About this file

This file is a federal contracting clause requirement document that prescribes Indian Economic Enterprise representation language for inclusion in written solicitations.

The provision requires offerors to represent whether they meet the definition of an Indian Economic Enterprise (IEE) as defined in DIAR 1480.201 and whether they intend to maintain that status throughout contract performance. Offerors must notify the contracting officer immediately in writing of any ownership changes that would affect compliance with this representation. The clause also establishes that false or misleading information submitted by an enterprise in an offer constitutes a violation of the Buy Indian Act (25 U.S.C. 1001) and is punishable under 18 U.S.C. 1001. False claims submitted during contract performance are subject to penalties under 31 U.S.C. 3729 to 3731 and 18 U.S.C. 287. This is a template provision to be incorporated into all written solicitations for supplies, services, architect-engineer services, and construction as prescribed in 1480.503(e)(4).
