Section L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
1. Introduction. The offeror’s proposal shall be submitted in hard copy, with accompanying digital copies, as set forth below. The RFP shall provide the Government address and receipt date for proposal submittal.
Offerors shall provide information by addressing each Factor/Subfactor in the format and sequence identified in the solicitation. The Offerors must provide information in sufficient detail to allow the Government to make a best value assessment of the Offeror’s capability to support the proposed response to the evaluation criteria.
Proposals that do not contain the information requested in the solicitation risk being determined unacceptable by the Government. The Government will not assume the Offeror possesses any capability, understanding, or commitment not specified in the proposal.
The proposal must not merely repeat the solicitation requirements, but rather must provide convincing documentary evidence in support of conclusive statements of how contract requirements will be met.
Proposals that do not contain the information requested in the solicitation risk being determined Unacceptable by the Government. The Government will not assume the Offeror possesses any capability, understanding, or commitment not specified in the proposal.
Alternate Proposals: Alternate proposals will not be accepted.
Proposals shall be valid through TBD.
All questions concerning this procurement, either technical or contractual must be submitted in writing to the Contracting Officer. No direct discussion between the technical representative and a prospective Offeror shall be conducted. Questions and proposals shall be submitted to the following point of contact:

2. PROPOSAL SUBMISSION REQUIREMENTS
a. Each volume shall be submitted in a separate three-ring binder. Any pages that are changed (as a result of negotiations or proposal revisions) should be of a different color and have changed information clearly marked by a vertical line in the right margin of the page. The revised pages shall be dated. Each binder shall be clearly labeled with its Title and a copy number (e.g., copy 1 of 5).
b. Printing should be single spaced. Each paragraph shall be separated by at least one blank line. A standard, 12-point minimum font size applies. Arial or New Times Roman fonts are required. Tables and illustrations may use a reduced font size no less than 8-point and may be landscape.
c. The following volumes of material shall be submitted:

NOTE: Pages that exceed the required page limitations will not be evaluated.
Additional pages over the maximum allowed will be removed or not read and will not be evaluated by the Government.

3. PROPOSAL FILES
a. Format. The submission shall be clearly indexed and logically assembled.
Each volume shall be clearly identified and shall begin at the top of a page. All pages of each volume shall be appropriately numbered and identified by the complete company name, date and RFP number in the header and/or footer. A Table of Contents should be created using the Table of Content feature in MS Word. MS Word (doc) files shall use the following page setup parameters:
Margins – Top, Bottom, Left, Right – 1” Gutter – 0” From Edge – Header, Footer 0.5” Page Size, Width – 8.5” Page Size, Height – 11”
NOTE: 11X17 folded pages are acceptable for tables/graphic representations;
however, each 11X17 page counts as two pages.
The following additional restrictions apply:
b. File Packaging. All of the proposal files shall be compressed (zipped) into one file entitled proposal zip using WinZip version 6.2 or later, or as separate uploads in their native format, i.e. doc, xls, ppt, etc., and provided on CDs or DVDs. Zip disks are not permitted. Files shall be in read-only format, using PDF files. All price breakdown information to aide in the cost/price evaluation shall be submitted in Microsoft Office Excel Read/Write format and viewable in Microsoft Excel 2007. Each disc shall be externally labeled with the volume number, date, and the offeror’s name. **Please note
– Self extracting exe files are not acceptable. ** If the hard-copy proposal differs from the electronic version, the hard copy will govern.
Content Requirement. All information shall be confined to the appropriate file. The offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal. Each file of the proposal shall consist of a Table of Contents, Summary Section, and the Narrative discussion. The Summary Section shall contain a brief abstract of the file. Proprietary information shall be clearly marked. Offerors are responsible for including sufficient details (i.e. drawings, test data) to permit a complete and accurate evaluation strictly from a technical standpoint. The Technical Volume(s) shall have a separate index, which contains narrative titles that are cross-referenced to both the applicable Statement of Work (SOW) paragraph and page number. This index shall not count against the Page limitation for the Technical Volume. The narrative discussions shall also be related to the applicable SOW paragraph by placing the appropriate SOW number at the beginning of the discussion text. The proposal shall be detailed and clearly stated to allow an assessment by the Government without the need for additional clarifications. The Offeror shall provide detailed narrative discussions that address both the SOW and the Contract Data Requirements List (CDRL’s) of the solicitation. All information and data provided shall be specific to SAWS , except for the area of Past Performance.
In the response to the Request for Proposal, the Offeror must address the following Factors and Subfactors:
(i) VOLUME I – Volume I – FACTOR 1: MANAGEMENT
The Management volume consists of the following three sub-factors: (A) Program Management Plan, (B) Supply Chain Management Plan, and (C) Delivery Order 0001.
The Offeror shall include sufficient information to complete an accurate evaluation from a technical standpoint. The Offeror shall provide a detailed narrative that addresses each task as described below:
Subfactor 1: Program Management Plan
The Offeror shall submit the following for the entire program as follows:
a) A Management Plan that identifies and addresses the Offeror’s process for addressing issues with non-conformances to general specifications, performance and inspection or test failures.
b) A description of the Offeror’s organizational structure clearly defining/displaying the roles and responsibilities of the key personnel and how the proposed team will be able to manage and execute complex supply and transportation plans; to include the level of direct access of the Offeror’s Program Manager to its higher-level management (i.e., senior staff, corporate senior officials) and/or the authority of the Program Manager to accomplish delegated tasks.
c) A Quality Management System Plan that is certified to, compliant with or exceed ISO 9001:2008 standards and which addresses initiatives to identify, minimize and control internal and supplier processes.
d) Evidence that substantiates the Offeror’s experience and ability to effectively manage schedule and performance of the Offeror’s subcontractors.
e) A Risk Management Plan which adequately identifies potential programmatic risks, probabilities, associated consequences, mitigation strategies, and addresses how the Offeror will continuously update and review its risk management/mitigation process throughout the life of the contract.
Subfactor 2: Supply Chain Management Plan
The Offeror shall submit the following for the entire program as follows:
The Offeror shall provide a detailed Supply Chain Management plan for each of the items on the Section B Attachment for SAWS in Appendix I. The detailed Supply Chain Management Plan proposal will consist of two parts: (1) Supply Plan and (2) Transportation Plan.
(1) The Supply Plan shall list the following at a minimum
• Item
• Quantity
• Supplier(s)
• Source location(s)
• Manufacturer(s) and location(s) of manufacture (if different than supplier/source location(s))
• Source of supply - new production and/or surplus with ammunition’s range of years manufactured and service life
If multiple suppliers, the quantity should be reflected for each supplier.
The Offeror shall identify any required End Use Certificate (EUC) and supporting documents for each supplier/foreign country. Supporting evidence shall include letters of commitment from each supplier/source and for any additional parties identified within the supply chain.
Letters of commitment from supplier/source shall include at a minimum:
• Name and address of the company providing the commitment
• Item of commitment
• Length of commitment for a minimum of 120 days from date the solicitation closes.
• Signature of individual from supplier/source that is authorized to bind the company and provides a firm commitment
(2) The information provided for the Transportation Plan portion of the Supply Chain Management sub-factor is required for items identified below:
a) The proposal shall include a detailed Transportation Plan for all items listed below for delivery to Miesau, Germany AND Crane, Indiana

The Miesau, Germany AND Crane, Indiana Transportation Plan should include at a minimum the following:
• Mode(s) of transportation from origin to final delivery point (to include inland transportation)
• Identification of port(s) to be utilized
• Identification of freight forwarder companies
• Rough Order Magnitude (ROM) price for transportation costs
b) Each Transportation Plan shall also include milestones of each shipment, to include the milestones to obtain any local, state, or federal permits, approvals, and/or clearances required to handle the movement of the ammunition into customer country.
The terms of local and state permits, approvals, and clearances includes all foreign states and localities necessary for the movement.
Subfactor 3: Delivery Order 0001
The Offeror shall submit the following for the entire program from delivery order award, to delivery location and delivery order close out.

a) Integrated Master Schedule (IMS) which identifies all program tasks required for successful execution of Delivery Order 0001 to include the tasks and milestones identified in the Government SOW and general specifications, including deliverables and data items. The IMS shall be provided in a Gantt chart (or similar presentation format) with milestones, events, and program tasks from first delivery order through delivery, highlighting the critical path. The proposal shall include a description of each of the tasks included in the IMS.
b) Transportation Plan for all items listed above for Delivery Order 0001 and should include at a minimum the following:
i. Mode(s) of transportation from origin to final delivery point (to include inland transportation)
ii. Identification of port(s) to be utilized
iii. Identification of freight forwarder companies
iv. Rough Order Magnitude (ROM) price for transportation costs
v. Letter(s) of commitment from freight forwarder companies, to include the following:
vi. Name and address of the company providing the commitment
vii. Length of commitment for a minimum of 120 days from the date the solicitation closes.
viii. Signature of individual from supplier/source that is authorized to bind the company and provides a firm commitment
• Supporting documentation such as invoices, purchase orders, rate agreements, and etc. to support the transportation cost.
If a firm commitment cannot be made for any of the items listed above, it shall be clearly stated.
The Transportation Plan shall also include milestones of each shipment, to include the milestones to obtain any local, state, or federal permits, approvals, and/or clearances required to handle the movement of the ammunition into customer country. The terms of local and state permits, approvals, and clearances includes all foreign states and localities necessary for the movement.
c) A detailed Supply Plan that demonstrates compliance with the required quantities and delivery schedules.
• The Supply Plan shall list the following at a minimum:
• Item
• Quantity
• Supplier(s)
• Source location(s)
• Manufacturer(s) and location(s) of manufacture (if different than supplier/source location(s))
• Date of delivery
• Source of supply - new production and/or surplus with ammunition’s range of years manufactured and service life
If multiple suppliers, the quantity should be reflected for each supplier.
The Supply Plan shall also include a detailed plan that addresses the production or supplier capacity for compliance with required quantities and delivery schedules of Delivery Order 0001. The Offeror shall identify any required End Use Certificate (EUC) and supporting documents for each supplier/foreign country. Supporting evidence shall include letters of commitment from each supplier/source and for any additional parties identified within the supply chain
(ii) VOLUME II – Technical.
FACTOR 2: TECHNICAL
The Technical volume consists of the following two sub-factors: (A) Technical Description and (B) Configuration Management. The Offeror shall include sufficient information to complete an accurate evaluation from a technical standpoint. The Offeror shall provide a detailed narrative that addresses each task as described below:
Subfactor 1: Technical Description:
1. The Offeror shall submit four complete documented examples of technical data as defined in the applicable Specification (listed in 2 below) for:
a) CLIN 0259: 120mm Mortar Weapon System
b) CLIN 0216: 81mm Mortar Illum (Complete)
c) CLIN 0119: 122mm M-21 OF Rocket (GRAD)
d) CLIN 0299: 40mm HEAT (90mm Warhead Dia.)
2. The Offeror shall submit a narrative description with process flow chart(s) that demonstrates its means to ensure compliance to meet the technical, testing and inspection requirements and verification procedure requirements as defined in the NSA/NSMWS General Specifications listed below:
a. General Specification for Non-Standard Ammunition, dated 01 Jan 2019
b. General Specification for Non-Standard Small Caliber Ammunition, dated 01
Jan 2019
c. General Specification for Non-Standard Mortar Ammunition, dated 01 Jan
d. General Specification for Non-Standard Rocket Propelled & Spin Stabilized
Grenade Ammunition, dated 01 Jan 2019
e. General Specification for Non-Standard Mortar Systems, dated 01 Jan 2019
Subfactor 2: Configuration Management:
The Offeror shall submit a narrative description and/or flow diagram of their Configuration Management Process for all the SAWS related items, to be provided according to General and Family Specifications and other contract requirements. The description must identify, but is not limited to the following:
a) Description or chart of the configuration management organizational structure along with the roles, responsibilities and capabilities of the key technical personnel within this organizational structure to manage and execute changes to subcontractor’s technical data packages.
b) Description of the procedures, processes, methods for process control and the Offeror’s resources for implementing configuration control both internally and externally including flow down to sub-contractors and suppliers technical data packages.
c) Description of methods demonstrating a configuration management process that includes assessment, verification, and validation of proposed changes through robust analysis, and application of sound scientific and engineering principles.
These methods shall also demonstrate the recording, cataloguing and control of documentation within the Offeror’s proposed configuration management process.
(iii) VOLUME III – Cost/Price.
a) The Offeror must complete, in its entirety, the Price Matrix workbook included as Attachment 0007 of the solicitation.
b) The Offeror shall input all blue highlighted cells within the tab labeled
“SAWS INPUT.”
c) The Offeror shall input its Contractor Name, Proposal Reference Number, and Date of Proposal.
d) The Offeror shall enter firm-fixed priced ceiling unit prices within all highlighted blue cells for each CLIN item and its corresponding quantity ranges for all ordering periods within the price matrix SAWS INPUT tab.
The ceiling prices will establish firm-fixed-priced not-to-exceed unit prices for the SAWS items for each delivery order.
e) No other inputs are required for the Price Matrix workbook.
(iv) VOLUME III – Past Performance. This volume shall contain past performance information regarding similar contracts. This volume shall not exceed 25 pages plus five pages for each major subcontractor, excluding Past Performance Questionnaire Forms. Offerors shall submit all Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past three years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation. Relevant efforts are defined as services/efforts that are the same as or similar to the effort (as compared to NAICS code 332993 (or 332994 as described above) required by the RFP. Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, in alphabetical order.
The Offeror shall also submit the written consent of its major subcontractors to allow the disclosure of its subcontractor’s past performance information to the Offeror. In addition, letters of commitment shall be included for all major subcontractors for their past performance to be considered. This volume shall be organized into the following sections:
(1) Section 1 – Contract Descriptions. This section shall include the following information in the following format.
(a) Contractor/Subcontractor place of performance, CAGE Code and DUNS Number. If the work was performed as a subcontractor, also provide the name of the prime contractor and Point of Contact (POC) within the prime contractor organization (name, and current address, e-mail address, and telephone and fax numbers).
(b) Government contracting activity, and current address, Procuring Contracting Officer’s name, e-mail address, telephone and fax numbers.
(c) Government’s technical representative/COR and current email address, telephone and fax numbers.
(d) Government contract administration activity and the Administrative Contracting Officer’s name, and current e-mail address, telephone and fax number.
(e) Government contract administration activity’s Pre-Award Monitor’s name, and current e-mail address, telephone and fax numbers.
(f) Contract Number and, in the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Delivery Order Numbers.
(g) Contract Type (specific type such as Fixed-Price (FP), Cost Reimbursement (CR), Time & Material (T&M), etc.). In the case of Indefinite Delivery contracts, indicate specific type (Requirements, Definite Quantity, and Indefinite Quantity) and secondary contract type (FP, CR, T&M, etc.).
(h) Awarded price/cost.
(i) Final or projected final price/cost.
(j) Original delivery schedule, including dates of start and completion or work.
(k) Final or projected final, delivery schedule, including dates of start and completion of work.
(2) Section 2 – Performance. Offerors shall provide a specific narrative explanation of each contract listed in Section 1, Contract Description, describing the objectives achieved and detailing how the effort is relevant to the requirement of this RFP.
(a) For any contracts that did not/do not meet original schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcomings and any corrective action(s) taken to avoid recurrence. The offerors shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. All Requests for Deviation and Requests for Waiver shall be addressed with respect to causes and corrective actions. The offerors shall also provide copy of any Cure Notices or Show Cause Letters received on each contract listed and a description of any corrective action implemented by the offeror or proposed subcontractor. The offerors shall indicate if any of the contracts listed were terminated and the type and reasons for the termination.
(b) For all contracts, the offeror shall provide data on all manufacturing warranty returns. Data shall delineate total number of warranty returns, number of Could Not Duplicate (CND), number of failures attributable to GFE component failures, and number and nature of failures attributable to the offeror’s delivered product.
(3) Section 3 – Subcontracts. Offerors shall provide an outline of how the effort required by the RFP will be assigned for performance within the offeror’s corporate entity and among the proposed subcontractors. The information provided for the prime offeror and each proposed major subcontractor must include the entire company name, company address, CAGE Code, DUNS Number and type of work to be performed by citing the applicable Government PWS subparagraph number. This includes all subcontractors who will be providing critical hardware/services or whose subcontract is for more than 10% of the total proposed cost/price. This section will further include written consent of major subcontractors to allow the disclosure of their subcontractor’s past performance information to the Offeror. In addition, letters of commitment shall be included for all major subcontractors
(4) Section 4 – New Corporate Entities. New corporate entities may submit data on prior contracts involving its officers and employees. However, in addition to the other requirements in this section, the offeror shall discuss in detail the role performed by such persons in the prior contracts cited. Information should be included in the files described in the sections above. Letters of Commitment shall be included in the proposal for these employees in order to be considered.
(5) Past Performance Questionnaire. For all contracts identified in Section 1, Contract Descriptions, a Past Performance Questionnaire must be completed and submitted.
The offeror shall complete Part I of the Past Performance Questionnaire and e-mail the questionnaire to both the Government contracting activity and technical representative responsible for the past/current contract. The POCs shall be instructed to electronically complete Part II of the questionnaire and e-mail the entire questionnaire to the Contracting Office no later than the proposal due date, to Christina Reyes (christina.s.reyes.civ@mail.mil) and Logan Frye (logan.e.frye.civ@mail.mil). The offeror shall e-mail to the Contracting Officer a list of all the POC’s who were sent a questionnaire. The Government must receive this list no later than the proposal due date. The POC List shall be submitted in Word for Windows Table Format to include the following fields: Solicitation Number; Company Name; Contract Number;
Government Agency; POC Last Name, First Name; POC Title; POC Telephone Number; POC E-mail Address; and Date E-Mail to POC (month/day).
(6) Submissions. Offerors are discouraged from providing points of contact with another contractors’ facility, i.e., in case an offeror (or one of his/her team members) is in a subcontract with another contractor who has submitted a proposal on the same requirement. Offerors shall provide and submit the prime contract number and all Governmental agency points of contact (POC) in lieu of subcontract numbers or prime contract POCs in situations as described above.
(v) VOLUME IV – Small Business Participation – See Appendix F, Enclosure 4
1. The Offeror shall demonstrate small business participation by detailing its proposed approach to meet the requirements under this factor by addressing the following two areas in its Small Business Participation proposal:
(a) Proposed Small Business Participation Plan in performance of the potential contract (applies to both Other Than Small Businesses and Small Businesses)
(b) Commitment to Small Business
i) Payment Procedures (applies to both Other Than Small Businesses and Small Businesses)
ii) Compliance with Small Business Subcontracting Plans (applies to Other Than Small Businesses only)
2. Proposed Small Business Participation Plan
The Offeror shall complete the Small Business Participation Plan (Appendix F, Enclosure 4) to show maximum practicable opportunities to small businesses to compete on this requirement in accordance with FAR 52.219-8, Utilization of Small Business Concerns.
3. Commitment to Small Business
The Offeror shall include a written statement of its established procedures to ensure timely payments to small business subcontractors in accordance with FAR 52.219-8, Utilization of Small Business Concerns (for those contracts under which it was required within the past three years from the closing date of this solicitation). If not required in any recent contracts, the Offeror shall so state.
Note: for Other than Small Businesses ONLY. Compliance with terms and conditions of FAR 52.219-9, Small Business Subcontracting Plan (if required on recent contracts). The Other than Small Business Offeror shall provide three Individual Subcontracting Reports (ISRs) for recent contracts (performed within the past three years from the closing date of this solicitation) that included a subcontracting plan.
Offerors using Commercial Subcontracting Plans shall provide three Summary Subcontract Reports (SSRs) and the associated Commercial Subcontracting Plan for each SSR. Caution: SSRs based on Individual Subcontracting Plans will not be accepted. If Small Business Subcontracting Plans were not required in any recent contracts, the Offeror shall so state. If the Offeror has less than three recent contracts, the Offeror shall provide the most recent ISR (or SSR for Commercial Subcontracting Plans) for each contract it has, and state that the Offeror does not have three recent contracts.
(vi) VOLUME V – SOLICITATIONS, OFFER AND AWARD DOCUMENTS AND
CERTIFICATIONS/REPRESENTATIONS
Certifications and Representations – Each offeror shall complete (fill-in and signatures) the solicitation sections indicated below using the file (without modification to the file) provided with the RFP. An authorized official of the firm shall sign the SF 33 and all certifications requiring original signature. An Acrobat PDF file shall be created to capture the signatures for submission.

Solicitations, Offer and Award Documents and Certifications/Representations shall not be addressed separately from that submitted in VOLUME V – SOLICITATIONS, OFFER
AND AWARD DOCUMENTS AND CERTIFICATIONS /REPRESENTATIONS
E. DISCUSSIONS.
1. GENERAL INFORMATION. In accordance with FAR 15.306(d), discussion sessions with each offeror may be held. Should discussions take place, all offerors in the competitive range will be allowed a minimum of 14 calendar days to submit Final Proposal Revisions.
2. DISCUSSION SCHEDULING. If discussions are conducted, the Contracting Officer will schedule the discussion sessions, and each offeror will be notified of the time and place at least three (3) business days prior to their discussion session.
Appropriate security clearances should be provided by the offerors in sufficient time to process the requests. The Contracting Officer will provide additional instructions with the notification.
