SECTION 01 11 00 Page 2

1.3.2 Horizontal and Vertical Control

Horizontal control must be NAD83 Georgia East state plane coordinate system. Vertical control must be Mean Lower Low Water (MLLW) based on EPOCH 1983-2001 datum.

1.4 WORK COVERED BY CONTRACT DOCUMENTS

1.4.1 Project Description

Construction work applies to the installation and removal of silt fence, including the daily inspection and maintenance of installed silt fence, clearing and grubbing of the entire DMCA interior and the top and inside slope of the existing dikes, harvesting of earth materials for placement, survey before, during, and after construction, placement and compaction of earth materials, establishment of turf, cleanup, maintenance of roadways, and the application of herbicde to the DMCA interior. The centerline alignment of the proposed new dike is approximately 9,270 feet . Clear the entire DMCA including around weirs and weir outfall basin areas. Relocate the two southeastern weirs, and provide additional catwalks. Provide weir risers on the two weirs along the cross dike. Raise the perimeter dike to a uniform elevation of 33 feet MLLW and raise the cross dike to the eastern side of the DMCA to a uniform elevation of 31 feet MLLW.

1.4.2 Borrow Availability

Obtain earth materials for construction from within the DMCA as shown.

The materials intended for use are sand, silt, and clay, or other materials classified by ASTM D2487, except Pt (Peat). See Drawings for borrow area limits. Sufficient earth materials are available at the borrow area to complete construction. The interior of the containment area is constantly undergoing a drying and consolidation process that renders the Contract survey inaccurate. Perform a topographic survey of the whole interior of DMCA 1N before harvesting of materials. The difference between the Contract survey and the before survey is the result of drying and consolidation of the site, and does not constitute a "changed" or "differing" site condition as defined elsewhere in this Contract.

1.4.3 Placement Limitation

The placement of earth materials while raising the island dikes must be at a rate of no more than 1 vertical foot of height per week. Additionally, sequence dike embankment construction so that there is no more than 2 feet difference in transverse elevation over a difference of 1,000 feet on the surface during construction.

1.4.4 Shoreline Change

The DMCA 1N shoreline is subject to erosion and shifting due to the tides, wind, and waves. As a result, the Contract survey may not reflect the current site conditions. Disparities between the design survey and the commencement of work does not constitute a changed or differing site condition.

1.4.5 Tolerance

There will be no payments made for materials placed outside the design templates, regardless of tolerance or acceptability criteria. Be aware of

SECTION 01 11 00 Page 3 construction limitations, degree of field control, alignments, weather, and other operational factors, and base the bid price for dike contruction accordingly. Section 31 00 00 EARTHWORK indicates a tolerance of + 0.5 foot which will be considered only for acceptance purposes of dike and ramp embankment. No tolerance will be allowed below the prescribed slopes or grades for dike and ramp embankments. Consider the costs of additional material in the appropriate bid price, as it will not be paid separately or considered in added bid quantities.

1.5 WORK REQUIREMENTS

a. Clear and grub the entire interior of the disposal area, including dikes, ramps, and existing bird island. Clear other areas necessary for construction access and silt fence placement. Obtain necessary burn permits.

c. Raise the cross dike and add extensions to the two weir/water control structures.

d. Complete grassing/turf establishment.

e. Cleanup and removal of debris as needed.

f. Items incidental to work requirements include but are not limited to moisture adjustment of in-place soils to within acceptable ranges for use as fill.

g. As a last order of work, application of herbicide to the interior of the DMCA.

1.6 PROTECTION OF EXISTING CONDITIONS AND NEW WORK

In addition to FAR 52.236-9 "Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":

a. Excavate, transport, and construct in such a manner as to prevent injury or damage to portions of the existing work which will remain and to new work. Repair or replace portions of new work which have been altered during construction operations at no aditional cost to the Government.

b. Repair or replace portions of existing conditions which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing surfaces and vegetation adjacent to the new work must be in a condition equal to or better than that which existed before new work started.

1.7 WORK IN QUARANTINED AREA

USACE and the U.S. Department of Agriculture (USDA) have a compliance agreement requiring measures to prevent the spread of certain plant pests that may be present in the soil ( ER 1110-1-5 ). Major portions of the southeastern states are in a quarantine area for such pests, including the imported fire ant. In addition, adjacent states to the north have introduced infestations resulting from movement of soil from infested southeastern states. Thoroughly clean land-based construction equipment and tools at the previous job site to ensure these implements are free from residual soil, egg deposits from plant pests, noxious weeds, and

SECTION 01 11 00 Page 4 plant seeds. Thoroughly clean equipment using water under pressure and thoroughly clean hand tools by brushing or other means to remove soil. In addition, thoroughly clean construction equipment and hand tools used for this Contract before they are brought to the job site and before they are removed from this job site and notify Government for inspection. Consult with the USDA jurisdictional office for additional cleaning requirements that may be necessary.

1.8 CONTRACTOR REQUIREMENTS

a. Project Involves Handling of Asbestos: No

b. Occupancy During Construction: No

c. Phasing of Work: No

d. Small Project Construction Schedule: Bar Chart

e. CQC System Requirements: CQC Manager

1.9 PRE-BID SITE VISIT

Prior to the submission of bids, bidders are highly encouraged to visit the project site location to become familiar with the project requirements. Failure to visit the project site will not disqualify a bid; however, the Contractor must comply with the terms and conditions of the resultant Contract, regardless of such failure. In no event will a failure to inspect the site constitute grounds for a claim after Contract award.

1.10 COMMUNICATIONS

The Contractor must maintain a cellular telephone for communication between the project site and the District Office.

1.11 WARRANTY

Provide a minimum of 1 year warranty on materials and workmanship from the date of the Government's acceptance of the work.

1.12 LOCATION OF UNDERGROUND UTILITIES

Obtain digging permits prior to start of excavation, and comply with Installation requirements for locating and marking underground utilities.

Contact local utility locating service a minimum of 48 hours prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday. Verify existing utility locations indicated on contract drawings, within area of work.

Notify the Contracting Officer at least 15 days prior to starting excavation work.

1.7.4 Copies Delivered to the Government

Deliver one copy of submittal register updated by Contractor to Government with each invoice request.

1.8 SCHEDULING

Schedule and submit concurrently product data and shop drawings covering component items forming a system or items that are interrelated. Submit pertinent certifications at the same time. No delay damages or time extensions will be allowed for time lost in late submittals. Allow 30 calendar days for review and approval of submittals.

SECTION 01 33 00 Page 8

a. Coordinate scheduling, sequencing, preparing, and processing of submittals with performance of work so that work will not be delayed by submittal processing. The Contractor is responsible for additional time required for Government reviews resulting from required resubmittals. The review period for each resubmittal is the same as for the initial submittal.

b. Submittals required by the contract documents are listed on the submittal register. If a submittal is listed in the submittal register but does not pertain to the contract work, the Contractor is to include the submittal in the register and annotate it "N/A" with a brief explanation. Approval by the Contracting Officer does not relieve the Contractor of supplying submittals required by the contract documents but that have been omitted from the register or marked "N/A."

c. Resubmit the submittal register and annotate it monthly with actual submission and approval dates. When all items on the register have been fully approved, no further resubmittal is required.

1.9 GOVERNMENT APPROVING AUTHORITY

When the approving authority is the Contracting Officer, the Government will:

a. Note the date on which the submittal was received.

b. Review submittals for approval within the scheduling period specified and only for conformance with project design concepts and compliance with contract documents.

c. Identify returned submittals with one of the actions defined in paragraph REVIEW NOTATIONS and with comments and markings appropriate for the action indicated.

Upon completion of review of submittals requiring Government approval, stamp and date submittals.

1.9.1 Review Notations

Submittals will be returned to the Contractor with the following notations:

a. Submittals marked "approved" or "accepted" authorize proceeding with the work covered.

b. Submittals marked "approved as noted" or "approved, except as noted, resubmittal not required," authorize proceeding with the work covered provided that the Contractor takes no exception to the corrections.

c. Submittals marked "not approved," "disapproved," or "revise and resubmit" indicate incomplete submittal or noncompliance with the contract requirements or design concept. Resubmit with appropriate changes. Do not proceed with work for this item until the resubmittal is approved.

d. Submittals marked "not reviewed" indicate that the submittal has been previously reviewed and approved, is not required, does not have evidence of being reviewed and approved by Contractor, or is not

SECTION 01 33 00 Page 9 complete. A submittal marked "not reviewed" will be returned with an explanation of the reason it is not reviewed. Resubmit submittals returned for lack of review by Contractor or for being incomplete, with appropriate action, coordination, or change.

e. Submittals marked "receipt acknowledged" indicate that submittals have been received by the Government. This applies only to "information-only submittals" as previously defined.

1.10 DISAPPROVED SUBMITTALS

Make corrections required by the Contracting Officer. If the Contractor considers any correction or notation on the returned submittals to constitute a change to the contract drawings or specifications, give notice to the Contracting Officer as required under the FAR clause titled CHANGES. The Contractor is responsible for the dimensions and design of connection details and the construction of work. Failure to point out variations may cause the Government to require rejection and removal of such work at the Contractor's expense.

If changes are necessary to submittals, make such revisions and resubmit in accordance with the procedures above. No item of work requiring a submittal change is to be accomplished until the changed submittals are approved.

1.11 APPROVED SUBMITTALS

The Contracting Officer's approval of submittals is not to be construed as a complete check, and indicates only that the general method of construction, materials, detailing, and other information are satisfactory.

The design, general method of construction, materials, detailing, and other information appear to meet the Solicitation and Accepted Proposal.

Approval or acceptance by the Government for a submittal does not relieve the Contractor of the responsibility for meeting the contract requirements or for any error that may exist, because under the Quality Control (QC) requirements of this contract, the Contractor is responsible for ensuring information contained with in each submittal accurately conforms with the requirements of the contract documents.

After submittals have been approved or accepted by the Contracting Officer, no resubmittal for the purpose of substituting materials or equipment will be considered unless accompanied by an explanation of why a substitution is necessary.

1.12 APPROVED SAMPLES

Approval of a sample is only for the characteristics or use named in such approval and is not be construed to change or modify any contract requirements. Before submitting samples, provide assurance that the materials or equipment will be available in quantities required in the project. No change or substitution will be permitted after a sample has been approved.

Match the approved samples for materials and equipment incorporated in the work. If requested, approved samples, including those that may be damaged in testing, will be returned to the Contractor, at its expense, upon completion of the contract. Unapproved samples will also be returned to the Contractor at its expense, if so requested.

SECTION 01 33 00 Page 10

Failure of any materials to pass the specified tests will be sufficient cause for refusal to consider, under this contract, any further samples of the same brand or make as that material. The Government reserves the right to disapprove any material or equipment that has previously proved unsatisfactory in service.

Samples of various materials or equipment delivered on the site or in place may be taken by the Contracting Officer for testing. Samples failing to meet contract requirements will automatically void previous approvals. Replace such materials or equipment to meet contract requirements.

Approval of the Contractor's samples by the Contracting Officer does not relieve the Contractor of its responsibilities under the Contract.

1.13 WITHHOLDING OF PAYMENT

Payment for materials incorporated in the work will not be made if required approvals have not been obtained.
