I. DESCRIPTION

THIS IS A NOTICE OF INTENT FOR REQUEST FOR QUOTE. This is a combined synopsis/solicitation for commercial supplies prepared in accordance with FAR Part 12. This announcement constitutes the only solicitation. Quotes are being requested and a separatewritten solicitation will not be issued.

Solicitation number 140L0626Q0022 is issued as a request for quote (RFQ) for Mine Data Cost, Reclamation Bonds Estimation, and Training. The NAICS code is 513120 with a size standard of 1000 employees.

This acquisition is not set aside for small business concerns. This solicitation incorporates provisions and clauses by reference. The full text of provisions and clauses may be accessed electronically at www.acquisition.gov.

GENERAL INFORMATION:

This solicitation is a Request for Quote (RFQ). Award of this contract will be made according to FAR Part

12 Acquisition of Commercial Products and Commercial Services. All references to “proposal” in this solicitation shall be understood to mean “quotation.” Quotations shall be evaluated in an impartial manner and consideration given to those with the highest perceived value to the government.

Contract Type:

The contract awarded because of this solicitation will be a firm-fixed price commercial contract.

VIII. PROVISIONS AND CLAUSES INCORPORATED BY FULL TEXT

52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016) (DEVIATION May 2026)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations

Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

52.212-2 Evaluation — Commercial Products and Commercial Services (Nov 2021) (DEVIATION Mar 2026)

(a) Evaluation factors: The Government will award a contract resulting from this solicitation to the responsible

Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(i) Technical

The following criteria will be used to evaluate each vendor's quote, determining their ability to meet the requirements outlined within the SOW. Each vendor’s technical quote will be evaluated to determine if the vendor provides a sound, compliant approach that meets the requirements in this request for quote and demonstrates a thorough knowledge and understanding of the requirements. Provide a capabilities statement or project narrative that demonstrates how the company will successfully meet the needs of the statement of work.

Area 1 –Evidence of the ability to provide Mine and Mill Cost Data.

Area 2 -Evidence of the ability to provide Reclamation Bond Cost Programs.

Area 3- Provide curriculum of Online Technical Training and demonstrate ability to offer logins and training as required by the SOW within 30 days to include a project plan and milestones.

(ii) Price

Price must be determined complete and reasonable, and will be evaluated as follows:

rice will be evaluated to determine if it is complete and reasonable. For price to be reasonable, it must also represent a price to the Government that a prudent person would pay in the conduct of competitive business for the level of effort required.

The Bureau of Land Management (BLM) is requesting FFP quotes for the supplies required in the SOW. FFP quotes shall cover all, deliverables and acceptable levels of quality required in the attached SOW.

The contractor(s) shall furnish all personnel, facilities, equipment, materials, supplies and services, and otherwise do all things necessary for, or incidentally to, the satisfactory performance of this order at a firm-fixed price.

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer, whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

AWARD SELECTION PROCESS

Award will be made in accordance with FAR Part 12 to the Offeror that provides the best value to the government based on price, technical, and prior experience or past performance. Per FAR 12.203(c)(2) evaluation will be conducted by comparative evaluation of offerors. This solicitation is not stating nor required to state the importance assigned to each evaluation factor and/or sub factor (FAR 12.203(c)(2)).

1. Price: A price evaluation will be performed to determine the reasonableness of the proposed price.

Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced.

Offerors are cautioned to distribute costs appropriately.

2. Technical: Written confirmation that company specializes in, or has sufficient documented direct experience in, providing all requirements of the supplies outlined, and in accordance with, the attached Statement of Work (SOW).

3. Prior Experience: Complete Prior Experience Questionnaire(s) as described in “TO SUBMIT

AN OFFER” section, that can confirm your company has successfully completed similar tasks outlined in the Statement of Work.

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the

Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.

52.217-6 Option for Increased Quantity (Mar 1989)

The Government may increase the quantity of supplies called for in the Schedule at the unit price specified.

The Contracting Officer may exercise the option by written notice to the Contractor within seven days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties agree.

52.217-7 Option for Increased Quantity-Separately Priced Line Item (Mar 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within seven days. Delivery of added items shall continue at the same rate that items like are called for under the contract, unless the parties otherwise agree.
