TOTALS

TOTAL CLINS 0001 thru 0003 $__________________________

NOTES:

The Contractor must bid on all items of the bid schedule.

CLIN 001 is the amount the Contractor will pay the Government for the material located in cell A.1. CLIN 002 is the amount the Government will compensate the Contractor (Contractor) for mobilization and demobilization to Houghtaling Island, as well as for the excavation and transport of material out of containment cell A.1. CLIN 003 is the amount the Government will compensate the Contractor (Contractor) for maintaining the containment site and access trail used during harvesting, as well as for the restoration and final stabilization of Cell A.1 after all purchased material is harvested (including a final As-Built survey of the restored work area).

Bids will be evaluated by the best offer tendered (total bid), based on the difference between CLIN 001 (PLUS) and

CLINS 002 & 003 (MINUS):

CLIN 001 – (CLIN 002 + CLIN 003) = Total Bid

If the Contractor’s payment for CLIN 001 is greater than the requested compensation for CLIN 002 + CLIN 003, then the winning bid will be the highest payment to, and greatest profit for, the Government.

If the Contractor’s payment for CLIN 001 is less than the requested compensation for CLIN 002 + CLIN 003, then the winning bid will be lowest payment to the Contractor constituting the least cost to the Government.

In accordance with 28.102-2 Amount required.

(b) Contracts exceeding $150,000(1) Performance bonds.

Unless the contracting officer determines that a lesser amount is adequate for the protection of the Government, the penal amount of performance bonds must equal-

Typically, performance and payment bonds are not required on construction acquisition below $150,000.00. Due to the sensitive nature of Houghtaling island, If the island is damaged from extraction of the sand in any way the government requires protection in case the contractor fails to resort the damages back to existing conditions.

Furthermore, if the island is damaged while the removal of the fill is occurring, or if the contractor does not remove the fill, USACE New York District would be required to find an additional disposal site for ongoing maintenance dredging projects.

Due to the above conditions and circumstances the Government is requiring the awarded contractor to provide performance and payment bonds for the absolute value of the contract.
