About this file
This document is a draft Instructions to Bidders for a United States Army Corps of Engineers (USACE) Sacramento District design-bid-build construction project involving erosion control and levee strengthening along the North and South banks of the Lower American River in Sacramento, California. The solicitation anticipates two separate contract awards, with bidders allowed to submit pricing for one or both sites, subject to potential "award restrictions" limiting the number of sites a single contractor can be awarded.
Key details include the solicitation number W9123826BA0003, with bidder inquiries to be submitted through ProjNet (https://www.projnet.org/projnet) using the Bidder Inquiry Key 8HY9UY-M4SDIP. The government will evaluate bids based on overall lowest price across both sites, with a responsibility determination conducted in accordance with FAR Part 9. Primary contacts are Henry Barron (Contract Specialist) and Rachel Kinney (Contracting Officer), both reachable via email. The solicitation is currently in a draft stage, with a court injunction regarding tree removal and elderberry replanting causing delays in the final solicitation release.

Section 00 21 13 - Instructions to Bidders
INSTRUCTIONS TO BIDDERS
BASIS FOR AWARD:
1. This solicitation is for work at two separate sites (North and South) with the expectation of two (2) awards. The Government intends to award a contract(s) to the bidder(s), providing the overall lowest price to the Government.
2. Contractors may submit a bid with pricing for one or more of the sites included in this solicitation. To be considered for award for any given site, a bidder must submit pricing on all line items for that site. Each bidder that includes pricing on more than one site in its bid, may also include an “award restriction” with its bid, limiting the number of sites for which it can be considered for a contract award. An award restriction is a whole number identifying the maximum number of sites for which that bidder may receive an award.
3. An award restriction may not include a prioritization or preference for a particular site or combination of sites on which a Contractor submits a bid. If a Contractor does not submit an award restriction with its bid, the Government may make an award to that Contractor for any site or combination of sites included in its bid. An offer containing an invalid award restriction is nonresponsive and no portion of the offer will be considered for award. Award restrictions may not be added or removed after bid opening.
4. A responsibility determination will be conducted in accordance with FAR Part 9. A bidder must be found responsible for the number of sites for which it is in line for award. If a bidder is found to be non-responsible for a proposed award, the bid submitted by that bidder will be eliminated from consideration and the remaining bids reevaluated.
5. As part of the responsibility determination if a Contractor is the apparent low bidder on both sites, the Contracting Officer may request additional documentation for responsibility determination to ensure both sites can be constructed concurrently.
6. Award restriction example.
(a) This example is solely for the purpose of illustrating the operation of an award restriction. Assume that Bidder C submits a responsive bid with pricing for both sites but includes an award restriction of “1” with its bid. Even if Bidder C is the low bidder on both sites, it is only eligible to receive awards for one of those sites because of the award restriction submitted with its bid. The Government will select which site will be included in the contract award to that bidder by reviewing the other bids submitted and determining which combination of bids provides the overall lowest price (for both sites in combination) to the Government.
