12. PUBLIC RELEASE
Any information (classified or unclassified) pertaining to this contract shall not be released for public dissemination except as provided by the National Industrial Security Program Operating Manual (NISPOM) or unless it has been approved for public release by appropriate U.S. Government authority.

13. SECURITY GUIDANCE
The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract;
and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

10(a): Access to COMSEC information requires US Citizens with a final US Government clearance at the appropriate level. A written request by the Prime Contractor to the GCA Contracting Officer is required for the flow down of information to a subcontractor for COMSEC. Upon receiving a written request from a Prime contractor, the GCA Contracting Officer will provide written concurrence or non-concurrence for the request of flow down COMSEC to DOI Security Department.
A copy of the request from the Prime contractor and the written concurrence or non-concurrence from the GCA Contracting Officer sent to DOI Security Department who will then issue out the approval for flow down of COMSEC.
COMSEC material is not releasable to contractor employees who have not received a FINAL clearance at the appropriate security level.
COMSEC information/material shall be processed IAW DoD 5220.22-M, Chapter 9, section 4, and OPNAVINST 2221.5C, and any additional security guidelines. When access is required at Government facilities, contractor personnel will adhere to COMSEC rules and regulations as mandated by command policy and procedures. All contractors shall be briefed before access to COMSEC is granted.
10(g): Access up to NATO SECRET is authorized for this contract. Protection of NATO information shall be in accordance with USAAN

01-07 and its applicable enclosures. Access to NATO requires a final US Government National Security Clearance and must have a NATO security briefing from the FSO. A written request by the Prime Contractor to the GCA Contracting Officer is required for the flow down of information to a subcontractor for NATO. Upon receiving a written request from a Prime contractor, the GCA Contracting Officer will provide written concurrence or non-concurrence for the request of flow down NATO to the DOI Security Department.
10(j)/11(l): Controlled Unclassified Information including For Official Use Only and Covered Defense Information (meeting the definition of 48 CFR 252.204-7012(a)) generated and/or provided under this contract shall be marked and safeguarded as specified in DoD Instruction 5200.48 (Controlled Unclassified Information) (CUI) available at https://www.esd.whs.mil/directives/issuances. Any product containing Covered Defense Information shall be assigned the appropriate distribution statement using the criteria set forth in DoDI
5230.24 (Distribution Statements on Technical Documents); and have this statement displayed per DoDI 5230.24, Enclosures 3-4.
All For Official Use Only (FOUO), Covered Defense Information (CDI), and program Controlled Unclassified Information (CUI) data transmitted and safeguarded via electronic means shall use approved encryption. The contractor shall ensure that when transmitting FOUO/ CDI, over non-secure e-mail (e.g. not connected to the Navy Marine Corps Intranet through Broadband Unclassified Remote Access System / Virtual Private network), those transmissions are encrypted using Department of Defense Public Key Infrastructure (PKI), or an approved DoD External Certificate Authority, in accordance with Public Key Infrastructure & Public Key Enabling, DoDI 8520.02, 24 May 2011.
11(f): The contractor shall require access at any North Atlantic Treaty Organization (NATO) base Europe, Southeast Asia Treaty Organization (SEATO) base Asia, U.S. DoD base Okinawa, U.S. DoD base Japan, U.S. DoD base South Korea, Australian Naval Air Base Nowra, AU, Naval Station, Rota, Spain, Bucholz AAF, Kwajalein, in performance of this contract.
11(h): COMSEC account required for government furnished equipment. Contractor will contact NSA for account procedures.
- Classified or unclassified technical papers to be presented at a classified symposium must be approved by the NAVSEA HQ Contracting Officer's Representative (COR) prior to the presentation.
- Security classification guides (OPNAVINST 5513 series) and controlled unclassified information (CUI) (e.g., FOUO, distribution statement controlled) are not authorized for public release; therefore, they cannot be posted on a publicly accessible web-server or transmitted over the internet unless appropriately encrypted. Request for public release cannot be transmitted via the internet until the contractor receives final approval from NAVSEA (SEA 00D).
- Contractor must submit a request for sharing of classified and other sensitive information between prime contracts in writing to the NAVSEA Office of Security Programs (SEA 00P3) identified in Item 16 of this form.
- Personnel designated as derivative classifiers shall receive derivative classification training prior to access from the contractor's Facility Security Officer (FSO). The FSO shall ensure personnel receive initial and biennial training during the life of this contract. Evidence of completion, training certificates or equivalent, shall be provided to the Information Assurance Manager no later than the individual's due date.
- All classified documents must be destroyed using a National Security Agency (NSA) approved high security crosscut shredder listed on the NSA/CSS evaluated products list (EPL) for high security crosscut paper shredders, or other approved method for destroying classified information.
- All classified information involved in security incidents shall be retained and provided to the certifying official in Item 16 of this DD 254 for classification review.
- All security related issues, incidents, or requests pertaining to this contract shall be presented in writing by the contractor's Facility Security Officer (FSO) to the individual identified in block 16(a) of this DD254. The contractor shall abide by other reporting requirements outlined in the NISPOM.
- Forward a copy of subcontractor DD 254s issued under this contract to the official shown in item 16 of this DD 254.
