IV. PROVISIONS AND CLAUSES

mailto:hasan.j.williams.mil@army.mil mailto:susette.lujardolahera.mil@army.mil

This solicitation document and incorporated provisions and clauses are those in effect through the most recent Federal Acquisition Circular. The following clauses apply to this acquisition and are incorporated by reference:

• FAR 52.212-1, Instructions to Offerors – Commercial Products and Commercial

Services. (See Section VI for details).

• FAR 52.212-2, Evaluation – Commercial Products and Commercial Services.

(See Section V for details).

• FAR 52.212-3, Offeror Representations and Certifications – Commercial

Products and Commercial Services.

• FAR 52.212-4, Contract Terms and Conditions – Commercial Products and

Commercial Services.

• FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or

Executive Orders – Commercial Products and Commercial Services.

The full text of these clauses may be accessed electronically at https://www.acquisition.gov/.

V. EVALUATION (IAW FAR 52.212-2)

(a) Basis for Award: The Government intends to award a contract to the responsible offeror whose proposal complies with the solicitation requirements and is determined to be the most advantageous based on Price and Technical Acceptability.

1.Price

The Government will assess the prices of all acceptable offers to determine whether they are fair and reasonable. Award will be made to the offeror with the lowest evaluated price among the technically acceptable proposals.

Reasonableness: The existence of adequate price competition is expected to support a determination of reasonableness; a price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

Realism: Analysis the government uses to ensure the quoter understands the requirement. Quoting unrealistically low in price may be considered indicative of a lack of understanding of the complexity and risk in the contract requirements. Unrealistic offers may not be considered for award. The ability of the quoter to perform aspects of the anticipated contract from inception to completion will be considered as part of the overall "realism" evaluation.

Completeness: Completeness is compliance of the quoter with Addendum to FAR Provision 52.212-1, Instruction to Offerors.

Unbalanced pricing: Exists when, despite an acceptable evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of price analysis techniques. Quotes that are determined to be unbalanced may be rejected if the lack of balance poses a significant risk to the Government.

2. Technical Acceptability

Offeror shall submit a copy of its National Propane Gas Association Certification for New Mexico and Texas.

Offeror must submit documentation demonstrating 3 to 5 years of experience providing propane deliveries.

Offeror must provide at least two contracts that show proof of performance in the last two years.

3.Past Performance

Must provide capabilities and past experiences of delivering Propane in a timely manner.

(b) Process: The Government will conduct an initial evaluation of all proposals to determine price acceptability and whether the proposed prices are fair and reasonable.

From the set of proposals found technically acceptable, the Government will then identify the offeror that most clearly demonstrates the capability to meet the requirements specified in PWS. As part of this determination, the offeror must show the ability to mobilize and begin performance promptly upon contract award.

Technical Acceptable and Unacceptable Ratings

Rating Description

Acceptable Offer clearly meets all evaluation factors of the solicitation.

Unacceptable Offer does not meet the minimum requirements of the solicitation.

Once that offeror is identified, the Government will perform a price‑reasonableness analysis on the proposed price. If the price is determined to be fair and reasonable, the

Government will make award to that offeror without further consideration of the remaining proposals.

VI. SUBMISSION INSTRUCTIONS

Offerors shall submit their proposals electronically via email to the primary and secondary points of contact listed above no later than the specified response date and time. The submission shall consist of two (3) separate volumes:

• Volume I - Price Proposal: The Offeror shall submit a completed pricing schedule for CLIN 0001, providing a unit price per gallon for the initial 12-month firm-fixed-price period.

• Volume II - Technical Proposal: A detailed narrative addressing how the offeror will meet all requirements in the Performance Work Statement. Do not include any pricing information in this volume.

• Volume III- Phase In: A 72-hour phase-in period will commence upon contract award. The purpose of this period is to ensure the contractor is fully prepared to begin performance in accordance with the PWS The contractor shall use this time to finalize all arrangements, including personnel, facilities, and materials.

Full performance in accordance with the solicitation requirements shall begin immediately following the conclusion of the 72-hour phase-in period.

All question responses regarding this solicitation must be submitted by email no later than 22 June 2026 at 09:00 AM MST to ensure the Government can provide a timely response. All official Government responses will be issued through a written amendment to the solicitation.
