A. Clean and well maintained areas for the enjoyment of our visitors is a central goal of the National Park Service. In response to substandard performance, invoking the deduction provision for work omitted, or improperly done, is designed to protect NPS interest, it is not a desirable substitute for accomplishing the job through the normal process. It is designed only to assure that the Park Service pays only for services provided and is fairly compensated for damages which result from lack of performance, or inadequate performance. It should be noted that time is of the essence in the performance of this contract. The attached QASP QUALITY ASSURANCE SURVEILLANCE PLAN provides more detail in qualifying performance.
B. Failure to perform the required services, as indicated in the specifications, herein, constitutes a deficiency. All work will be regularly inspected by the COR and any deficiencies will be reported, in writing, to the Contractor. The COR will make the sole determination as to the existence of a deficiency in performance. Corrective action, by the Contractor, shall be taken promptly and the work satisfactorily accomplished. Deficiencies shall be addressed in the day they are noted, when practical. Under all other circumstances, deficiencies shall be corrected within 24 hours of notification. If the deficiencies are of a nature which preclude a satisfactory correction within the specified time frame, no further opportunity will be provided to the contractor to cure the deficiencies and the provision for monetary adjustment will apply.
C. In the event The Contractor fails to correct a deficiency within the specified time frame, The National Park Service has the right to obtain performance of the deficient task from some other source or the in-house work force. The cost of such performance, and any other additional cost incurred to The Park Service as a result of such actions, shall be charged to the Contractor. In the alternative, at the discretion of the COR, the contract may be terminated upon ten(10) days notice in writing to the Contractor, if the deficiency is determined to warrant such action.
PART 8: ACCEPTANCE, MEASUREMENT AND PAYMENT
A. The Contractor shall include with all invoices for payment, an acceptance report signed by the COR. Failure to obtain a signed acceptance report will release the Government from any obligation to pay for services claimed, but not documented by a signed acceptance report. The Contractor shall include copies of his work log (see 3A above), signed by the COR, for that month, with said invoice. Failure to include signed copies of said work log, which constitute an acceptance report, will release the Government from any obligation to pay for services claimed, but not documented by a signed acceptance report. A copy of the invoice shall also be given or sent to the COR.
B. Invoices accompanied by acceptance reports that have been signed by the COR shall be submitted by the Contractor through the Internet Payment Platform (IPP) System at HTTP://WWW/IPP.GOV.
C. The amount to be paid will be based on the actual items completed and accepted. Quantities so measured will be paid for at the specified price. Invoices must reflect the same unit description, and unit price as the original Quote proposal.
