About this file
This document is a federal contracting template and regulation reference guide regarding the prohibition on procuring covered telecommunications equipment or services.
The document establishes representation and certification requirements that offerors must complete to demonstrate compliance with Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019. Offerors must provide negative representations confirming they will not provide, and do not use, covered telecommunications equipment or services as substantial or essential components of systems or as critical technology. Covered equipment includes telecommunications equipment produced by Huawei Technologies Company, ZTE Corporation, and video surveillance/telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company, along with any subsidiaries or affiliates of these entities. The representation applies to all contract actions, including SF44 purchases, with no exemptions permitted. Offerors responding affirmatively or declining to complete the representation will not receive contract awards; such cases must be forwarded to the supporting contracting office for determination of Section 889 compliance. The document incorporates FAR Clauses 52.204-24, 52.204-25, and 52.204-26, which establish definitions, prohibitions, exceptions for certain third-party services and equipment that cannot route user data, and reporting requirements for contractors who identify covered equipment during performance. All representations and supporting documentation must be retained for a minimum of six years and uploaded to the 413th CSB Intelink or appropriate procurement control file.
