden School Building Committee (Owner), represented by ARCADIS as the Owner's Project Manager, and a yet-to-be-named Architect. The project involves comprehensive design services for a new Pre-K through 5th Grade school facility serving 706 students, including master planning, architectural design, structural, mechanical, electrical, plumbing, fire protection, site and civil engineering, landscape design, technology infrastructure, geotechnical services, cost estimating, and construction administration. The Architect's scope encompasses all necessary engineering disciplines and consulting services to ensure complete and accurate project design. The project delivery method is identified as Construction Manager-at-Risk with a Guaranteed Maximum Price, and the facility must meet or exceed either the State of Connecticut High Performance Building Standard or LEED Silver certification. The agreement establishes the Architect's responsibilities across schematic design, design development, construction documents, procurement, and construction administration phases, with a requirement for Building Information Modeling using REVIT or equivalent software and monthly design team coordination meetings.

The Architect shall maintain comprehensive insurance coverage including Commercial General Liability ($1,000,000 per occurrence/$2,000,000 aggregate), Professional Liability ($5,000,000 per claim and aggregate maintained for seven years post-completion), Workers' Compensation at statutory limits, and Employers' Liability ($500,000 per accident/$1,000,000 policy limit), with all policies naming the Owner, City of Meriden, and ARCADIS as additional insureds. Compensation terms are not fully detailed in this draft document; however, the Owner's budget for the Cost of the Work and specific compensation arrangements are referenced as separate exhibits. The agreement specifies that cost estimates shall be prepared by an independent cost estimator at key phases (pre-schematic design, end of schematic design, design development, and construction documents 50% and 100%), with collaborative reconciliation involving the Construction Manager. The Architect is responsible for compliance with all applicable Connecticut Department of Administrative Services requirements and building code regulations. The agreement also includes provisions for additional services beyond the scope, with the Architect required to provide written notice within 30 days of recognizing additional work needs, and specifies that any delays exceeding 120 days caused by the Owner constitute compensable delay at a rate not to exceed $500 per working day.
