Work shall be performed in accordance w ith the plans and specifications. This project is being solicited as a 100% Small Business Set-Aside.

The North American Industry Classif ication System (NAICS) Code is 236220, and the Small Business Size Standard is $39.5M in average receipts for the past three (3) years. Construction project magnitude is betw een $5M and $10M. Firms w ho intend to submit a bid are strongly encouraged to attend the Pre-Bid Conference/Site Visit. See Section 00100 for location, date and time. All documents and the plans and specif ications for this solicitation w ill be available only from Contract Opportunities located at https://sam.gov. SECTION 00010 - NOTES

1. All information relating to this Invitation For Bid, including pertinent changes/amendments will be posted at System for Award Management (SAM) http://sam.gov. For security reasons, all potential offerors, plan rooms and printing companies are required to have a Unique Entity ID and be registered in the SAM database. Entities can register or renew at http://sam.gov. The required representations and certifications are also submitted at http://sam.gov.

2. Emailed bids are preferred. Hand carried or mailed bids are allowed. Facsimile transmission of bid is not authorized.

3. Offeror’s attention is directed to the bid bond and insurance requirement contained in this solicitation:

a. FAR 52.228-1 Bid Guarantee (SEP 1996). Bid bond shall be furnished by time set for opening bids.

b. FAR 52.228-5 – Insurance-Work on a Government Installation (Jan 1997)). Certification of the required coverage for the prime contractor shall be furnished prior to beginning work on this contract. The Contracting Officer may also request evidence of the required insurance at any time during the life of the contract.

4. The prices shown in the Bidding Schedule must reflect ALL costs involved in performing the work as described in the plans and specifications.

5. The term “Bidding Schedule” shall also be construed to mean “Offer Schedule” or “Schedule”. The terms “bid”, “offer”, “bidder”, and “offeror” shall be construed as having the same meaning in this solicitation and resulting contract.

6. A complete bid package must contain the following:

a. Offer, Standard Form (SF) 1442 front and back signed.

b. Section 00010 Line Items- All items (‘Base Bid’ and ‘Options’) must be priced (even if $0.00).

Line 0001 is the BASE BID and line items 1001, 1002, 1003, 1004, 1005, 1006, 1007, and 1008 are OPTIONS.

c. Section 00600, Representations and Certifications, completed and return only additional certifications found in this section. In addition, the offeror must have entered current and complete data within the past year in Online Representations and Certifications at https://sam.gov.

d. When completing the “Offeror” portion of the SF 1442 (Blocks 14 – 20), an official having the authority to contractually bind the company must sign the SF 1442 in accordance with FAR 4.102.

One copy of the SF1442 is required to have an original ink signature.

e. All amendments to the solicitation must be acknowledged. Receipt by the offeror must be acknowledged in the space provided on the SF 1442 OR by returning a signed copy of each amendment by the time set for receipt of bids.

f. Bid Bond and Power of Attorney can be sent electronically (PDF) with an electronically submitted bid and originals will be required prior to award. Ensure any raised seals are visibile in the PDF to the maximum extent practicable.

7. Joint Venture Requirements - Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database. Applicable to set-aside solicitations: Joint Ventures must meet applicable size standards (See FAR Subpart 19.1). Submit with the proposal any size determination for the Joint Venture entity received from the Small Business Administration. A Joint Venture where-in one party is not a small business may be referred to the Small Business Administration ( IAW FAR 19.302 (b)) to determine eligibility. All questions regarding Joint Ventures must be directed to the Small Business Administration (SBA) and not the Contracting Officer.

Section 00100 - Bidding Schedule/Instructions to Bidders

INSTRUCTIONS TO BIDDERS

SECTION 00100 - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

Description of the Project: Construct a new 12,953sqft F16 Mission Training Center including four aircraft simulator bays, with supporting spaces, administrative space, and site work. General construction must provide all labor, equipment and material for the construction to include: demolition, site work, landscaping, concrete, asphalt paving, utilities, masonry, standing seam metal roofing, structural steel and miscellaneous metals, doors, windows and glazing, HVAC and DDC, plumbing, electrical and communications systems, fire and security alarm systems, fire suppression, flooring, demountable wall systems, painting, and other miscellaneous work as required. Proposal Options to include: (1) Construct masonry wall, chain link fence, dumpster enclosure w/ concrete pad, (2) Provide illuminated sign, standard building sign, window roller shades, & interior signage, (3) Provide landscaping (trees, shrubs, rock beds) & irrigation system I.L.O. grass only, (4) Provide aggregate temporary staging drives (4 simulator door locations) I.L.O. grass, (5) Tall brick masonry wainscot, building entry monolith, horizontal wall panels I.L.O.

1. INSTRUCTIONS TO BIDDERS:

a. You are invited to submit a bid in response to our Invitation for Bids (IFB) entitled W50S9622B0002 – Construct F-16 MTC, Project Number LUXC189012, at the 114th Fighter Wing Air National Guard Base, Sioux Falls, SD.

b. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.

c. This solicitation is set-aside 100% for small businesses.

2. EVALUATION FOR AWARD.

Option CLINs will be evaluated in accordance with FAR 52.217-5.

3. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT:

a. A pre-bid conference will be conducted on August 31, 2022 at 1:00 PM CST for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at 114th Fighter Wing – South Dakota Air National Guard Base, 1201 West Algonquin St, Sioux Falls, SD 57104. Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held following the conference.

b. In order to ensure your access to the military base and conference site, all attendees must register to attend this Pre-Bid Conference and Site Visit 5 days prior. Even if you have already have access to the base you must register to attend. Please register by sending an email with the following information for all attendees a minimum of 5 days in advance:

5. BID REPOSITORY AND BID OPENING:

6. WAGE DETERMINATION:

Construction Wage Rates applicable to this project are SD20220028 Modification 2, dated 05/20/2022, and provided in Section 00800.

7. BID PREPARATION EXPENSES AND PRE-CONTRACT COSTS:

This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

8. CLAUSES:

Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

9. DISPOSITION OF UNSUCCESSFUL BIDS:

In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful bids including the bid bond.

10. OFFERORS QUALIFICATIONS:

To establish its responsibility, the apparent low bidder may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work. This action may be requested to determine if the contractor is responsible.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. (c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is: 114th Fighter Wing, 1201 W Algonquin St, Sioux Falls, SD 57104.

52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT-- CONSTRUCTION MATERIALS UNDER

TRADE AGREEMENTS (MAY 2014)

(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “designated country construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American -- Construction Materials Under Trade Agreements” (Federal Acquisition Regulation (FAR) clause 52.225-11).

(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. An offer based on use of the foreign construction material for which an exception was requested-- (i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
