1. DESCRIPTION/STATEMENT OF WORK

The total treatment area of this task order (TO) consists of approximately 1,358 acres of public lands within the Spokane District, Bureau of Land Management. The treatment area is located in the Airport pasture of the Fishtrap allotment, northeast of Sprague, WA. This area is highly susceptible to frequent wildfires due to its proximity to Interstate 90 and the high density of noxious weeds and invasive annual grasses. These treatments aim to mitigate wildland fire risk by reducing the horizontal and vertical continuity (Rate of Spread) and fuel loadings (ton/ac) of noxious weeds and invasive annual grasses and improve habitat for fire resilient native plant communities.

The treatment area consists of one unit to be treated with the herbicide imazapic (Plateau) for the control of invasive annual grasses. The treatment area is a relatively flat parcel with terrain variation ranging from 2,000’-2,100’. There are topographical and unique features on the east side of the unit that may inhibit the use of ground-based broadcast application methods.

2. SPECIFICATIONS:

• See full Statement of Work for all project specifications.

• Plateau is to be applied at 8oz. per acre; with Insist 90 applied at 2 pints per 100 gallons of mix;

with a total mix application rate of 10 gallons/acre.

• Herbicide, adjuvants and water will be supplied by the contractor. No substitution of chemicals or changes to application rates are allowed unless approved by the COR.

• Contractor shall provide at least 7 days’ notice to the BLM prior to treatments and provide a schedule of work.

• Contractor shall provide a completed Pesticide Application Record (PAR) for each treatment site and a map showing treated areas.

• Herbicide application progress shall be tracked by DGPS.

2.1 Key Personnel and Required Qualifications or Certifications

• Application by Commercial Pesticide Operator/Applicator, licensed by State Department of Agriculture (with all applicable Herbicide Category), of BLM-approved herbicides to forbs, grasses or wood.

4. INSPECTION AND ACCEPTANCE:

4.1 FAR 52.246-4: INSPECTION OF SERVICES--FIXED-PRICE (AUG 1996)

a. Definition. “Services”, as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

b. The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

c. The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

d. If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

e. If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may—

1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

2) Reduce the contract price to reflect the reduced value of the services performed.

f. If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—

1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

2) Terminate the contract for default.

4.2 CONTRACTOR INSPECTION PROCEDURES

(A) General Instructions

1) The Contractor shall generate a project log of the completed work utilizing a DGPS and supply a computer generated file (shapefile) created in a GPS Differential Guidance System to the COR. See 4.2 Description of Work.

2) By submission of project log to the Government, the Contractor is considered to be certifying that the unit is satisfactorily completed and that the project logs reflect the work accomplished.

3) In the event the Contractor falsifies inspection results, as determined by the Contracting Officer, the Government may declare the Contractor to be in default of the contract. Additionally, the Government may refer such falsifications to the US Attorney’s Office for possible prosecution pursuant to 18 U.S.C. 1001 (Falsification of Government Documents) or 18 U.S.C. 287 (Fraud).

4.3 GOVERNMENT INSPECTION PROCEDURES – COMPLIANCE INSPECTION:

(A) The COR, or a designated inspector, will conduct compliance inspections while work is in progress, usually daily at first, to assure that work is proceeding satisfactorily. Compliance inspections will be accomplished by the BLM COR/PI and will monitor to determine uniformity of herbicide application. Randomly placed drift cards may be used for quality control testing. If coverage is deemed unsatisfactory (e.g. less than 90% of drift cards show herbicide coverage), the contractor will be required to treat those areas at no additional cost to the

BLM.

(B) The Contractor shall notify the COR when units will be completed at least 3 days prior to completion to ensure inspections are complete and of acceptable quality prior to departing the project.

Work will be accepted on the basis of visual inspection for compliance with specifications on areas reported as completed by the Contractor.

5. COMMENCEMENT PROSECUTION, AND COMPLETION OF WORK

The Contractor shall be required to (a) commence work under this contract within 7 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 10/30/2026.

6. POST AWARD CONFERENCE

A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. The conference will be held at virtually.

7. EVALUATION CRITERIA:

Contractor must send a technical capability statement briefly explaining:

How they intend to complete this contract as far as time frame, personnel, and deliverables as well as explaining experience in survey work. Include relevant past performance information.

The Government will consider the relevance of past performance information obtained in relation to the scope of this procurement with respect to both similar efforts, and the length, scope, number, complexity, and diversity of contracts completed by the firm. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort will be given additional weight in the evaluation process.

Government evaluators may avail themselves of various federal, state, and local past performance databases. The Government may research offeror performance on any federal, state, local, and commercial contract performance of the offeror that is known to the Government, but not included on the submitted performance information.

Additionally, the personal experience and evaluator knowledge of offeror performance may be utilized.

Quotes will be evaluated in two steps:

• Step 1: Quotes will be reviewed initially under a Pass/Fail evaluation to determine if the Technical Capability meets requirements of the call order. Quotes must be signed. Those that do not meet the requirements will be marked unresponsive. Acceptable quotes will then be evaluated under Step 2.

• Step 2: Lowest Price with an acceptable quote will receive the award

March 2025 Class Deviation

This Call Order incorporates two FAR class deviations to ensure compliance with Executive Orders 14148, 14173, 14168, and 14208, issued since January 20, 2025. It also removes references to AGAR clauses and provisions that have been rescinded. These updates reflect recent policy changes and remove outdated requirements, as detailed below.

The following FAR provisions and clauses are hereby removed in their entirety from the LMIR BPA:

• 52.222-21 Prohibition of Segregated Facilities

• 52.222-26 Equal Opportunity

• 52.222-55 Minimum Wages for Contractor Workers Under Executive Order 14026/1

Disclaimer: System updates may lag policy updates. The System for Award Management (SAM) may

Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services.

Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S.

Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.

As prescribed in AGAR 433.104-4 (a)(5)(ii), the following Notice for Filing Agency Protests shall be included in every solicitation.

NOTICE FOR FILING AGENCY PROTESTS

United States Department of Agriculture (USDA) Ombudsman Program

The USDA is committed to issuing solicitations and awarding contracts in a fair and prompt manner. The Ombudsman Program for Agency Protests (OPAP) was established to address protest issues within the agency, providing an alternative to costly and time-consuming litigation. Operating independently, OPAP offers relief comparable to that granted by the Government Accountability Office (GAO). Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO. Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.

Informal Forum with the Ombudsman

1. Initial Point of Contact: Interested parties who believe a specific USDA procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer.

2. Escalation: If the Contracting Officer is unable to address their concerns, interested parties are encouraged to contact the USDA Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.

3. Required Information: To ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman

1. Effort to Resolve: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions.

2. Independent Review: If the protester’s concerns remain unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest with either the Contracting Officer or, alternatively, with the Ombudsman under the OPAP program. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined in writing to be in the best interest of the Government.

3. Resolution Timeline: The agency’s goal is to resolve protests within 35 calendar days from the date of filing.

4. Required Information: Protests shall include the information set forth in FAR 33.104(a)(3).

Failure to submit the required information may result in a delay or dismissal of the protest.

5. Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.

6. Submission: Formal protests under the OPAP program should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.

Election of Forum. By initiating a protest with the USDA, the protester agrees not to pursue the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If a protest is filed externally, the agency protest will be dismissed.

Airport Pasture Broadcast Herbicide

1.0 GENERAL

1.1 Introduction

This project includes approximately 1,358 acres of public lands within the Spokane District, Bureau of Land Management. The treatment area is located in the Airport pasture of the Fishtrap allotment, northeast of Sprague, WA. This area is highly susceptible to frequent wildfires due to its proximity to Interstate 90 and the high density of noxious weeds and invasive annual grasses. These treatments aim to mitigate wildland fire risk by reducing the horizontal and vertical continuity (Rate of Spread) and fuel loadings (ton/ac) of noxious weeds and invasive annual grasses and improve habitat for fire resilient native plant communities.

The treatment area consists of one unit to be treated with the herbicide imazapic (Plateau) for the control of invasive annual grasses. The treatment area is a relatively flat parcel with terrain variation ranging from 2,000’-2,100’. There are topographical and unique features on the east side of the unit that may inhibit the use of ground-based broadcast application methods.

1.2 Applicable Directives

Contractor must hold a current Washington Commercial Applicator License. All vegetation control measures shall comply with the provisions set forth in the Record of Decision for the Vegetation Treatments Using Herbicides on Bureau of Land Management Lands in 17 Western States Programmatic EIS (September 2007), as well as all federal, state, and local regulations and applicable land-use permitting procedure.

1.3 Location and Description

Vicinity maps showing the project area within which the treatment unit will be located are attached. Contractor will not treat areas outside of identified work areas.

2.0 CONTRACTOR FURNISHED PROPERTY AND SERVICES

2.1 The contractor shall furnish all labor, equipment, fuel, supervision, supplies

(except those designated as Government-furnished) and incidentals to perform all work as set forth in the specifications. The contractor will be responsible for the transportation and storage of the supplies and equipment used for the project.

2.2 The contractor shall be responsible for purchasing, safely transporting, storing and disposal of materials as follows:

Liquid Imazapic Formulation – Plateau or Panoramic 2SL: 8 oz/ acre

AND

Insist 90 at label-recommended rate

AND

Water sufficient to apply no less than 10 gallons/acre of tank mix

2.3 The contractor is responsible for ensuring that the application of the herbicide meets all label specifications. The contractor shall ensure that equipment is clean and free of chemical residue prior to treatment. The contractor shall be responsible for cleanup of accidental spills, following proper handling and storage precautions, and ensuring proper exposure control and personal protection is provide as defined by Imazapic Safety Data Sheets. The contractor will report all spills of hazardous materials to the Contracting Officer’s Representative (COR) or Project Inspector (PI) immediately.

2.4 The contractor shall comply with all Federal, State, and Local regulations.

3.0 GOVERNMENT FURNISHED PROPERTY

3.1 No government furnished property will be provided.

4.0 SPECIFIC TASKS

4.1 Contractor shall provide a completed Pesticide Application Record (PAR) for each treated site. A GIS shapefile showing treated areas is required.

4.2 Approved Herbicides:

The prescribed herbicides, which are approved for use on the Spokane District, Pesticide Use Proposal (ORW030-26-005) will have the following EPA registration numbers:

Plateau: 241-365 Panoramic 2SL: 66222-141-81927

4.2.1 The MAXIMUM rate of herbicide application is as follows as expressed in active ingredient per acre (a.i./acre).

4.3 Approved Adjuvants: All applications require the use of an approved deposition aid at label-recommended rate. A list of approved adjuvants is attached. If a deposition aid label does not specify a minimum recommended application rate, no less than 20% of the maximum rate will be applied.

4.4 Liquid herbicide will be applied utilizing water as a carrier, with no less than an average of 10 gallons/acre of tank mix applied.

4.5 All roads (public and private) damaged or opened by the Contractor shall be restored at no cost to the Government to their condition prior to commencement of work.

4.6 If sensitive, endangered, or threatened species (plant or animal) are discovered within the treatment area, the contractor is to immediately notify the COR. The Government may issue a suspend work and/or partially terminate any portion of the work due to discoveries of sensitive, threatened, endangered species or archeological sites during contract operations.

4.7 The Government may issue a suspend work order and/or partially terminate any portion of the work at any time when application conditions are considered sufficiently unfavorable to warrant stoppage. Stoppage shall continue until application operations are again authorized by the Government. No monetary compensation will be given to the contractor for work suspensions.

4.8 Whenever a specification; Agency, State or Federal law; or label direction has a contradiction, the most stringent interpretation shall take precedence.

4.9 Herbicide shall not be applied within 300 feet of any fish-bearing stream or within

150 feet of any other surface water (troughs, ponds, open water). Fish-bearing streams and permanent surface waters will be marked on the GIS layer or map and given to the Contractor prior to herbicide application. Contractor is expected to apply the herbicide consistent with the maps and shapefiles provided by the

4.10 Herbicide applications will only be made when both air and soil temperatures are above freezing and the treatment area is clear of snow, ice, and standing water.

4.11 Herbicide application will only be made when sustained windspeed is 10 mph or less with gusts of no more than 15 mph, in accordance with label requirements.

4.12 Precipitation in the form of rain, snow, or fog will halt herbicide application.

4.13 Contractor is responsible for identification and avoidance of any and all hazards.

SITE SPECIFICS

4.1 Location and Description of Project

The herbicide treatment areas are located in Lincoln County, approximately 0.5 miles northeast of Sprague, WA, south of I-90.

The areas to be treated for the contract will be irregular shapes of varying length/width that follow GIS coordinates. Shapefiles will be provided to the contractor.

4.2 Description of Work

The Contractor shall furnish equipment to apply liquid or dry granule herbicide to the designated areas in the time specified.

Navigation: Differentially Correctable Global Positioning System (DGPS) is required for tracking and data collection. The Contractor shall provide all guidance equipment, materials, computers, printers, personnel, and services required for the system to be used. The system shall be sufficiently sensitive to provide immediate deviation indications (real-time).

The DGPS system must be capable of determining a differentially corrected location with an error of no more than two meters in the horizontal plane. The guidance system shall be capable of updating current position at a rate of a minimum of one time per second. Differential correction must cover the complete operational area. During operation, differentially corrected signal must be accurately recorded at least 90% of the operational time. Differential correction may be provided by a portable differential station, FM radio fixed towers, or satellite.

Software provided with DGPS must be designed for parallel offset in increments equal to the assigned swath width of the application equipment.

4.3 Equipment Requirements

Project Log: Must be capable of a minimum rate of one-second logging intervals.

Full record includes position, time, speed, track, application system on/off, job name/number, and differential correction status. The computer program must be capable of calculating and show total acres treated during the application and also capable of downloading to a computer for analysis and review. The project log must show and differentiate between spray-on and spray-off when viewed on a computer monitor or printer. Export files of each project log shall be provided and must be compatible with ArcView or ARC-INFO GIS system on a standard USB memory stick. The Contractor may provide software that is compatible and which will enable the files to convert into viewable files for ArcView or ARC-INFO GIS. The contractor must, upon request by the COR or Project Inspector, be able to supply project log data on a USB memory drive for review at any time during the contract. The Contractor will provide project log data at the end of each day’s application in a format able to be viewed on ArcGIS or other appropriate format (shapefiles, .gpx, .kml, etc.). GIS data must be provided daily to the COR or designated representative. The Contract will not be considered complete until the data have been reviewed and deemed complete with no skips in the sprayed areas.

The DGPS system must be capable of zooming in on any portion of the treatment to view a specific area with greater detail.

Hardware

Visual Display Monitor and Control Keypad: (1) Capable of displaying swath width over project path; (2) mounted in a location that will allow the applicator to view the screen; (3) have a method to display nested polygons to indicate sensitive or no-spray areas within or adjacent to treatment blocks; (4) have a feature that allows the applicator to return to the exact location of application shutdown and complete application without omitted or doubled treated areas; (5) be able to input reference waypoints (A-B line); (6) have a feature which alerts applicator when they are about to enter or exit a specific treatment block or an exclusion area within a block.

DGPS navigation unit shall insure straight and regular paths of application.

Irregular paths of application will result in immediate stoppage of work.

Corrective action shall be taken immediately by the contractor to insure evenly spaced, straight and regular application paths and complete coverage of areas included in the spraying job. The entire surface within the designated boundaries of the project area shall receive uniform coverage with herbicide except for areas excluded by the Government. Areas excluded from the herbicide operation within the designated boundaries will not be included in the acreage computed for payment. Dispersal shall be low enough to obtain proper distribution and uniform coverage of herbicide. Herbicide application shall not be made during rainfall, snowfall, or when the ground is frozen.

The Contractor shall contact the authorized BLM COR/PI 72 hours prior to implementing any work specified in this contract. Furthermore, the COR/PI shall be present at the prescribed work sites to direct and inspect the Contractor. The Contractor shall submit completed Pesticide Application Records no later than 2 weeks after applying the herbicide specified in this contract.

5.0 FIELD QUALITY CONTROL

5.1 The BLM COR/PI will monitor to determine uniformity of herbicide application.

Randomly placed drift cards may be used for quality control testing. If coverage is deemed unsatisfactory (e.g. less than 90% of drift cards show herbicide coverage), the contractor will be required to treat those areas at no additional cost to the

6.0 EXPECTED DELIVERY OR PERFORMANCE TIMES

6.1 The period of performance is from September 1, 2026 and will be completed no later than October 30th, 2026. Government preference is starting and completing the project as quickly as possible, however due to weather conditions during this time, soil moisture, soil temperature, and snow cover, time frames may need to be re-negotiated.

6.2 There will be a Pre-Work conference prior to the start of the project at an agreed upon date between the COR/PI and the Contractor. At the pre-work conference the Contractor shall provide the COR a written “work progress” plan that details his/her proposed workforce and schedule to provide for orderly completion of the work within the contract performance times. This work schedule must be acceptable to the government. At a minimum, the schedule should reflect a work progress rate equal to the available amount of contract performance time. The unit sequence work schedule will be determined by the COR at the pre-work conference and may be subject to change because of normal variations in weather conditions at no change in contract time or price.

6.3 The Contractor shall begin work within 7 calendar days from the effective notice to proceed. The Contractor shall continue performance of the work under the contract without delay or interruption except by causes beyond his control as defined by contract clauses, or by the receipt of a “Suspend Work Order” issued by the Government. Failure to do so may be cause for action under the “Default” clause. The Contractor shall complete all work required within the time specified.

7.0 MEASUREMENT AND PAYMENT

7.1 Application of herbicide will be measured and paid for by the number of acres treated to the nearest acre.

7.2 Measurement for payment for herbicide treatment will be the actual area, in acres, within the designated boundaries satisfactorily treated in conformance with these specifications. Measurement will be made from either physical surveys of the areas or a computer generated file created in a GPS Differential Guidance System at the option of the BLM. The shapefile will be used in ArcGIS for final acreage measurement. Acreages will be computed from horizontal distances as shown on maps at the option of the BLM.

7.3 If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115% or below 85% of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for the completion the contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified. No payment will be made for acres treated in excess of the contract amount.

8.0 CONTRACTING OFFICER’S REPRESENTATIVE (COR) AND/OR

PROJECT INSPECTOR (PI)

The COR/PI will be responsible for giving the contractor any special instructions or guidance necessary to complete delivery as required by the contract. The COR or PI does not have the authority to modify or in any way amend the terms of this contract.

9.0 SAFETY

The contractor is responsible for providing a safety plan that identifies a point of contact in the event of any accident. The plan should include names and emergency phone numbers for personnel and facilities to contact, including Flight For Life/Life Flight/Care Flight, etc., in case an emergency warrants such actions.

The plan should also include a description of on-site emergency procedures to follow in case of an accident. The plan should identify the insurance company providing coverage and the pertinent group coverage number.

It is the responsibility of the Contractor to identify all hazards within the work area. All appropriate precautions shall be taken by the Contractor.

10.0 UNMANNED AIRCRAFT SYSTEM

Aviation Utilization: If UAS will be utilized (i.e., Unmanned Aircraft System) lease describe the equipment to be used, compliant with OPM-35 and DOI covered UAS assessment Guide Version 4.0 (see attached).
